A regular meeting of the Civil Service Commission was held on Wednesday, June 1, 2011, in Trenton, New Jersey.

PRESENT: Robert M. Czech, Chairperson, Members Robert E. Brenner, Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Robert M. Czech, Chairperson, opened the meeting with the following statement:

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

ACTION:

The Civil Service Commission acknowledged the settlements with the exception of Tam Dang which was held over at the request of the appellant.

A-2 DANIEL BAKER (REMAND)

 

 

Daniel Baker, Fire Fighter, City of East Orange, Fire Department, 30-day suspension on the charge of conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the 30-day suspension.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-3 TYRON DUBOSE, II

 

 

Tyron DuBose, II, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, indefinite suspension pending criminal charges effective December 3, 2009.

Recommendation of the Administrative Law Judge - Uphold the indefinite suspension.

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

Sherman McCray, County Correction Sergeant, Burlington County, County Jail, seven-day suspension, 10-day suspension and demotion to the position of County Correction Officer effective March 8, 2009, on charges of incompetency, inefficiency or failure to perform duties, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the seven-day suspension, the 10-day suspension and the demotion to the position of County Correction Officer.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5 WEST MILFORD TEMPORARY LAYOFFS

 

 

Anthony Adragna, et al., Township of West Milford, appeal the good faith of their temporary layoffs effective September 3, October 8, November 12, and December 27, 2010, for reasons of economy and efficiency.

Recommendation of the Administrative Law Judge - Grant the appointing authority's motion for summary decision and uphold the temporary layoffs.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-6 VICTORIA CARTER

 

 

Victoria Carter, Principal Clerk Typist, Central Office, Department of Human Services, removal effective May 26, 2010, on charges of conviction of criminal offense and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

Phillip Cook, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal effective August 20, 2009 on charges of conduct unbecoming a public employee, other sufficient cause, physical abuse of a patient, inappropriate physical contact or mistreatment of a patient and violation of a policy.

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-8 LASHONN DURANT

 

 

Lashonn Durant, Police Officer, City of Plainfield, Department of Public Affairs and Public Safety, removal effective April 5, 2010, on charges of conduct unbecoming a public employee, and violation of Department rules regarding duties and responsibilities, subversive conduct, alcohol intoxication off duty and arrest.

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-9 ALLICYN EVANS

 

 

Allicyn Evans, Human Services Technician, Veterans Memorial Home, Paramus, Department of Military and Veterans Affairs, removal effective October 8, 2009, on charges of being absent from work as scheduled without permission and without giving proper notice of intended absence, chronic or excessive absence from work without pay and violation of a rule, regulation, policy, procedure, order or administrative decision.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge. 

 

James Harris, Residential Living Specialist, Trenton Psychiatric Hospital, Department of Human Services, removal effective March 6, 2009, on charges of conduct unbecoming a public employee, mistreatment of a patient, violation of policy, falsification and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-11 ANTHONY MCIVER

 

 

Anthony McIver, Senior Correction Officer, South Woods State Prison, Department of Corrections, removal effective October 21, 2010, on charges of conduct unbecoming a public employee, other sufficient cause and violation of a rule, regulation, policy, order, or administrative decision.

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-12 DAVID HOPKINS

 

 

David Hopkins, County Correction Sergeant, Mercer County, Department of Public Safety, removal effective June 14, 2008, on charges of other sufficient cause, negligence in performing duty resulting in injury to persons or damage to property, failure to report injury, abuse or accident involving patient, resident or client, use of force and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

 

Michael Ogonowski, County Correction Officer, Mercer County, Department of Public Safety, fine in the amount of $18,267.60 (equal to 60 days' pay) on charges of other sufficient cause, violation of administrative procedures and/or regulations involving safety and security, and failure to report injury, abuse or accident involving patient, resident or client and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Reverse the fine of $18,267.60 (equal to 60 days' pay).

 

ACTION:

The Civil Service Commission modified the recommendation of the Administrative Law Judge to a fine equal to 20 days' pay.

A-14 ELMER STOCKS

 

 

Elmer Stocks, Electrical Inspector, City of Atlantic City, Department of Neighborhood Services, removal, on charges of incompetency, inefficiency, or failure to perform duties, insubordination, conduct unbecoming a public employee, other sufficient cause, violation of Department policy and procedures manual, falsification of public records, and behaving in a way that instigates or provokes ill will or animosity, including fighting or other physical contact between employees or between employees and others.

