A regular meeting of the Merit System Board was held on Wednesday, February 11, 2004 , in Trenton , New Jersey .

PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Alan Dexter Bowman, Josephine DiRienzo, Margaret E. L. Howard and Robert J. Long; Elizabeth Laufer, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2003, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise specified.

The Merit System Board recorded the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof.

SUBJECT: Change in the Classification Plan - Addition of Workweek

STATE PAROLE BOARD

The State Parole Board requests the creation of a 40-hour workweek for the Parole Officer Recruit base title and bilingual variant. The State Parole Board uses the NE workweek for caseload staff, and the 40-hour workweek for staff assigned to the Electronic Monitoring Response Unit.

The State Parole Board plans to assign and train Parole Officer Recruits to work in the Electronic Monitoring Response Unit. This unit is currently staffed with Senior Parole Officers assigned a 40-hour workweek to cover a 24-hour, 7-day per week, shift overlap work operation.

ACTION: The Merit System Board acknowledged the settlements.

A-2 FRANK DEBARTOLA

Frank Debartola, Police Officer, Borough of Lodi, Police Department, release at the end of the working test period effective December 23, 2002 .

Recommendation of the Administrative Law Judge - Reverse the release at the end of the working test period and provide a new shortened working test period.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to reverse the release at the end of the working test period, reinstate the appellant with permanent status, back pay, seniority, benefits and attorneys fees.

A-3 DEXTER CLIMESON

Dexter Climeson, Senior Correction Officer, Juvenile Justice Commission, Department of Law and Public Safety, removal effective July 25, 2002, on charges of conduct unbecoming a public employee, neglect of duty, and violation of Department rules regarding, inter alia , physical or mental abuse of an inmate, patient, client, resident or employee, inappropriate physical contact or mistreatment of an inmate, patient, client, resident, or employee.

Recommendation of the Administrative Law Judge - It is noted that while the Administrative Law Judge made detailed findings, he made no recommendation regarding the charges.

ACTION: The Merit System Board upheld the removal.

Sharon Peterson , Senior Correction Officer, East Jersey State Prison, Department of Corrections, 1) four removals effective January 3, 2002, on charges of conduct unbecoming a public employee, falsification, intentional misstatement of material fact in connection with work, employment application, attendance, or in any record, report, investigation or other proceeding, 2) 30-day suspension on charges of conduct unbecoming a public employee and falsification, intentional misstatement of material fact in connection with work, employment application, attendance, or in any record, report, investigation or other proceeding, 3) 15-day suspension on charges of chronic or excessive absenteeism or lateness, and unsatisfactory attendance and 4) 45-day suspension on charges of other sufficient cause and violation of a rule, regulation, policy, procedure, order, or administrative decision.

James Roberson , Senior Correction Officer, East Jersey State Prison, Department of Corrections, removal effective March 26, 2002, on the charge of conduct unbecoming a public employee.

This matter was held over from the Merit System Board meeting of January 28, 2004 .

Recommendation of the Administrative Law Judge - Uphold Peterson's and Roberson's removals.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-5 DAWN HENSLEY

Dawn Hensley, County Correction Officer, County of Burlington , County Jail , 20-day suspension on charges of incompetency, inefficiency or failure to perform duties, neglect of duty and other sufficient cause. This matter was held over from the Merit System Board meeting of January 7, 2004 .

Recommendation of the Administrative Law Judge - Reverse the 20-day.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

Kris Ballester, represented by Michael McLaughlin, Esq., appeals his rejection as a Fire Fighter candidate by the City of Hoboken and its request to remove his name from the eligible list for Fire Fighter on the basis of psychological unfitness to perform effectively the duties of the position.

Andrew Cockerham, represented by Joseph Brennan, Esq., appeals the determination of the Division of Human Resource Information Services (HRIS) which upheld his removal from the eligible list for Police Officer (S9999D), Township of Mt. Laurel, on the basis that he failed to respond to the certification and had previously been appointed a Police Officer from the S9999D eligible list.

ACTION: The Merit System Board directed that this appeal be denied.

Julio Cordero, Jr., a non-veteran, appeals the decision of the Division of Human Resource Information Services, which found a sufficient basis to remove his name from the eligible list for Police Officer (S9999D), City of Jersey City , for failure to meet the age requirement for the position.

ACTION: The Merit System Board directed that this appeal be denied.

George Finkeldey appeals the decision of Human Resource Information Services (HRIS), which upheld the appointing authority's bypass of his name on the certification for the Police Sergeant (PM2573A), Township of North Bergen , eligible list.

ACTION: The Merit System Board granted permission not to make appointments, waived selection costs but imposed compliance costs.

B-25 SUPERVISOR OF VETERANS' INTERMENT (C6201C)

The appointing authority requests permission not to make an appointment from the certification for Supervisor of Veterans' Interment (C6201C), Hunterdon County .

ACTION: The Merit System Board granted the request for an appointment waiver but assessed costs.

B-26 SUPERVISOR OF ACCOUNTS (M4002C AND M0084D), TOWNSHIP OF MONROE

The appointing authority requests that the eligible list for Supervisor of Accounts (M4002C), Township of Monroe , be cancelled due to an incorrect residency announcement.

