A regular meeting of the Merit System Board was held on Wednesday, April 7, 2004 , in Trenton , New Jersey .

PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Flavella Branham, Josephine DiRienzo, Margaret E. L. Howard and Robert J. Long; Lisa Ruch, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2003, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

Angela Carpenter, Hospital Attendant, County of Burlington, Buttonwood Hospital, removal effective March 10, 2003, on charges of incompetence, inefficiency, or failure to perform duties, conduct unbecoming a public employee, neglect of duty, and resident abuse/neglect.

Recommendation of the Administrative Law Judge - Modify the removal to a 20-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-8 ALVINGER COLEMAN

Alvinger Coleman, Senior Correction Officer, East Jersey State Prison, Department of Corrections, removal effective October 30, 2002 , on the charge of being prohibited by law from possessing or using a firearm.

Philip Martone, Superintendent of Recreation, Town of Kearny, Department of Parks and Recreation, removal effective October 28, 2002, on charges of conduct unbecoming a public employee, and violation of policy regarding employee conduct and work rules and workplace violence prevention.

Recommendation of the Administrative Law Judge - Modify the removal to a six-month suspension.

Dominick Mattiell, Police Trainee, City of Bayonne, Department of Public Safety, removal effective October 25, 1999, on charges of failure to complete the police training course, dismissal from Passaic County Police Academy for a positive drug test and inability to perform duties.

Shadell Jackson appeals the decision of Human Resource Information Services, which found that the appointing authority had presented a sufficient basis to remove her name from the eligible list for Communications Officer (M0282D), City of Orange Township, on the basis of falsification of her preemployment application.

ACTION: The Merit System Board directed that this appeal be denied.

B-20 ALEXANDER B. TILLMAN

Hudson County appeals the decision of Human Resource Information Services, which found that Alexander B. Tillman's name could not be removed from the eligible list for County Correction Officer (S9999D) on the basis of his criminal record since he had been given medical and psychological examinations.

ACTION: The Merit System Board directed that this appeal be denied and Alexander B. Tillman's name be retained on the County Correction Officer (S9999D) eligible list.

B-21 REGINA M. YAHARA-SPLAIN

Regina M. Yahara-Splain appeals the decision of Human Resource Information Systems, which remove the appellant's name from the special reemployment list for Senior Food Service Handler, 12 Months due to the appellant's failure to respond t the Certification Notice.

ACTION: The Merit System Board directed that this appeal be granted.

B-22 DATA PROCESSING SYSTEMS PROGRAMMER 1 (S6646E), HIGHER EDUCATION STUDENT ASSISTANCE AUTHORITY

The appointing authority request permission not to make an appointment from the certification for Data Processing Systems Programmer 1 (S6646E), Higher Education Student Assistance Authority.

ACTION: The Merit System Board granted the request for an appointment waiver and assessed no selection costs at this time.

B-23 EXECUTIVE ASSISTANT (M6932A), TOWNSHIP OF NORTH BERGEN

The Township of North Bergen (Township), represented by Rachel A. Rehaut, Esq., petitions the Merit System Board for reconsideration of the final administrative decision, rendered on January 7, 2004 , in which the Board denied its request for an appointment waiver and ordered that the Township properly dispose of the April 30, 2002 certification.

ACTION: The Merit System Board granted the request for reconsideration and granted the appointment waiver, but assessed costs.

B-24 PERSONNEL OFFICER (C0316D), BERGEN COUNTY BOARD OF SOCIAL SERVICES

The appointing authority requests permission not to make an appointment from the certification for Personnel Officer (C0316D), Bergen County Board of Social Services.

ACTION: The Merit System Board granted the request for an appointment waiver and directed that selection costs be presently deferred.

B-25 SUPERVISING COUNSELOR, VICTIM-WITNESS PROGRAM AND COUNSELOR, VICTIM-WITNESS PROGRAM

The Morris County Prosecutor, represented by Joseph Conner, Jr., Esq., appeals the decision of the division of Human Resource Management, which determined that Patricia Stewart should be classified under the title of Supervising Counselor, Victim-Witness Program and that Keisha Higgs and Donna Pasquariello should be classified under the title of Counselor, Victim-Witness Program in the competitive division of the career service.

ACTION: The Merit System Board directed that these appeals be granted in part.

B-26 CYNTHIA PRISCO

Cynthia Prisco, a Senior Clerk Typist with the Juvenile Justice Commission, Department of Law and Public Safety, appeals the determination of the Commissioner of the Department of Community Affairs, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment, or Hostile Environments in the Workplace.

ACTION: The Merit System Board granted a hearing.

