A regular meeting of the Civil Service Commission was held on Wednesday, May 6, 2015, in Trenton, New Jersey.
PRESENT: Robert M. Czech, Chairperson, Members Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Nicholas Angiulo, Assistant Director, Division of Appeals and Regulatory Affairs.
In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.
DISMISSAL FOR FAILURE TO APPEAR
The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

Recommendation of the Administrative Law Judge - Modify the removal to a 30 working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Wanda Hunt, Senior Therapy Program Assistant, Trenton Psychiatric Hospital, Department of Human Services, removal effective September 20, 2014, on charges of conduct unbecoming a public employee and other sufficient cause.
Recommendation of the Administrative Law Judge - Reverse the removal.
ACTION: The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a six-month suspension.

Charles Nemeth, Equipment Operator, Morris County, Department of Utilities Authority, removal effective January 3, 2014, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty, misuse of public property, including motor vehicles, and other sufficient cause.
Recommendation of the Administrative Law Judge - Reverse the removal.
ACTION: The Civil Service Commission directed that this matter be held over.
A-8 ROBERT RANDOLPH (A decision will be posted in this matter when the Civil Service Commission makes a decision at a future meeting.)
Robert Randolph, Assistant District Parole Supervisor, Juvenile Justice Commission, Administration, demotion to Senior Parole Officer effective July 14, 2012 and 60 working day suspension, on charges of misuse of public property, including motor vehicles, conduct unbecoming a public employee, and other sufficient cause.
Recommendation of the Administrative Law Judge - Reverse demotion and 60 working day suspension.
ACTION: The Civil Service Commission adopted the recommendation of the Administrative Law Judge regarding the 60 working day suspension. However, it rejected the recommendation concerning two of the demotions and upheld these demotions. The Civil Service Commission also directed that the matter of another demotion be remanded to the Office of Administrative Law.
A-9 MELISSA WALKER
Melissa Walker, Parking Enforcement Officer, City of Hoboken, Department of Transportation and Parking, six working day, eight working day, 10 working day, 30 working day, and 60 working day suspensions and removal effective August 8, 2014 on charges of failure to perform duties, insubordination, neglect of duty, chronic or excessive absenteeism or lateness, and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the six working day, eight working day, 10 working day, 30 working day and 60 working day suspensions and modify the removal to a six-month suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

James White, County Correction Officer, Camden County, Department of Corrections, six-month suspension on charges of conduct unbecoming a public employee, neglect of duty, misuse of public property, including motor vehicles, and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the six-month suspension.

Recommendation of the Administrative Law Judge - Modify the removal and resignation not in good standing to a 60 working day suspension and resignation in good standing.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1 D.D. - CSC DOCKET NO. 2014-2323
D.D. appeals her rejection as a Parole Officer Recruit candidate by the State Parole Board and its request to remove her name from the eligible list for Parole Officer Recruit (S0738M) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this matter be referred for an independent evaluation.
B-2 J.L. - CSC DOCKET NO. 2014-2998
J.L., represented by Damian P. Conforti, Esq., appeals his rejection as a Sheriff's Officer candidate by the Essex County Sheriff's Office and its request to remove his name from the eligible list for Sheriff's Officer (S9999M) on the basis of psychological unfitness to perform effectively the duties of the position.

Crystina Burt requests reconsideration of the decision rendered on December 3, 2014, which permitted her to amend her application for the Entry Level Law Enforcement Examination (S9999R).

The Department of Environmental Protection requests that Ian Fisher's out-of-title work experience in the title of Environmental Specialist 2 be accepted to qualify him for a prospective promotional examination for Software Development Specialist 2.
ACTION: The Civil Service Commission directed that this request be granted.

Jeffrey Meyer petitions the Civil Service Commission for reconsideration of its final decision, rendered on December 17, 2014, which found him ineligible for the Manager 4, Environmental Protection, Technical, Scientific, Engineering (PS6834G), Department of Environmental Protection examination.
ACTION: The Civil Service Commission directed that this request be denied.
B-27 MANO PONNA - CSC DOCKET NO. 2015-2657
The Newark School District request reconsideration of the decision rendered on February 4, 2015, which ordered it to pay Mano Ponna an amount equal to 30 days of pay as a result of its failure to provide him with the required notice of layoff.
ACTION: The Civil Service Commission directed that this request be denied.

Alexander Reinert appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirements for the open competitive examination for Personnel Technician (C0767S), Atlantic County.

B-29 V.E. - CSC DOCKET NO. 2015-1663
V.E., a Payroll Clerk with the Department of Human Services (DHS), appeals the decision of the Equal Employment Office Director for DHS, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.

Marose (ALJ), who rendered her initial decision on March 13, 2015. At its meeting on April 15, 2015, the Civil Service Commission (Commission) adopted the ALJ's recommendation to reverse the removal. However, the Commission ordered that the appellant undergo a psychological fitness-for-duty examination prior to returning to work.
ACTION: The Civil Service Commission adopted the decision.
B-56 SALARY REGULATIONS FOR FISCAL YEAR 2015, SUPPLMENT 1
Submitted for the Civil Service Commission's review are the Salary Regulations for Fiscal Year 2015, Supplement 1. The Supplement makes a change to Section 3 - Special Incentive Programs to add two titles to the list of titles to which appointments may be made above Step 4 without obtaining prior approval from the Chair/CEO of the Civil Service Commission and the Director of the Office of Management and Budget. Supplement 1 has been approved by Robert M. Czech, Chair/CEO, Civil Service Commission, and Charlene M. Holzbaur, Director, Division of Budget and Accounting.

Submitted for the Civil Service Commission's review is a Notice of Proposal to readopt with amendment N.J.A.C. 4A:9, Political Subdivisions. This rule chapter is set to expire on July 1, 2015. In accordance with N.J.A.C. 1:30-6.4(g), the expiration date will be extended by 180 days so long as the proposed readoption is filed with the Office of Administrative Law prior to July 1, 2015.

Gorman (ALJ), who rendered his initial decision on February 19, 2015. At its meeting on April 15, 2015, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to modify the removal to a five working day suspension. Rather, the Commission modified the penalty to a 45 working day suspension.