Recommendation of the Administrative Law Judge - Modify the removal to a sixty-day suspension.

ACTION:

The Civil Service Commission modified the recommendation of the Administrative Law Judge and upheld the removal.

 

 

 

Jorge Guerrero, Truck Driver, Hudson County, Department of Roads and Public Property, 90 working day suspension on charges of conduct unbecoming a public employee, insubordination, creating a hostile work environment, threatening and intimidating a fellow employee, physical abuse, endangering the life of a fellow employee, and negligence and removal effective November 4, 2010, on charges of conduct unbecoming a public employee, insubordination, and neglect of duty. Settled to a resignation in good standing effective November 4, 2010 and a lump sum payment of $8,000.

Recommendation of the Administrative Law Judge - Acknowledge the settlement.

 

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-16 WILLIE JETTI (CONSOLIDATION) SETTLEMENT

 

 

Willie Jetti, Fire Fighter, City of Newark, Fire Department, removal effective June 1, 2009, on charges of incompetency, inefficiency, or failure to perform duties, chronic or excessive absenteeism or lateness, conduct unbecoming a public employee, neglect of duty, and other sufficient cause. Settled to a resignation in good standing effective June 1, 2009. Willie Jetti, County Correction Officer, Essex County, removal effective May 26, 2010, on charges of conduct unbecoming a public employee, inability to perform duties, incompetency, inefficiency or failure to perform duties and other sufficient cause. Settled to a resignation in good standing effective May 26, 2010.

Recommendation of the Administrative Law Judge - Acknowledge the settlements.

ACTION:

The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

 

The Division of State and Local Operations requests the inactivation of 28 general and department specific unclassified titles.

The Civil Service Commission directed that this request be granted.

ACTION:

B-2 BRUCE DAVIS

 

Bruce Davis, a Senior Correction Officer, Juvenile Justice, with the Juvenile Justice Commission, Department of Law and Public Safety, represented by Frank M. Crivelli, Esq., appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-3 GAIL HARGROVE

 

 

Gail Hargrove, an Assistant Deputy Public Defender 3 with Office of the Public Defender, appeals the denial of sick leave injury (SLI) benefits.

Wayne Shaw, a Senior Correction Officer with South Woods State Prison, Department of Corrections, represented by Daniel Geddes, Esq., appeals the denial of sick leave injury (SLI) benefits.

B-6 JEFFREY SHORTENCARRIER

 

 

Jeffrey Shortencarrier, a Senior Correction Officer with South Woods State Prison, Department of Corrections, represented by Daniel Geddes, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:

The Civil Service Commission directed that this appeal be denied.

 

 

 

Daniel Joseph Lookner, represented by Thomas A. Cushane, Esq., appeals his rejection as a Police Officer candidate by Lawrence Township and its request to remove his name from the eligible list for Police Officer (S9999K) on basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-9 LUIS ALICEA, ET AL.

 

 

Luis Alicea, Joseph Chamberlain, Charles Cossaboone, Joseph Marrero, Darryl Russo, and Tamisha Shepherd, Senior Correction Officers with the Department of Corrections, represented by Colin M. Lynch, Esq., appeal fines in the amount of $413.76 imposed by the Department of Corrections. Paul Miller, a Correction Sergeant with the Department of Corrections, appeals a fine in the amount of $465 imposed by the Department of Corrections.

ACTION:

The Civil Service Commission directed that these appeals be granted.

 

 

 

Paul Ortiz appeals the decision of the Division of State and Local Operations, which upheld the removal of his name from the eligible list for Fire Fighter (M2376H), New Brunswick, for failure to meet the residency requirements.

 

ACTION:

The Civil Service Commission directed that this appeal be granted.

B-11 HIRAN PATEL

 

 

The Director of the Division of Selection Services petitions the Civil Service Commission for enforcement of the decision rendered on January 14, 2009, wherein the Commission ordered that Hiran Patel be removed from his provisional title upon his failure to pass the promotional examination for Section Supervisor Fiscal Resources (PS7410P), Department of Law and Public Safety.

 

ACTION:

The Civil Service Commission directed that this petition be granted and the appointing authority be fined $3,204 for its non-compliance with the Commission decision.

