A regular meeting of the Merit System Board was held on Wednesday, June 11, 2003, in Trenton, New Jersey.

PRESENT: Chairwoman Ida L. Castro, Merit System Board members, Alan Dexter Bowman, Josephine DiRienzo, and Robert Long; Barbara Bereski, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2002, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

It is noted that Josephine DiRienzo was absent for the vote on item A-1 but voted on the remainder of the agenda items.

Thomas Clark, Senior Correction Officer, Juvenile Justice Commission, removal effective July 25, 2002, on charges of other sufficient cause, conduct unbecoming a public employee, and use, possession or sale of any controlled dangerous substance.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-3 RICHARD DURRETT
Richard Durrett, Human Services Technician, Ancora Psychiatric Hospital, Department of Human Services, removal effective August 1, 2002, on the charge of conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Dismiss the appeal with prejudice.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-4 MARIO ESPOSITO
Mario Esposito, Police Officer, City of Orange, Police Department, removal effective July 27, 2000, on the charge of Violating Police Department rules regarding law enforcement drug screening.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

Peter Kristensen, Police Officer, Borough of Fair Lawn, Police Department, removal effective November 30, 2001, on charges of inability to perform duties and other sufficient cause.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION: The Merit System Board directed that this matter be held over.

A-6 JAMES REDMOND
James Redmond, Carpenter, County of Cape May, Department of Facilities and Services, removal effective October 10, 2001 on charges of inability to perform duties and chronic/excessive absenteeism.

Recommendation of the Administrative Law Judge - Uphold the removal

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a resignation in good standing.

A-7 ROBERT SISCO
Robert Sisco, Senior Building Maintenance Worker, Ramapo College of New Jersey, removal effective October 25, 2001, on the charge of inability to perform duties.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a resignation in good standing.

Michael Stevens, Senior Correction Officer, South Woods State Prison, Department of Corrections, removal effective July 8, 2002 on charges of conduct unbecoming a public employee and other sufficient cause.

A-9 ROMONA HARVEY
Romona Harvey, a Principal Social Service Aide with the Division of Youth and Family Services, Department of Human Services, was removed from her position, effective September 13, 2001, on a charge of conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board directed that this matter be held over.

Richard Wilkins appeals the request by the Township of Irvington to remove his name from the Police Officer (S9999D) eligible list for medical unfitness to effectively perform the duties of the position.

Joseph D'Angelo, an Automotive Mechanic with the Palisades Interstate Park Commission, appeals the denial of sick leave injury (SLI) benefits.

B-10 KENDRA BROWN
Kendra Brown appeals the decision of Human Resource Information Services, which upheld the removal of her name from the eligible list for Investigator (S0708C), Judiciary vicinage 7 - Mercer County, on the basis of her failure to appear for a scheduled interview. The appellant also appealed her removal from the eligible list for Investigator (S0708C), Judiciary Vicinage 9 - Monmouth County, on the basis of her failure to respond to a notice of certification.

ACTION: The Merit System Board directed that these appeals be denied.

Robert Dynow, represented by John E. Hogan, Esq., appeals the decision of Human Resource Information Services (HRIS), which upheld the removal of his name from the Correction Officer Recruit (S9999A), Department of Corrections, eligible list, on the basis of an unsatisfactory criminal record.

ACTION: The Merit System Board directed that this appeal be granted.

B-12 JOSEPH PLESS
Joseph Pless, represented by Steven A. Varano, Esq., appeals the bypass of his name on a certification of the Police Sergeant (PM2547B), Borough of Lodi, eligible list.

ACTION: The Merit System Board granted a hearing.

B-13 BERNADETTE VALENTE
Bernadette Valente appeals the determination of Human Resource Information Services, which upheld the bypass of her name for appointment from the Secretarial Assistant 2 (PS4137Q), Office of the Public Defender eligible list.

ACTION: The Merit System Board directed that this appeal be denied.

B-14 IRMA NEWTON
Irma Newton, an Unemployment Insurance Clerk with the Department of Labor (DOL), appeals the determination of the Commissioner for DOL, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-15 ARN OLSEN
Arn Olsen, a Crew Supervisor, Carpenters, at East Jersey State Prison, Department of Corrections (DOC), appeals the determination of the Equal Employment Division, with the DOC, stating that the appellant had failed to present sufficient evidence to support a finding that he had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board granted a hearing.