B-27 TERESA SPALDING

Teresa Spalding, a County Correction Officer with the County of Burlington County Jail , represented by William B. Hildebrand, Esq., seeks enforcement of the Merit System Board decision rendered on November 19, 2003 , which awarded her back pay, benefits and seniority.

ACTION: The Merit System Board granted the appellant $68,284.60 in gross back pay along with seniority credit, vacation time and sick time.

B-28 JAMES NANCE

The City of Newark represented by Lori A. Brown, Assistant Corporation Counsel, petitions the Merit System Board for a stay of its decision in In the Matter of James Nance (MSB, decided October 1, 2003) pending its appeal to the Appellate Division of the Superior Court of New Jersey.

ACTION: The Merit System Board denied the request.

B-29 THOMAS PAVLIK

The Township of Brick , represented by Arthur R. Thibault Jr., Esq., petitions the Merit System Board for reconsideration of the administrative decision, rendered on January 7, 2004 , in which the Board reinstated Thomas Pavlik's appeal of his removal and transmitted the matter to the Office of Administrative Law for a hearing.

ACTION: The Merit System Board denied the request.

B-30 RUSSELL MAFFEI

Pursuant to the Merit System Board's order in the decision In the Matter of Russell Maffei (MSB decided March 26, 2003), the Board reviewed the record to determine whether sanctions should be imposed on the Board of Public Utilities and/or the Department of Personnel.

ACTION: The Merit System Board directed that no sanctions are warranted in this matter.

B-31 BOYETTE MCSWAIN

The appeal of Boyette McSwain, a Senior Juvenile Detention Officer with the Essex County Division of Youth Services, Department of Citizen Services, of her removal effective April 13, 1999 , on charges, was heard by Administrative Law Judge Mumtaz Bari-Brown (ALJ), who rendered her initial decision on January 12, 2004 . At its meeting on March 24, 2004 , the Board adopted the ALJ's recommendation to uphold the removal. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-32 DIANE SANDERS

The appeal of Diane Sanders, a Human Services Technician at Trenton Psychiatric Hospital , Department of Human Services, of her removal effective May 3, 2002 , on charges, was heard by Administrative Law Judge John R. Tassini (ALJ), who rendered his initial decision on February 11, 2004 . At its meeting on March 24, 2004 , the Merit System Board did not adopt the ALJ's recommendation to reverse the removal. Rather the Board imposed a three-day suspension. The proposed decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the decision.

B-33 FELIX ARBULU-BILLENA, ET AL.

Felix Arbulu-Billena, Gregg Gilden and Rakesh Puri appeal the determinations of the Division of Selection Services, which found them to lack the experience requirements for the open competitive examination for Computer Operator 3 (S6644E), Statewide.

ACTION: The Merit System Board directed that these appeals be denied.

B-34 BARBARA BERGER, ET AL.

Barbara Berger, Darlene Smith, Terry Smith and Dianne Taylor appeal the determinations of the Division of Selection Services that found that, per the substitution clause for education, they did not meet the experience requirements for the promotional examination for Administrative Analyst 3 (PS5431K), Division of Youth and Family Services.

ACTION: The Merit System Board directed that these appeals be denied.

B-92 HEATHER GRIFFITH

The appeal of Heather Griffith, a Social Worker 2, Secured Facilities with Bayside State Prison, Department of Corrections (DOC), of her 10-day suspension on charges was before Administrative Law Judge W. Todd Miller (ALJ) who rendered his initial decision on February 11, 2004 , modifying the 10-day suspension to a written warning with appropriate sensitivity training. At its meeting on March 24, 2004 , the Merit System Board modified the 10-day suspension to a five-day suspension and appropriate sensitivity training. The proposed decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the decision.

B-93 CHERYL KOSCIUK

The appeals of Cheryl Kosciuk, a Senior Correction Officer with the Department of Corrections, of her: 1) 30-day suspension on charges, and 2) 15-day suspension and two removal effective March 31, 2001 , on charges were heard by Administrative Law Judge Israel D. Dubin (ALJ), who rendered his initial decision on January 15, 2004, upholding the 30-day suspension and reversing the 15-day suspension and two removals. At its meeting on March 24, 2004 , the Merit System Board adopted the ALJ's recommendations. The proposed decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the decision.

B-94 VICTOR RAMOS

The appeal of Victor Ramos, a County Police Officer with the County of Essex , of his removal effective May 31, 2002 , on charges was heard by Administrative Law Judge Edith Klinger (ALJ), who rendered her initial decision on January 30, 2004 upholding the removal. At its meeting on March 24, 2004 , the Merit System Board did not adopt the ALJ's recommendation. Rather, the Board modified the removal to a five-day suspension with training in how to effectively deal with the public. The proposed decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the decision.