B-12 THAKUR PERSAUD

 

 

Thakur Persaud, a Program Manager, Disease Prevention and Control, with Paterson, represented by John J. Segreto, Esq., appeals his non-appointment from the eligible list for Health Officer (M0991L), Paterson.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-13 DAWN SOLANO

 

 

Dawn Solano, a former Clerk Typist with Kearny, represented by Paul L. Kleinbaum, Esq., appeals the temporary appointment of Stacey Vagueiro as a Clerk Typist.

ACTION:

The Civil Service Commission directed that this appeal be granted but no further remedy be awarded to the appellant.

 

 

 

Kenneth Carroll requests a make-up examination for the written portion of the examination for Fire Fighter (M9999M), various jurisdictions.

 

ACTION:

The Civil Service Commission directed that this request be granted.

B-15 JOSEPH RATAJCZAK

 

 

Joseph Ratajczak requests a make-up examination for the Entry Level Law Enforcement Examination (S9999M).

 

ACTION:

The Civil Service Commission directed that this request be granted.

B-16 BETH LARKIN

 

 

The Department of Law and Public Safety, on behalf of Beth Larkin, a Supervisor, Records Management, with the Division of State Police, requests a waiver of repayment of a salary overpayment, pursuant to N.J.S.A. 11A:3-7, which provides that when an employee has erroneously received a salary overpayment, the Civil Service Commission may waive repayment based on a review of the case. It also requests that her salary be "red circled."

ACTION:

The Civil Service Commission directed that the request for waiver of repayment of the salary overpayment be granted in part and the request to "red circle" Ms. Larkin's salary be denied.

Agenda Item B-16 was held to be considered at the conclusion of the regular agenda. At that time, a motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Civil Service Commission entered into Executive Session for the purpose of legal advice. The Commission subsequently reconvened the public meeting.

B-17 PASQUALE ANGELASTRO

 

Pasquale Angelastro, Camden County, Public Safety and Juvenile Justice Department, appeals the determination of his layoff rights by the Division of State and Local Operations.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-18 LEONARD BLANCO, ET. AL.

 

 

Leonard Blanco, Paula Hill, Suzanne Holzer, Carol Miller, and Rena Rotella, former Building Maintenance Workers with Hunterdon County, appeal the determination of their layoff rights by the Division of State and Local Operations.

 

ACTION:

The Civil Service Commission directed that these appeals be denied.

B-19 RUDOLPH WALDINGER

 

 

Rudolph Waldinger, a former Data Processing Technician with Monmouth County, represented by Catherine M. Elston, Esq., appeals the determination of his layoff rights by the Division of State and Local Operations.

The Policemen's Benevolent Association Local 25, represented by David J. DeFillippo, Esq., and the West Orange Police Superior Officers' Association, represented by Fredric M. Knapp, Esq., petition the Civil Service Commission for a stay of the layoff of police personnel in West Orange, pending the outcome of their appeals regarding the good faith of their layoffs.

ACTION:

The Civil Service Commission directed that this request be denied.

 

 

 

Damian Hadden appeals the determination of the Division of State and Local Operations that his position with the Department of Corrections is properly classified as an Administrative Analyst 2, Fiscal Management. The appellant seeks an Administrative Analyst 1, Accounting, classification.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-22 JUANA JACKSON

 

 

Juana Jackson appeals the determination of the Division of State and Local Operations which found that her position with the Department of Health and Senior Services is properly classified as Secretarial Assistant 3, Non-Stenographic. The appellant seeks a Secretarial Assistant 2, Non-Stenographic classification.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-23 JAMES JOYCE

 

 

James Joyce appeals the decision of the Division of State and Local Operations that the proper classification of his position with the Department of Law and Public Safety is State Investigator 3, Law and Public Safety. The appellant seeks a State Investigator 1, Law and Public Safety classification.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-24 SEETHA KRISHNAN

 

 

Seetha Krishnan appeals the determination of the Division of State and Local Operations that her position with the Department of Children and Families is properly classified as a Technical Assistant, Contract Administration. The appellant seeks a Contract Administrator 2 or Budget Analyst 1 classification.

ACTION:

The Civil Service Commission directed that this appeal be denied.

 

 

 

Shawn O'Leary appeals the determination of the Division of State and Local Operations that his position is properly classified as Senior Chemist. The appellant seeks a Research Scientist 3, Chemistry classification.

