          A regular meeting of the Civil Service Commission was held on Wednesday, February 20, 2019, at 10:00 a.m., in Trenton, New Jersey.

 

          PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan (via telephone); Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 20, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Arthur Chew, Supervising Engineer, Ocean City, Department of Administration, layoff.

 

Kathleen Cooke, Senior Clerk Driver, Atlantic County, Department of Administrator, removal.

 

Paulo DeOliveira, Police Officer, Township of Hillside, Police Department, 15 working day suspension.

 

Donna Gallagher, Hospital Attendant, Hudson County, Department of Health and Human Services, 90 working day suspension.

 

Elijah James, Police Lieutenant, Irvington Township, Department of Public Safety, 15 working day suspension.

 

Narcissa Miller, Judiciary Clerk 2, Cumberland/Gloucester/Salem Vicinage, resignation not in good standing.

 

Terry Phillips, Technician, MIS, City of Atlantic City, Department of Administration, 90 working day suspension.

 

Patrick Woods, Plumber and Steamfitter, Trenton Psychiatric Hospital, Department of Health, removal.

 

ACTION: The Civil Service Commission noted the withdrawal of appeals without prejudice.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

 

Christopher Calhoun, Cook, 12-months, Woodbine Developmental Center, Department of Human Services, resignation not in good standing.

 

Dawud Cross, City of Newark, Department of Recreation, Cultural Affairs and Senior Services, removal.

 

ACTION:     The Civil Service Commission noted the dismissal of appeals without prejudice.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

 

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    THOMAS COGHAN

 

Thomas Coghan, Sheriff’s Officer, Middlesex County, Sheriff’s Department, 20 working day suspension on charges of chronic or excessive absenteeism and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 20 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    BRANDI L. HUNT

 

Brandi L. Hunt, Senior Correctional Police Officer, Mountainview Youth Correctional Facility, Department of Corrections, removal effective April 24, 2018 on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    FIRE PREVENTION SPECIALIST – CSC DOCKET NO. 2019-1953

 

          The Division of Agency Services recommends the reallocation of the Fire Prevention Specialist title to the noncompetitive division of the career service.

         

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-2    R.D.F – CSC DOCKET NO. 2018-1378

 

          R.D.F., represented by Robert K. Chewning, Esq., appeals his rejection as a Police Officer candidate by the Montville Township Police Department and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    J.J.N. – CSC DOCKET NO. 2018-2076

 

          J.J.N., represented by Donald A. DiGioia, Esq., appeals his rejection as a Police Officer candidate by the Linden Police Department and its request to remove his name from the eligible list for Police Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

         

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-4    K.R. – CSC DOCKET NO. 2018-3079

 

          K.R. appeals her rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove her name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the positions.

         

ACTION:     The Civil Service Commission directed that the appellant be referred for an independent psychological evaluation.

 

B-5    BRIAN T. COOKE – CSC DOCKET NO. 2018-3282

 

          Brian T. Cooke appeals the removal of his name from the Police Officer (S9999U), Deptford Township eligible list on the basis of an unsatisfactory background.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    TAMIKA FARLOW – CSC DOCKET NO. 2019-1382

 

          Tamika Farlow, represented by Juan C. Cervantes, Esq., appeals the removal of her name from the Correctional Police Officer (S9988U), Department of Corrections eligible list on the basis of an unsatisfactory criminal record.

         

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-7    CYNTHIA B. RUIZ – CSC DOCKET NO. 2019-291

 

          Cynthia B. Ruiz appeals her removal from the eligible list for Correctional Police Officer (S9999U), Juvenile Justice Commission for failing to complete pre-employment processing.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    REPRESENTATIVE CITIZENS COMPLAINTS (M0767V), JERSEY CITY – CSC DOCKET NO. 2019-856

 

          The Division of Agency Services requests that the City of Jersey City be ordered to return the January 18, 2018 certification (OL180058) of the eligible list for Representative Citizens Complaints (M0767V), for proper disposition.

         

ACTION:     The Civil Service Commission ordered the appointing authority to properly dispose of the certification and pay compliance costs in the amount of $1,000.

 

B-9    RODNEY BROWN – CSC DOCKET NO. 2019-678

 

          Rodney Brown appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirement for the promotional examination for Head Barber (PS7278H), Ancora Psychiatric Hospital.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-10  PAMELA MEDINA – CSC DOCKET NO. 2019-1424

 

          Pamela Medina appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Employee Relations Coordinator (PS4300K), Department of Human Services.

         

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11  CATHERINE MOON – CSC DOCKET NO. 2019-1705

 

          Catherine Moon appeals the decision of the Division of Agency Services which found that her position with the Department of Law and Public Safety is correctly classified as Travel Coordinator, Department of Law and Public Safety. The appellant seeks an Administrative Assistant 1 job classification.

         

ACTION:     The Civil Service Commission directed that the classification of the position encumbered by Catherine Moon be re-reviewed.

