Anita O’Leary, Senior Correction Officer, Edna Mahan Correctional Facility
for Women, Department of Corrections, asserts that she had been subjected to
violations of the New Jersey State Policy Prohibiting Discrimination, Harassment
and Hostile Environments in the Workplace.
Recommendation of the Administrative Law Judge - Dismiss the appeal
for failure to prosecute.
ACTION: The Merit System Board affirmed the recommendation of the Administrative
Law Judge.
A-3 REGINA BAYLEY, LARRY LAWSON, SHELLEY CANNON, JOHN DASILVA (CONSOLIDATION)
Regina Bayley, Larry Lawson, Shelley Cannon, and John DaSilva, various titles,
City of Newark, removals effective June 27, 1997, on the charge of failure
to comply with the City’s Residency Ordinance.
Recommendation of the Administrative Law Judge - Uphold the removals
of Shelley Cannon, and John DaSilva, and stay the removals of Regina Bayley
and Larry Lawson for 12 months to give them the opportunity to comply with
the residency requirement.
ACTION: The Merit System Board affirmed the recommendation of the Administrative
Law Judge.

effective December 26, 2001 on charges of conduct unbecoming a public employee
and insubordination and 3) removal effective February 5, 2002 on the charge
of falsification.

Robert Rain, Senior Correction Officer, South Woods State Prison, Department
of Corrections, removal effective August 13, 2002, on charges of conduct unbecoming
a public employee, violations of rules regarding safety and security precautions
and improper or unauthorized contact with inmates, parolees, their families,
or friends.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative
Law Judge.

Hugo O. Albarracin appeals his rejection as a Correction Officer Recruit candidate

Norberto Ramos, III, appeals the decision of Human Resource Information Services,
(HRIS), which found that the appointing authority had presented a sufficient
basis to remove his name from the eligible list for Police Officer (S9999D),
Township of Irvington, on the basis of his failure to meet the residency requirement.

Heath Shulas, represented by Sidney H. Lehmann, Esq., appeals the removal
of his name from the Police Officer (S9999B), Township of North Brunswick,
eligible list due to an unsatisfactory background report.

Terrence Simpson appeals the decision of Human Resource Information Services,
which found that the appointing authority had presented a sufficient basis
to remove the appellant’s name from the eligible list for Police Officer

B-18 BHULESHWAR DARJI
Bhuleshwar Darji, a Principal Engineer, Structural Evaluation with the Department
of Transportation (DOT), represented by Peter M. Duzuki, Esq., appeals the
determination of the Director, Division of Civil Rights and Affirmative Action
(DCR/AA) of the DOT, stating that the appellant had failed to present sufficient
evidence to support a finding that he had been subjected to violations of the
New Jersey State Policy Prohibiting Discrimination, Harassment, or Hostile
Environments in the Workplace.
ACTION: The Merit System Board directed that this appeal be denied.

Doris Whyte, a Day Care Center Technician with the Department of Human Services,
represented by Bruce M. Gorman, Esq., petitions the Merit System Board for
reconsideration of its decision rendered on April 23, 2003, denying her request
for restoration of vacation leave.
ACTION: The Merit System Board directed that this appeal be denied.
B-20 ANNIE BELIN
The appeal of Annie Belin, a Juvenile Detention Officer with the County of
Union, of her 10-day suspension, was heard by Administrative Law Judge Leslie
Z. Celentano (ALJ), who rendered her initial decision on June 9, 2003. At its
meeting on August 12, 2003, the Merit System Board did not adopt the ALJ’s
recommendation to dismiss the charges. Rather, the Board ordered that the matter
be remanded to the Office of Administrative Law for further proceedings. The
proposed decision is now submitted for the Board’s review.
ACTION: The Merit System Board adopted the decision.
B-21 SEAN CHINSOON
The appeal of Sean Chinsoon, a County Correction Officer with Monmouth County,
of his removal effective January 31, 2002, on charges was heard by Administrative
Law Judge Ana C. Viscomi (ALJ), who rendered her initial decision on May 29,
2003. At its meeting on August 12, 2003, the Merit System Board (Board) did
not adopt the ALJ’s recommendation to modify the removal to a six-month
suspension. Rather the Board modified the removal to a three-month suspension.
The proposed decision is now submitted for the Board’s review.
ACTION: The Merit System Board adopted the decision.
B-22 JOHN GILLEY, JOSEPH LEWIS, LISA DORSEY, ERASMO QUINONES AND DANIEL MCKNIGHT,
JR.
The appeals of John Gilley, Joseph Lewis, Lisa Dorsey, Erasmo Quinones and
Daniel McKnight, Jr., County Correction Officer, County of Mercer, Department
of Public Safety, of their removals on charges, were heard by Administrative
Law Judge Solomon A. Metzger (ALJ), who rendered his initial decision on June
17, 2003, modifying the removals to a 30-day suspension for Gilley, a 60-day
suspension for McKnight, a 90-day suspension for Quinones and a six-month suspension
for Dorsey and reversing the removal for Lewis. At its meeting on August 12,
2003, the Board adopted the ALJ’s recommendation for appellants Gilley,
Lewis, Quinones and McKnight. However, the Board did not adopt the ALJ’s
recommendation to modify Dorsey’s removal to a six-month suspension.
Rather, the Board upheld the removal. The proposed decision is now submitted
for the Board’s review.
ACTION: The Merit System Board, on its own motion, reconsidered its prior
decision of August 12, 2003 and affirmed the recommendation of the Administrative
Law Judge.
B-23 MARK HRUSKA
The appeal of Mark Hruska of the bypass of his name for appointment from the
Fire Fighter (M5254S), Borough of Carteret eligible list was heard by Administrative
Law Judge Joseph Lavery (ALJ), who rendered his initial decision on May 27,
2002, invalidating the bypass and ordering that the certification be reissued.
At its meeting on August 12, 2003, the Merit System Board (Board) upheld the
bypass. The proposed final decision is now submitted for the Board’s
review.
ACTION: The Merit System Board adopted the final decision.
B-24 CHRISTINE PHILLIPS
The appeal of Christine Phillips, a Principal Clerk Typist with South Woods
State Prison, Department of Corrections, of her removal, effective February
23, 2001, on charges, was heard by Administrative Law Judge Edgar R. Holmes
(ALJ), who rendered his initial decision on June 3, 2003. At its meeting on
August 12, 2003, the Merit System Board (Board) adopted the ALJ’s recommendation
to uphold the appellant’s removal. The proposed final decision is now
submitted for the Board’s review.
ACTION: The Merit System Board adopted the final decision.
B-25 DORELEENA SAMMONS-POSEY
The appeal of Doreleena Sammons-Posey, a Program Manager (Family Health Programs)
with the Department of Health and Senior Services, of the decision to bypass
her name for appointment from the Service Director, Department of Health (PS1005H)
eligible list, was before Administrative Law Judge Steven C. Reback (ALJ),
who rendered his initial decision on May 22, 2003. At its meeting on August
12, 2003, the Merit System Board adopted the ALJ’s recommendation to
uphold the bypass. The proposed final decision is now submitted for the Board’s
review.
ACTION: The Merit System Board adopted the final decision.
B-26 JUDITH ANN ABRAMOVITZ, CHARLES END AND BETSY REETZ
Judith Ann Abramovitz, Charles End, and Betsy Reetz appeal the determinations
of the Division of Selection Services that they did not meet the experience
requirements for the promotional examination for Program Manager, Health Care
Systems Analysis (PS3954H), Department of Health and Senior Services.
ACTION: The Merit System Board directed that these appeals be denied.