 

ACTION:

The Civil Service Commission directed that this appeal be granted.

B-26 PATRICIA ZEFUTIE

 

 

Patricia Zefutie appeals the determination of the Division of State and Local Operations that her position with the Department of Health and Senior Services is properly classified as Senior Clerk Typist. The appellant seeks a Principal Clerk Typist or Technical Assistant 3 classification.

 

ACTION:

The Civil Service Commission directed that this appeal be denied.

B-27 PROGRAM DEVELOPMENT AIDE, COMMUNITY SERVICE (C0748L), MIDDLESEX COUNTY

 

 

Middlesex County requests permission not to make an appointment from the August 18, 2010 certification for Program Development Aide, Community Service (C0748L).

 

ACTION:

The Civil Service Commission granted the appointment waiver and assessed partial selection costs in the amount of $1,024.

B-28 PROGRAM MONITOR (M1117L), PATERSON HOUSING AUTHORITY

 

 

The Paterson Housing Authority requests permission not to make an appointment from the August 11, 2010 certification for Program Monitor (M1117L).

ACTION:

The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.  

East Orange requests reconsideration of In the Matter of Complaint Investigator (M0101K) and (M0724K), East Orange (CSC, decided February 16, 2011), wherein the Civil Service Commission ordered the appointing authority to properly dispose of the May 14, 2009 certification within 20 days and remove the provisional appointee.

 

ACTION:

The Civil Service Commission directed that the request for reconsideration be denied and the appointment waiver be granted. The Civil Service Commission assessed selection costs in the amount of $2,048 and prior costs of $2,000 for compliance.

B-30 POLICE OFFICER (S9999K), DEPTFORD TOWNSHIP

 

 

Deptford Township requests reconsideration of In the Matter of Police Officer (S9999K), Deptford Township (CSC, decided February 2, 2011) wherein the Civil Service Commission ordered the appointing authority to properly dispose of the March 30, 2009 certification (OL090412) within 30 days and remit $500 in compliance costs.

 

ACTION:

The Civil Service Commission directed that this request be granted.

B-31 ROLAN CARTER

 

 

The appeal of Rolan Carter, a Police Officer with the City of Camden, of his removals, effective June 25, 2009, on charges, was heard by Administrative Law Judge Susan M. Scarola, who rendered her initial decision on April 12, 2011. At its meeting on May 18, 2011, the Civil Service Commission adopted the ALJ's recommendation to deny the appellant's request to withdraw his appeal and ordered that the matter be remanded to the Office of Administrative Law for further proceedings. The proposed decision is now submitted for the Commission's review.

ACTION:

The Civil Service Commission adopted the decision.  

The appeal of William Johnson, a Senior Correction Officer with the Albert C. Wagner Youth Correctional Facility, Department of Corrections, of his removal effective August 6, 2010, on charges, was heard by Acting Director and Chief Administrative Law Judge Laura Sanders, who rendered her initial decision on April 6, 2011. At its meeting on May 18, 2011, the Civil Service Commission adopted the ALJ's recommendation to uphold the removal. However, the Commission found it necessary to address the exceptions and cross exceptions filed by the parties. The proposed final decision is now submitted for the Commission's review.

 

ACTION:

The Civil Service Commission adopted the final decision.

B-33 JAMIE SKINNER

 

 

The appeal of Jamie Skinner, a Senior Correction Officer with East Jersey State Prison, Department of Corrections, of his removal effective June 17, 2009, on charges, was heard by Administrative Law Judge Barry E. Moscowitz, who rendered his initial decision on March 4, 2011. The appeals of Pablo Bosques, Jr., a former Building Maintenance Worker, Thomas Burns, a former Water Meter Reader, Rodney Cameron, a former Filter Operator, Alan Deak, a former Water Repairer, Pablo DeLeon, a former Laborer, Vincent Delibero, a former Equipment Operator, Brian Donnelly, a former Water Treatment Plant Operator, Guillermo Febles, a former Pumping Station Repairer, Hector Leon, a former Laborer, Kenneth Mroczkowski, a former Laborer, Joseph Porcaro, a former Senior Water Treatment Plant Operator, Andy Rios, a former Water Reservoir Attendant, William Rivera, an Equipment Operator, Mario Santiago, a former Heavy Equipment Operator, Edvardo Silva, a former Filter Operator, Clyton Waters, a former Senior Water Treatment Plant Operator, and Francis Wild, a former Equipment Operator/Water Repairer with the City of Perth Amboy (City), of their layoffs, effective June 30, 2009, were heard by Administrative Law Judge Sandra Ann Robinson (ALJ), who rendered her initial decision on December 2, 2010. At its meeting on May 18, 2011, the Civil Service Commission adopted the ALJ's recommendation to uphold the layoffs and dismiss the appellants' appeals. However, the Commission did not adopt that portion of the ALJ's initial decision in which she found bad faith with regard to the reemployment of the appellants. The proposed final decision is now submitted for the Commission's review.

