    A regular meeting of the Civil Service Commission was held on Wednesday, April 27, 2022, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2021, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Roberto Castellano, Police Officer, Jersey City, Department of Public Safety, removal.

 

Ed Germscheid, Public Safety Telecommunicator, Gloucester County, Department of Emergency Response, suspension.

ACTION:  The Civil Service Commission noted the withdrawal of appeals without prejudice.

Jared Brown, Senior Correctional Police Officer, Garden State Youth Correctional Facility, removal, effective July 14, 2021, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law JudgeUphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    MARC-ELIE GEORGES – CSC DOCKET NO. 2021-542

 

Marc-Elie George, Assistant Supervisor of Nurses, Passaic County, Preakness Health Center, removal, effective October 23. 2020, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge Reverse the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    MICHAEL JOHNSON – CSC DOCKET NOS. 2020-1749, ET AL. (CONSOLIDATED)

 

Michael Johnson, Police Officer, Elmwood Park, Police Department, removal, effective December 19, 2019, on charges of insubordination, failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    LAUREN KROPILAK – CSC DOCKET NO. 2020-1703

 

Lauren Kropilak, Public Safety Telecommunicator, Gloucester County, Department of Emergency Response, five working day suspension (12-hour shifts), on charges of insubordination, conduct unbecoming a public employee, neglect of duty and discrimination.

 

Recommendation of the Administrative Law Judge Modify the five working day suspension (12-hour shifts) to a one working day (12-hour shift) suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    BRIAN PIO – CSC DOCKET NO. 2020-2193 (ON REMAND)

 

Brian Pio, County Correctional Police Officer, Salem County, Sheriff’s Office, removal effective July 19, 2019, on charges of conduct unbecoming a public employee, violation of rules and regulations and other sufficient cause.

 

Recommendation of the Administrative Law Judge Consider the additional factfinding presented.

 

ACTION:   The Civil Service Commission reaffirmed In the Matter of Brian Pio (CSC, decided January 15, 2020).

B-1    TERRENCE COBBERTT, JR. - CSC DOCKET NO. 2022-852

 

Terrence Cobbertt, Jr., appeals the removal of his name from the County Correctional Police Officer (S9999A), Essex County eligible list on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    RICHARD COUPE, III - CSC DOCKET NO. 2022-1015

 

Richard Coupe III appeals the removal of his name from the eligible list for Police Sergeant (PM0892V), Willingboro on the basis that he failed to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    DOMINICK DELLAGRAZIE - CSC DOCKET NO. 2021-1579

 

Dominick Dellagrazie, represented by Catherine M. Elston, Esq., appeals the removal of his name from the Sheriff’s Officer (S9999A), Middlesex County eligible list on the basis of an unsatisfactory employment record.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-4    CHRISTIAN POSSO - CSC DOCKET NO. 2022-747

 

Christian Posso appeals the removal of his name from the eligible list for Police Officer (S9999A), Elizabeth on the basis of falsification of the preemployment application.

ACTION:     The Civil Service Commission directed that this appeal be granted.

Robert Raymond, represented by Robert K. Chewning, Esq., appeals the removal of his name from the eligible list for Police Officer (S9999A), Elizabeth on the basis of falsification of the preemployment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    EDWIDCH SEME - CSC DOCKET NO. 2022-759

 

Edwidch Seme, represented by Stephen B. Hunter, Esq., appeals the removal of his name from the eligible list for Police Officer (S9999A), Elizabeth on the basis of his age.

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    JORDY TERRONES- CSC DOCKET NO. 2022-840

 

Jordy Terrones, represented by Ariel Alvarez, Esq., appeals the determination of the Department of Corrections to remove his name from the eligible list for Correctional Police Officer (S9999A), on the basis that he failed to respond to the notice to appeal for an interview.

ACTION:     The Civil Service Commission directed that this appeal be granted.

Jody Biondi and Schronda Williams appeal the determinations of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Investigator, Secured Facilities (PC4396C), Essex County.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

B-29   MARITZA GONZALEZ – CSC DOCKET NO. 2022-2117

 

Maritza Gonzalez appeals the determination of the Division of Agency Services that she did not meet the licensing requirements for the open competitive examination for Technical Assistant to the Construction Official (M0608C), Clifton.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

Joseff Linsangan, Niove Ramirez and Charly Lara appeal the determinations of the Division of Agency Services which found that they were not employed in the announced unit scope for the promotional examination for County Correctional Police Sergeant (PC4825C), Hudson County.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

Jonathan Mazzarone appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Compliance Officer 1 MVC (PS6316T), Motor Vehicle Commission.

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-32   BRIAN MCGORTY - CSC DOCKET NO. 2022-1713

 

Brian McGorty appeals the determination of the Division of Agency Services that he did not meet the education requirements for the promotional examination for Network Administrator 1 (PS6876P), Division of State Police.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-33   DANIEL MCNAIR AND PETER FEMIANO - CSC DOCKET NOS. 2022-1636 AND 2022-1641

 

Daniel McNair and Peter Femiano appeal the determinations of the Division of Agency Services which found that they lacked the required amount of permanent service in a title to which the examination was open for the promotional examination for County Correctional Police Sergeant (PC4825C), Hudson County.

ACTION:     The Civil Service Commission directed that these appeals be denied.

Lynette Montgomery and Ebony Williams appeal the determinations of the Division of Agency Services which found that they did not meet the experience requirements, per the substitution clause for education, for the promotional examination for Social Work Supervisor (PC4939C), Union County.

