A regular meeting of the Merit System Board was held on Wednesday February 27, 2008, in Trenton, New Jersey.

PRESENT: Chairman Rolando Torres, Jr., Merit System Board Members Flavella Branham, John Currie, Margaret E.L. Howard, and Robert J. Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairman Rolando Torres Jr., opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 21, 2007, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION:   The Merit System Board acknowledged the settlements.

A-2   WILLIAM LAYTON

William Layton, County Correction Officer, County of Burlington, County Jail, six-day suspension on charges of neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the six-day suspension.

ACTION:   The Merit System Board modified the recommendation of the Administrative Law Judge to a two-day suspension.

A-3   JEFFREY NEMES

Jeffrey Nemes, Police Officer, Township of Hamilton, Department of Public Safety, indefinite suspension pending disposition of criminal charges.

Recommendation of the Administrative Law Judge - Grant appointing authority's motion for summary decision and dismiss the appeal with prejudice.

ACTION:   The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-4   JAMES STEWART

James Stewart, Police Officer, City of Newark, Police Department, ten-day, five-day and one-day suspensions on charges of violations of Department rules and regulations regarding obedience to orders, uniform, confidential information and official orders and neglect of duty.

Recommendation of the Administrative Law Judge - Modify the ten-day suspension to a five-day suspension, reverse the five-day suspension and modify the one-day suspension to a written warning.

ACTION:   The Merit System Board affirmed the Administrative Law Judge with regard to the 10-day suspension but modified the five-day suspension to an official written reprimand, and upheld the one-day suspension.

A-5   STYNA BRIDGEFORTH

Styna Bridgeforth, County Correction Officer, County of Hudson, Department of Corrections, removal effective February 8, 2005, on charges of inability to perform duties and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:   The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-6   LINWOOD BUGG

Linwood Bugg, Fire Alarm Operator, City of Paterson, Fire Department, removal effective January 11, 2005, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:   The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-7   LYNN R. VANDERVEER

Lynn R. VanDerveer, Senior Alcoholism Counselor, County of Burlington, Department of Health, removal effective February 20, 2007, on charges of inability to perform duties, neglect of duty and other sufficient cause.

   Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:   The Merit System Board modified the recommendation of the Administrative Law Judge to a resignation in good standing.

A-8   BRIAN WASHINGTON

Brian Washington, Human Services Assistant, Trenton Psychiatric Hospital, Department of Human Services, removal effective January 18, 2005, on charges of neglect of duty, physical or mental abuse of a patient, violation of administrative procedures and/or regulations involving safety and security, failure to report injury, abuse or accident involving patient.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:   The Merit System Board affirmed the recommendation of the Administrative Law Judge.

SECTION B - MISCELLANEOUS MATTERS

B-1   BETTY CREAMER

Betty Creamer, a Cottage Training Technician with Vineland Developmental Center, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

ACTION:   The Merit System Board directed that this appeal be granted.

B-2   BERNADETTE MARX

Bernadette Marx, a Secretarial Assistant 1 with the Department of Health and Senior Services, appeals the denial of sick leave injury (SLI) benefits.

ACTION:   The Merit System Board directed that this appeal be denied.

B-3   TRAVIS ASH

The appointing authority appeals the decision of the Division of Local Human Resource Management (LHRM), which found that there was a sufficient basis to restore Travis Ash to the Police Officer (S9999H), Gloucester Township eligible list, on the basis of falsification of his employment application.

ACTION:   The Merit System Board directed that this appeal be granted and that Ash's name be removed from the eligible list.

B-4   ISA MCCLENDON

Isa McClendon appeals the removal of her name from the Correction Officer Recruit (S9999F), Department of Corrections, eligible list due to an unsatisfactory employment record.

ACTION:   The Merit System Board directed that this appeal be granted.

B-5   SEAN REYNOLDS

Sean Reynolds appeals Pemberton Township's request to remove his name from the eligible list for Police Officer (S9999F), on the basis of an unsatisfactory background report. The appellant also appeals the Department of Corrections' request to remove his name from the eligible list for Correction Officer Recruit (S9999F), on the basis that he had already been removed from the pool of eligibles pursuant to N.J.A.C. 4A:4-7.7(g).

ACTION:   The Merit System Board directed that these appeals be denied.

B-6   VANESSA VILLEGAS-RUIZ

Vanessa Villegas-Ruiz appeals the decision of the Division of State Human Resource Management which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Correction Officer Recruit (S9999F), Department of Corrections eligible list due to an unsatisfactory employment history and the falsification of her application.

ACTION:   The Merit System Board directed that this appeal be denied.

B-7   JOHN D. WEST, JR.

John D. West, Jr., a former Fire Prevention Specialist, UFD, represented by Gregg L. Zeff, Esq., appeals the removal of his name from the Supervising Fire Prevention Specialist (PM1728E), City of Newark, eligible list due to his retirement effective December 31, 2003.