 

ACTION:

The Civil Service Commission adopted the final decision.

B-35 ANDREW D. BENESCH

 

 

Andrew D. Benesch appeals the determination of the Division of Selection Services which found that he did not meet the requirements for the promotional examination for Health Systems Specialist 1 (PS3194H), Department of Health and Senior Services.

ACTION:

The Civil Service Commission directed that this appeal be granted.  

Yvette C. Everson and Carly C. Miller appeal the determinations of the Division of Selection Services which found that they did not meet the requirements for the promotional examination for Personnel Assistant 2, Employee Relations (PS4129K), Department of Children and Families.

The Civil Service Commission directed that these appeals be granted.

B-37 DANIEL S. PANARELLO

 

 

Daniel S. Panarello appeals the determination of the Division of Selection Services which found that he did not meet the requirements for the promotional examination for Management Information Systems Coordinator (PC0049M), Atlantic County.

The Civil Service Commission directed that this appeal be granted.

B-38 DOROTHEA REED-ROBERSON

 

 

Dorothea Reed-Roberson appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the open competitive examination for Supervisor of Accounts (C0466M), Essex County.

Justin Salkind appeals the determination of the Division of Selection Services that he did not meet the experience requirement for the open competitive examination for Field Representative Housing, Housing Assistance Program (S0728M).

The Department of the Treasury requests that it be permitted to promote Sante Benedetti from the non-competitive title of Postal Clerk to the competitive title of Principal Postal Clerk pursuant to N.J.A.C. 4A:4-1.1(c)2.

The Civil Service Commission directed that this request be granted.

B-42 LUIS A. CORRO

 

 

The City of Perth Amboy, on behalf of Luis A. Corro, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remainder of his working test period as a Police Officer with Perth Amboy.

 

ACTION:

The Civil Service Commission directed that this request be granted.

B-43 ISA MCCLENDON

 

 

The City of Elizabeth, on behalf of Isa McClendon, requests that she be permitted to participate in the intergovernmental transfer program and to complete the remainder of her working test period as a Police Officer with Elizabeth.

ACTION:

The Civil Service Commission directed that this request be granted.  

The appeal of Albert McCloy, a Senior Police Officer with the Department of Human Services, of his removal, effective May 11, 2010, on charges, was heard by Administrative Law Judge Donald J. Stein, who rendered his initial decision on April 7, 2011. At its meeting on May 18, 2011, the Civil Service Commission did not adopt the ALJ's recommendation to modify the removal to a six-month suspension. Rather, the Commission upheld the appellant's removal. The proposed final decision is now submitted for the Commission's review.

 

ACTION:

The Civil Service Commission adopted the final decision.

B-45 ANTHONY J. SISK

 

 

Anthony J. Sisk, represented by Thomas J. Cammarata, Esq., and the County of Hudson, represented by Cindy N. Vogelman, Esq., petition the Civil Service Commission to acknowledge the settlement agreement between the parties relating to Mr. Sisk's removal from the eligible list for Sheriff's Officer (S9999H), County of Hudson, due to psychological unfitness to perform effectively the duties of the position.

 

ACTION:

The Civil Service Commission acknowledged the settlement.

ACTION:

The Civil Service Commission directed that this request be granted.  

Maria Rodriguez, a former Senior Building Maintenance Worker, with Montclair State University, requests that the Civil Service Commission reinstate her appeal of her resignation not in good standing effective November 17, 2009, which was dismissed based on her failure to appear at her scheduled hearing.

 

ACTION:

The Civil Service Commission directed that this request be denied.
