A regular meeting of the Merit System Board was held on Wednesday, April 21, 2004 , in Trenton , New Jersey .

PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Flavella Branham, Josephine DiRienzo, Margaret E. L. Howard and Robert J. Long; Lisa Ruch, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2003, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

LAW AND PUBLIC SAFETY AND GENERAL TITLES

The Department of Law and Public Safety requests the establishment of several intermittent titles for use by the New Jersey Racing Commission.

These titles are requested for staff performing inspection and veterinary functions at the four (4) racetracks managed by the New Jersey Racing Commission. These functions are currently classified by Temporary Employment Service (TES) titles, which are restricted to a specific number of working hours per fiscal year. However, the demands, working hours and schedules of these seasonal functions are such that the TES designation is no longer appropriate. Staff will exceed this limit before the end of the fiscal year, yet their services are still required. The Racing Commission has experienced difficulty in recruiting individuals to perform these duties considering the salary and work hours, and wishes to retain committed staff. Full-time, year-round positions are not warranted.

SUBJECT: Change in the Classification Plan

GENERAL

The Juvenile Justice Commission requests the addition of a new workweek for the title of Substance Abuse Assistant.

The Commission operates three residential community program facilities serving substance abuse clients. These facilities are staffed on an around-the-clock basis. The Commission currently uses the title of Youth Worker, because the 40-hour workweek designation permits them to have three, eight-hour shifts. The Commission maintains that Substance Abuse Assistant is a more appropriate title, but is unable to use it without incurring continuous overtime. The requested workweek will provide the Commission with the capability to appropriately classify incumbents and address scheduling requirements.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION: The Merit System Board acknowledged the settlements with the exception of Thomas Floyd, which was held over.

A-2 BERGEN COUNTY LAYOFF

Several of employees of Bergen County in various titles and department appealed the good faith of their layoff effective April 17, 2003 , for reasons of economy and efficiency. It is noted that prior to hearing, most appellants withdrew their appeals. This initial decision concerns the remaining appellant, Edward M. Norwich, Assistant County Tax Administrator.

Recommendation of the Administrative Law Judge - Uphold the good faith layoff of Edward M. Norwich.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-3 ROBIN DOLLSON

Robin Dollson, Truck Driver, Albert C. Wagner Youth Correctional Facility, Department of Corrections, 15-day suspension on the charge of chronic or excessive absenteeism.

Recommendation of the Administrative Law Judge - Reverse the suspension.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold a ten-day suspension.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board remanded the matter to the Office of Administrative Law.

The appointing authority requests permission not to make an appointment from the certification for Data Processing Coordinator (C6048E), County of Warren .

ACTION: The Merit System Board denied the request for reconsideration.

B-18 DIANE ATTANASIO AND ESSAM HANANI

Diane Attanasio and Essam Hanani, Public Health Representatives 3, Communicable Diseases, with Hunterdon County , represented by John Seiler, Staff Representative, CWA Local 1034, petitions the Merit System Board for relief related to the involuntary reduction in their workweek from July 1, 2003 to August 18, 2003 .

ACTION: The Merit System Board ordered Hunterdon County to pay Diane Attanasio the gross amount of $163.59 and Essam Hanani the gross amount of $134.61 in differential back pay.

B-19 ROCKAWAY TOWNSHIP LIBRARY

Morris Council No. 6, NJCSA, IFPTE, and the AFL-CIO, represented by Craig Gumpel, Esq., requests that the Merit System Board review the vacation and sick leave entitlement of employees employed by the Rockaway Township Library and the definition of part-time employee.

ACTION: The Merit System Board directed that the leave time of full-time and part-time employees be adjusted. The Merit System Board defines part-time employee in this case as an employee working less than 35 hours a week.

Celentano (ALJ), who rendered her initial decision on January 9, 2004 . At its meeting on April 7, 2004 , the Board adopted the ALJ's recommendation to uphold the removal. The proposed final decision is now submitted for the Board's review.

The appeal of Philip Martone, a Superintendent of Recreation with the Town of Kearny , of his removal, effective October 28, 2002 , on charges, was heard by Administrative Law Judge Carol I. Cohen (ALJ), who rendered her initial decision on February 24, 2004 . At its meeting on April 7, 2004 , the Merit System Board (Board) adopted the ALJ's recommendation to modify the removal to a six-month suspension. The proposed decision is now submitted for the Board's review.