B-16 LAMONT BRINSON
Lamont Brinson, an Instructor Counselor at New Jersey Training School for Boys in Jamesburg, Juvenile Justice Commission, represented by William Kaufman, CWA Local 1040, petitions for interim relief of his immediate suspension and a stay of his removal, effective March 4, 2003, pending the outcome of his hearing at the Office of Administrative Law.

ACTION: The Merit System Board denied the request.

B-17 FRANCES COHAN
North Bergen Housing Authority, represented by Michael A. Gannaio, Esq., requests reconsideration of the final decision of the Merit System Board, rendered on January 15, 2003, modifying the removal of Frances Cohan, a Housing Manager with the North Bergen Housing Authority, to a three-month suspension in accordance with the decision of the Superior Court of New Jersey, Appellate Division, in Frances Cohan v. North Bergen Housing Authority, Docket No. A-5662-00T1 (App. Div. November 6, 2002).

ACTION: The Merit System Board denied the request.

B-18 MARY LAWSON
The Department of Human Services (DHS), represented by Sonia M. Frontera, DAG, petitions the Merit System Board (Board) for reconsideration of the decision, In the Matter of Mary Lawson (MSB decided February 26, 2003), in which the Board reversed DHS' removal of Mary Lawson.

ACTION: The Merit System Board denied the request.

B-19 ANN UPDEGRAVE
Ann Updegrave, a former Principal Clerk Typist and Principal Purchasing Assistant - Typing with the Township of Jackson, petitions the Merit System Board for reconsideration of the final decision, rendered on November 8, 2001, which upheld her resignation in good standing. The appellant also appeals the bypass of her name on a certification of the Purchasing Agent (M0069D), Township of Jackson, eligible list.

ACTION: The Merit System Board denied the request for reconsideration and the bypass appeal.

B-20 GENEVA YOUNG
Geneva Young requests reconsideration of the decision of the Department of Personnel, rendered on January 23, 2003, denying her a hearing with respect to her removal from employment as an Investigator with the Judiciary, Vicinage 7 - Mercer County, on charges of poor work performance and other sufficient cause.

ACTION: The Merit System Board granted the request and directed that the matter be transmitted to the Office of Administrative Law for a hearing.

B-21 EVELYN WILLIAMS AND MARK COOKE
The County of Essex, represented by Timothy Stafford, Esq., and Evelyn Williams, a Food Service Worker and Mark Cooke, a Juvenile Detention Officer, represented by Christopher Watkins, Esq., petition the Merit System Board (Board) for acknowledgement of the settlement agreement reached by the parties, which provides for their reinstatement.

ACTION: The Merit System Board acknowledged the settlement as clarified and vacated its prior decision of November 7, 2002.

B-22 SYLVIA FARRAR
Sylvia Farrar, a Cottage Training Supervisor, North Jersey Developmental Center, Department of Human Services, represented by Sarah Evans, Staff Representative, CWA Local 1040, appeals the minor discipline of an Official Written Reprimand.

ACTION: The Merit System Board directed that this appeal be granted.

John Moro, Printing Operations Manager, South Woods State Prison, Department of Corrections, appeals minor discipline of a two day suspension.

ACTION: The Merit System Board directed that this appeal be granted.

ACTION: The Merit System Board directed that these appeals be denied.

Cheryl Buck appeals the determination of the Division of Selection Services, which found that she did not meet the experience requirement for the promotional examination for Medical Transcriber (PC0879D), Camden County.

John Busche, Jeffrey Gottfried, Edward Mercer, Antoine Nassimos, Carmen Reale, Gerald Vaivada and Kenneth Williams appeal the determination of the Division of Selection Services which found that, per the substitution clause for education, they did not meet the experience requirements for the examination for Construction Management Specialist 2 (S6490C), Department of the Treasury. Gerald Vaivada also appeals his ineligibility for Construction Management Specialist 3 (S6489C), Department of the Treasury.

Joseph S. Foglio, Chief of the Ocean City Fire Department and the Honorable Henry Knight, Mayor of Ocean City, on behalf of Joseph W. Foglio, John J. Quigley and Michael C. Majowicz, appeal the determination of the Division of Selection Services that they are not permitted to take the Physical Performance Examination due to their failure to request a test appointment prior to the deadline of April 4, 2003.

ACTION: The Merit System Board directed that these appeals be granted.