ACTION:   The Merit System Board directed that this appeal be denied.

B-8   GEORGE MLADENETZ

George Mladenetz, a Research Scientist 2 with the Department of Human Services, appeals the determination of the Acting Assistant Commissioner for Human Resources, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to additional violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace

ACTION:   The Merit System Board directed that thisappeal be granted in part and remanded to the appointing authority for consideration of the appropriate penalty for Frances Miceli for her violation of the State Policy and for an investigation of the allegation of third party sexual harassment.

B-9   DORITA PANIAGUA

Dorita Paniagua, an Institutional Trade Instructor 1, Cooking, with East Jersey State Prison, Department of Corrections (DOC), appeals the determination of the Assistant Director, Equal Employment Division, DOC, stating that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Policy).

   ACTION:   The Merit System Board directed that this appeal be denied.

B-10   JENIFER OSBORN

Jenifer Osborn, a Chief, Property Management with the Department of the Treasury, appeals that part of the determination of the Affirmative Action Officer stating that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Policy). The appellant also appeals the determination of the Affirmative Action Officer that she did not present sufficient evidence to support a finding that she had been subjected to a violation of the State Policy on the basis of retaliation. This matter was held over from the November 21, 2007 Merit System Board meeting.

ACTION:   The Merit System Board directed that this appeal be denied but remanded the matter to the appointing authority for a determination of the appropriate penalty for McLaughlin based on his violation of the State Policy, as well as any further penalties that may be appropriate.

B-11   CHRISTINE SHEARER

Christine Shearer, a Secretarial Assistant 1 with the Department of Human Services, appeals the determination of the Acting Assistant Commissioner for Human Resources, stating that there was probable cause to substantiate a finding that she violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:   The Merit System Board directed that this appeal be denied.

B-12   BARBARA LOSAGIO

Barbara Losagio, a former part-time Technical Assistant, Construction Official, with the Township of Pohatcong, represented by Donald E. Souders, Jr., Esq., appeals the determination of the former Division of Human Resource Management (now the Division of Local Human Resource Management), regarding enforcement of its determination with respect to sick leave and vacation pay for herself and the estate of her late husband, Anthony Losagio, a former part-time Construction Official and Zoning Officer with Pohatcong.

ACTION:   The Merit System Board ordered Pohatcong pay Ms. Losagio $6,366.36 for her accrued sick leave and to calculate and make payment for Ms. Losagio's and Mr. Losagio's pro-rated vacation entitlements. The Merit System Board denied the appeal for payment of Mr. Losagio's accrued sick leave. The Matter of the good faith of Ms. Losagio's layoff be referred to the Office of Administrative Law for a hearing and for Pohatcong to provide to Local Human Resource Management all relevant personnel records concerning Ms. Losagio's employment so that it can make any necessary corrections to her CAMPS record.

B-13   DARRYL THOMAS

Darryl Thomas, a former Supervising Juvenile Detention Officer with Cumberland County appeals his resignation in good standing effective October 11, 2007.

ACTION:   The Merit System Board directed that this appeal be denied.

B-14   JADWIGA WARWAS

Jadwiga Warwas, a Health Officer with the City of Plainfield, represented by Stephen E Klausner, Esq., petitions the Merit System Board for relief pursuant to N.J.S.A. 11A:2-24 and N.J.A.C. 4A:2-5.1, from alleged reprisal from her employer.

ACTION:   The Merit System Board directed that this appeal be denied.

B-15   JOYCE CREA

Joyce Crea petitions the Merit System Board for reconsideration of the decision rendered on April 11, 2007 which found that she was below the minimum requirements in experience for the qualifying examination for Governmental Relations Specialist 2, Department of Labor and Workforce Development.

ACTION:   The Merit System Board directed that this appeal be denied.

B-16   DEBORAH PALOMBI

Deborah Palombi, a Human Resource Consultant 1 with the Department of Personnel, presented by Michael D. Brottman, Esq., petitions the Merit System Board for reconsideration of its decision, In the Matter of Deborah Palombi (MSB decided February 28, 2007), which granted in part her request for sick leave injury (SLI) benefits.

ACTION:   The Merit System Board directed that this appeal be denied.

The appeal of General McFadden, a Fire Alarm Operator with the City of Paterson, of his 30 working day suspension on charges, was heard by Administrative Law Judge Jesse H. Strauss (ALJ), who rendered his initial decision on January 4, 2008. At its meeting on February 13, 2008, the Merit System Board did not adopt the ALJ's recommendation to uphold the 30 working day suspension. Rather, the Board increased the penalty to a 120 working day suspension. The proposed final decision is now submitted for the Board's review.

ACTION:   The Merit System Board adopted the final decision.

At its meeting on February 13, 2008, the Merit System Board did not adopt the ALJ's recommendation to reverse the removal. Rather, the Board ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.