 

B-12  MICHAEL MILLING – CSC DOCKET NO. 2019-589

 

          Michael Milling, represented by Jenelle Blackmon, Communications Workers of America Staff Representative, requests enforcement of a determination by the Division of Agency Services that his position with William Paterson University is properly classified as a Professional Services Specialist 2, Computer Services.

         

ACTION:     The Civil Service Commission directed that this request be held in abeyance pending a classification review of the appellant’s position.

 

B-13  RASHEED NELSON – CSC DOCKET NO. 2019-1240

 

          Rasheed Nelson appeals the determination of the Division of Agency Services that he did not meet the experience requirement for the open-competitive examination for Electrician (M0472W), City of Newark.

         

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-14  SCOTT STAHLMANN – CSC DOCKET NO. 2019-1136

 

          Scott Stahlmann appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the open-competitive examination for Personnel Officer (C0631W), Bergen County.

         

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15  JANET STENDARDO, ET AL. – CSC DOCKET NOS. 2018-3612, ET AL.

 

          Janet Stendardo, David Cunningham and James Seaver appeal the administration of the promotional examination for Assistant District Parole Supervisor (PS5490I), State Parole Board.

         

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-16  ROBERT JEDZINIAK, ET AL. – CSC DOCKET NOS. 2019-1460, ET AL.

 

          Robert Jedziniak, Geovanni Molina, Kevin Muller, Christopher Pellegrino and Juliette Vogt, represented by Michael L. Prigoff, Esq., former Fire Fighters with Jersey City, appeal their resignations in good standing.

         

ACTION:     The Civil Service Commission directed that these appeals be denied.

B-18  PIETRO VELARDI – CSC DOCKET NO. 2019-34

 

          Pietro Velardi, represented by Craig Gumpel, Esq., appeals the removal of his name from the Fire Fighter (M1513T), Clifton eligible list due to his failure to appear for the Physical Performance Test.

                   

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19  ALELI CRAWFORD – CSC DOCKET NO. 2019-1783

 

          Aleli Crawford appeals the determination of the Division of Agency Services that the proper classification of her position with the Office of the Public Defender is Assistant Deputy Public Defender 2. The appellant seeks an Assistant Deputy Public Defender 1 job classification.

                   

ACTION:     The Civil Service Commission directed that this appeal be remanded to the Division of Agency Services.

 

B-20  BRIAN BRENNAN – CSC DOCKET NO. 2019-1827

 

          Brian Brennan appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Mechanic (PC1301W), Middlesex County.

                   

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-21  JERMICA CLAYTOR – CSC DOCKET NO. 2019-1824

 

          Jermica Claytor appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Administrative Analyst 3, Fiscal Management (PS7370DN), Department of Community Affairs.

                   

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-22  MINDI KUSNAIK – CSC DOCKET NO 2019-86

 

          Mindi Kusnaik appeals the determination of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for Assistant Personnel Officer (PM0587W), Linden.

                   

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23  ISMAEL RIVERA, JR. – CSC DOCKET NO. 2018-3637

 

          Ismael Rivera, Jr. appeals the administration of the promotional examination for Investigator 2, Motor Vehicle Commission (PS5382T).

                   

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-24  JAMES DONOVAN, ET AL. – CSC DOCKET NOS. 2019-1346, ET AL.

 

          James Donovan and Terence Joynt (PM1774W), Bayonne; Daniel McGuire (PM1792W), Ewing; and Walter Laurencio (PM1914W), Union City; appeal the examination for Police Captain (various jurisdictions).

                   

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-25    MARK MOSKAL, ET AL. - CSC DOCKET NOS. 2019-1319, ET AL.

 

Mark Moskal (PM1933W), Bloomfield; Christopher Boller and Charles Morgan (PM1947W), Ewing; Peter Zanin (PM1967W), Hoboken; Joseph Scullion (PM1996W), Margate; Debbie Teixeira and Wyhidi Wilson (PM2013W), Newark; Alexander Castellon, Martin Grycuk and Michael Kisfalvi (PM2019W), Passaic; David Chasmer and David Dunlay (PM2036W), Union City; and Christopher Majewski (PM2040W), Weehawken; appeal the examination for Police Lieutenant (various jurisdictions).

         

ACTION:     The Civil Service Commission directed that theses appeals be denied.

 

B-26  STEPHEN RIZNYK – CSC DOCKET NO. 2019-1928

 

          Stephen Riznyk requests to be permitted to submit an application for the promotional examination for County Correction Captain (PC2910W), Monmouth County after the filing deadline.

                   

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-27  ALBERTO APONTE – CSC DOCKET NO. 2019-1756

 

          Alberto Aponte, a former County Correction Sergeant with Essex County, represented by Joshua M. Forsman, Esq., petitions the Civil Service Commission for interim relief of his removal.

                   

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-28  L.P. – CSC DOCKET NO. 2018-2774

 

          L.P., an Institutional Transportation Supervisor with the Woodbine Developmental Center, appeals the determination of the Assistant Commissioner, Legal Affairs, Department of Human Services, which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

                   

ACTION:     The Civil Service Commission directed that this matter be transmitted to the Office of Administrative Law for a hearing.