ACTION: The Merit System Board denied the request to cancel the Supervisor of Accounts (M4002C) eligible list, and granted a make up to Elvis L. Gooden for Supervisor of Accounts (M4002C). The Merit System Board, however, cancelled the Supervisor of Accounts (M0084D) eligible list.

B-27 HATHA BARAKA

Hatha Baraka, a Correction Lieutenant at Northern State Prison, Department of Corrections (DOC), appeals the determination of the Assistant Director, Equal Employment Division (EED), DOC, which found that the appellant failed to present sufficient evidence to support a finding that he had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board granted a hearing.

B-28 JUDITH CARROLL

Judith Carroll, a Human Services Technician with the New Jersey Veterans' Memorial Home - Paramus, Department of Military and Veterans' Affairs, represented by Edward H. Lee, Esq., requests that the Merit System Board reinstate her appeal of her removal, effective March 21, 2001, on charges, which was dismissed based on both parties' failure to appear at a scheduled hearing on December 3, 2002.

ACTION: The Merit System Board granted the request.

B-29 ROSEMARY CORINEALDI

Rosemary Corinealdi, a Hospital Attendant at Buttonwood Hospital , Burlington County , requests that the Merit System Board reinstate the appeal of two 60-day suspensions, which were dismissed based on Corinealdi's failure to appear at a scheduled hearing.

ACTION: The Merit System Board denied the request.

B-30 ROBERT WILSON

Robert Wilson, a Boiler Operator with the Jersey City School District , requests that the Merit System Board reinstate his appeal of his 26-day suspension, on charges, which was dismissed based on Wilson 's failure to appear at his scheduled settlement conference.

ACTION: The Merit System Board granted the request.

B-31 DONALD HICKS

Donald Hicks, a Police Officer with the City of Newark , represented by Anthony J. Fusco, Jr., Esq., seeks enforcement of the Merit System Board decision rendered on May 22, 2001 granting him back pay, benefits and seniority, and awarding him counsel fees.

ACTION: The Merit System Board granted $1,689.04 in back pay.

B-33 JEFFREY SIENKIEWICZ

Jeffrey Sienkiewicz, a Correction Sergeant, New Jersey State Prison, Department of Corrections, represented by John H. Rittley, Esq., seeks enforcement of the Merit System Board decision rendered on March 13, 2001 , which awarded him counsel fees.

ACTION: The Merit System Board granted $9,597.78 in counsel fees.

B-34 KEITH HINTON

Keith Hinton, a Police Sergeant with the City of East Orange , represented by Robert R. Cannan, Esq., petition the Merit System Board for reconsideration of the final decision, rendered on September 10, 2002 , which upheld his non-appointment from the eligible list for Police Lieutenant (PM1350W), City of East Orange .

ACTION: The Merit System Board denied the request for reconsideration.

B-35 TERESA LOCKETTE

Teresa Lockette, a Manager 1, Human Resources at Arthur Brisbane Child Treatment Center, Department of Human Services, petitions the Merit System Board for reconsideration of the final decision, rendered on May 7, 2003, which upheld the determination that she had not presented sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board granted the request for reconsideration but reaffirmed its prior decision.

B-36 MARK PIKUNICH

Mark Pikunich, a Senior Correction Officer, Department of Corrections (DOC), petitions the Merit System Board for reconsideration of the final administrative determination rendered December 11, 2003, by the Director of Merit System Practices and Labor Relations, denying his request for a hearing concerning the appeal of his 30-day suspension, due to untimely filing of his appeal pursuant to N.J.S.A. 11A:2-15 and N.J.A.C. 4A:2-2.8.

ACTION: The Merit System Board denied the request for reconsideration.

B-37 ROBERT RAIN

Robert Rain, a former Senior Correction Officer with South Woods State Prison, Department of Corrections, represented by Kevin P. McCann, Esq., petitions the Merit System Board for reconsideration of the final administrative determination, rendered September 3, 2003, which upheld the petitioner's removal from employment, effective August 13, 2002, on the charges of conduct unbecoming a public employee and undue familiarity with inmates and their friends.

ACTION: The Merit System Board denied the request for reconsideration.

B-38 SUSETTE SABIO-JONES

Susette Sabio-Jones petitions the Merit System Board for reconsideration of the April 9, 2003 final administrative decision in In the Matter of Susette Sabio-Jones, wherein the Board found that she did not meet the educational requirements for the promotional examination for Occupational Health Consultant 1 (PS3612N), Department of Labor.

ACTION: The Merit System Board denied the request for reconsideration.

B-39 TAMAR PRITCHARD

Tamar Pritchard, Librarian 1, Department of Law and Public Safety, appeals minor discipline of an Official Written Reprimand.

ACTION: The Merit System Board directed that this appeal be granted.

Felix Arbulu-Billena, Jessica Lynch and Jean Peterson appeal the determination of the Division of Selection services, which found that they were below the minimum requirements in education and experience for the open competitive examination for Network Administrator 1 (S6635E). Jeffrey Booth appeals the determination of the Division of Selection Services, which found that he was below the minimum requirements in education for the open competitive examination for Network Administrator 1 (S6635E).