At its meeting on February 13, 2008, the Merit System Board did not adopt the ALJ's recommendation to increase the 10 working day suspension to a 20 working day suspension. Rather, the Board increased the 10 working day suspension to a 45 working day suspension. The proposed final decision is now submitted for the Board's review.

ACTION:   The Merit System Board directed that this appeal be denied.

B-23   ARVIND K. PATEL

Arvind K. Patel appeals the determination of the Division of Selection Services which found that he did not meet the experience requirements for the promotional examination for Administrative Analyst 2, Data Processing (PS1695K), Department of Children and Families.

ACTION:   The Merit System Board directed that this appeal be denied.

B-24   IGNAZIA S. REDDICONTO

Ignazia S. Reddiconto appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for a prospective provisional appointment to the title of Training Technician, Juvenile Justice Commission.

Jennifer Tanforan appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Senior Interviewer, Veterans Services (PS1710N), Department of Labor and Workforce Development.

The Township of Parsippany-Troy Hills requests relaxation of N.J.A.C. 4A:4-7.1A(c) so as to permit the intergovernmental transfer of Gian F. Cacioppo from the title of Sheriff's Officer, Union County Sheriff's Office, to the title of Police Officer, Township of Parsippany-Troy Hills.

ACTION:   The Merit System Board granted the request.

The appeal of Juan Melendez, a County Correction Officer with the Hudson County Department of Corrections of his 30-day suspension, on charges, was heard by Administrative Law Judge Walter M. Braswell (ALJ), who rendered his initial decision on January 4, 2008. At its meeting on February 13, 2008, the Merit System Board adopted the ALJ's recommendation to modify the 30-day suspension to a 15-day suspension. The proposed decision is now submitted for the Board's review.

The appeal of Eric Cotton, a Cottage Training Technician with Woodbridge Developmental Center, Department of Human Services, of his 10-day suspension and removal effective July 14, 2006, on charges, was heard by Administrative Law Judge Douglas H. Hurd (ALJ), who rendered his initial decision on November 28, 2007. At its meeting on February 13, 2008, the Merit System Board adopted the ALJ's recommendation to reverse the removal. However, the Board did not adopt the ALJ's recommendation to reverse the 10-day suspension. Rather the Board modified the 10-day suspension to a five-day suspension. The proposed decision is now submitted for the Board's review.

B-35   LAKISHA TYSON

The appeal of Lakisha Tyson, a Human Services Assistant at New Lisbon Developmental Center, Department of Human Services, of her removal, effective September 6, 2006, on charges was heard by Administrative Law Judge Lisa James-Beavers (ALJ), who rendered her initial decision on December 21, 2007. At its meeting on February 13, 2008, the Merit System Board did not adopt the ALJ's recommendation to modify the removal to a 90-day suspension. Rather, the Board imposed a six-month suspension and ordered training in anger management. The proposed decision is now submitted for the Board's review.

ACTION:   The Merit System Board on its own motion, granted reconsideration of its prior decision and adopted the ALJ's recommendation to modify the removal to a 90-day suspension.

B-36   GLEN WILSON

Glen Wilson appeals his rejection as a Police Officer candidate by the City of Newark and its request to remove his name from the eligible list for Police Officer (S9999F) on the basis of medical unfitness to perform effectively the duties of the position.

ACTION:   The Merit System Board directed that this appeal be granted.

B-37   BRIAN MONTAGUE

The Borough of East Rutherford requests that the provisions of N.J.A.C. 4A:4-7.1A be relaxed in order to process the Intergovernmental Transfer of Brian Montague from the title of Sheriff's Officer, Passaic County Sheriff's Office to the title of Police Officer, Borough of East Rutherford.

ACTION:   The Merit System Board granted the request.

B-38   SHERIFF'S OFFICERS AND COUNTY CORRECTION OFFICERS, PASSAIC COUNTY SHERIFF'S OFFICE

The Passaic County Sheriff's Office and the Director, Division of Classification and Compensation, request that the provision of N.J.A.C. 4A:4-7.1A be relaxed in order to permit the Intergovernmental Transfers of specific incumbents in the title of Sheriff's Officer, Passaic County Sheriff's Office, to the title of Police Officer. The Passaic County Sheriff also requests that the working test period be relaxed for certain qualified staff in order for their names to be place on the Rice Bill list. Further, the Director, Division of Classification and Compensation, requests that the provisions of N.J.A.C. 4A:4-7.1A be relaxed in order to permit the Intergovernmental Transfers of incumbents in the title of Sheriff's Officer or County Correction Officer, Passaic County Sheriff's Officer, who have not completed their 12-month working test period. Anthony Batelli, Melissa Corrado, and Christopher Patacco appeal the date of their lateral title change to Sheriff's Officer and request that their names be placed on the Rice Bill list.

ACTION:   The Merit System Board granted the requests but denied the appeals of Mr. Batelli, Ms. Corrado and Mr. Patacco regarding the effective date of their lateral title change to Sheriff's Officer.