ACTION:     The Civil Service Commission directed that these appeals be denied.

Jason Flint appeals the determination of the Division of Agency Services that the proper classification of his position with the Department of Law and Public Safety is Weights and Measures Inspector 1. The appellant seeks a Weights and Measures Inspector 2 classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-42   DAWN KRUEGER – CSC DOCKET NO. 2022-2301

 

Dawn Krueger appeals the decision of the Division of Agency Services which found that her position with the Department of the Treasury is properly classified as Administrative Assistant 3. The appellant seeks a Senior Management Assistant job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-43   J.B. – CSC DOCKET NO. 2022-455

 

J.B., an applicant for the open competitive examination for Automotive Mechanic (S0629A), Statewide, appeals the determination of the Director, Division of Equal Employment Opportunity/Affirmative Action, Civil Service Commission, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-44   J.P. – CSC DOCKET NO. 2021-1802

 

J.P., an Assistant Commissioner, Department of Labor and Workforce Development, (DOL) appeals the determination of the Assistant Commissioner, Human Capital Strategies, DOL, stating that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-45   JANE OELER – CSC DOCKET NO. 2022-1673

 

Jane Oeler, a former Senior Clerk Typist with the Department of Higher Education, William Paterson University, appeals the determination of her layoff rights.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

  

B-46   CLERK 2 (M0342B), ELIZABETH PUBLIC LIBRARY – CSC DOCKET NO. 2022-1753

 

The Elizabeth Public Library requests permission not to make an appointment from the August 17, 2021 certification for Clerk 2 (M0342B).

 

ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.

 

B-47   COUNTY CORRECTIONAL POLICE OFFICERS, ATLANTIC COUNTY – CSC DOCKET NO. 2022-2391

 

Atlantic County requests permission to make temporary appointments of entry-level County Correctional Police Officers.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-48   VICTOR VAZQUEZ AND ROCCO DUARDO – CSC DOCKET NOS. 2022-1258 AND 2022-1259

 

Victor Vazquez and Rocco Duardo, Police Officers with Hackensack, represented by Charles J. Sciarra, Esq., request back pay and counsel fees in accordance with the Civil Service Commission decision rendered on July 21, 2021.

 

          ACTION: The Civil Service Commission granted $179,038.80 in gross back pay for Victor Vazquez and $311,473.80 for Rocco Duardo. It also granted counsel fees in the amount of $45,225 and expenses of $3,436.28, and denied all other requests.

 

B-49   READOPTION: N.J.A.C. 4A:1, GENERAL RULES AND DEPARTMENT ORGANIZATION

 

Submitted for the Civil Service Commission’s review is a Notice of Proposal to readopt N.J.A.C. 4A:1, General Rules and Department Organization.

ACTION:     The Civil Service Commission approved the proposed readoption for publication in the New Jersey Register for public notice and comment.

Vito DiTolvo appeals the determiniation of the Department of Corrections to remove his name from the eligible list for Correctional Police Officer (S9999A), of the basis that he failed to complete pre-employment processing.

 

ACTION:    The Civil Service Commission directed that this appeal be granted.

Kymea Harden requests to file a late application for the promotional examination for Senior Cottage Training (PS7333K), Woodbine Developmental Center.

ACTION:    The Civil Service Commission directed that this appeal be granted.

 

B-57   TISHA FINNEY - CSC DOCKET NO. 2022-2451

 

Tisha Finney appeals the determination of the Division of Agency Services that she does not meet the experience requirements for the promotional examiniation for Personnel Assistant 3 (PS6912E), Department of Military and Veterans Affairs.

 

ACTION:    The Civil Service Commission directed that this appeal be granted.

 

B-58   TRICIA PALAZZONE, ET AL. - CSC DOCKET NOS. 2022-2036, ET AL.

 

Tiricia Palazzone, Stacy Mills, and Pasqualina Hollendonner appeal the determinations of the Division of Agency Services, which found that they were ineligible for the promotional examination for Records Technician 3, Motor Vehicles (PS6554T), Motor Vehcile Commission on the basis that they were not permanent in the competitive division of the carreer service as of the closing date. The Motor Vehicle Commission requests that the appointment type recorded for each incumbent in the title of Technician MVC be amended to regular appointment (promotion) upon completion of their working test periods.

 

ACTION:    The Civil Service Commission directed that these requests be granted in part.

 

B-59   ANTONIO SMITH, SR. - CSC DOCKET NO. 2022-1961

 

Antonio Smith, Sr., appeals the determiniation of the Division of Agency Services, which found he was ineligible for the promotional examination for Records Technician 3, Motor Vehicles (PS6554T), Motor Vehicle Commission on the basis that he was not permanent in the competitive division of the career service as the closing date.

 

         ACTION:      The Civil Service Commission directed that this appeal be denied.

 

B-60   LEO BLAKE - CSC DOCKET NO. 2022-2307

 

Leo Blake requests a retroactive effective date of the reclassification of his position from Resource Interpretive Specialist 2, Historic Resources to Resource Interpretive Spcialist 3.

 

         ACTION:     The Civil Service Commission directed that this request be granted.

 

B-61   TECHNICIAN, MVC AND TECHNICIAN TRAINEE, MVC - CSC DOCKET NO. 2022-2121

 

The Division of Agency Services recommends the reallocation of the Technician MVC title to the noncompetative division of the career service in accordance with N.J.A.C. 4A:3-1.2 and the inactivation of the Technician Trainee MVC title.

 

         ACTION:     The Civil Service Commission directed that this request be granted.
