A regular meeting of the Civil Service Commission was held on Wednesday, July 8, 2009, in Trenton, New Jersey.
PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, John Currie and Margaret E. L. Howard; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2008, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
*It is noted that agenda Items A-3 Nathaniel Parker and B-33 Alonzo Cumberlander were considered at the conclusion of all other agenda items.
All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT
ACTION: The Civil Service Commission acknowledged the settlements.
A-2 WALTER H. BENNETT
Walter H. Bennett, Institutional Trade Instructor 1, South Woods State Prison, Department of Corrections, 10-working day suspension on the charge of neglect of duty.
Recommendation of the Administrative Law Judge - Reverse the 10-working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
*A motion was made and seconded that the open session be recessed at the conclusion of all other agenda matters, and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Civil Service Commission entered into Executive Session for the purpose of viewing video tapes of incidents which showed residents and inmates at State facilities involving the matters of A-3 Nathaniel Parker and B-33 Alonzo Cumberlander, since the matters would constitute unwarranted invasions of individual privacy. The Commission subsequently reconvened the public meeting.
A-3 NATHANIEL PARKER
Nathaniel Parker, Correction Lieutenant, Juvenile Justice, Juvenile Justice Commission, Department of Public Safety, 108-day suspension, on charges of conduct unbecoming a public employee, other sufficient cause, inappropriate physical contact or mistreatment of a resident and violation of a rule, regulation or procedure.
Recommendation of the Administrative Law Judge - Reverse the 108-day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-4 JOSEPH PIZZI
Joseph Pizzi, Fire Fighter, Township of Belleville, Fire Department, eight-day suspension on charges of insubordination, inappropriate conduct toward superior, and criticism of official acts or orders.
Recommendation of the Administrative Law Judge - Enforce and acknowledge the settlement.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-5 ALEXANDER ROSARIO
Alexander Rosario, County Correction Officer, Hudson County, Department of Corrections, 10-day suspension on charges of incompetency, conduct unbecoming a public employee and neglect of duty.
Recommendation of the Administrative Law Judge - Reverse the 10-day suspension.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to a five-day suspension.
A-6 EUGENE COLLINS (CONSOLIDATION)
Eugene Collins, Police Officer, City of Newark, Police Department, removal effective February 8, 2008, on charges of conduct unbecoming a public employee, neglect of duty, and violation of Police Department rules regarding compromising arrangements, loyalty, report of crime, knowledge of crime, bound by duty and efficiency and cooperation and removal effective February 8, 2008, on charges of inability to perform duties and violation of Police Department rules regarding mental and physical capability.
Recommendation of the Administrative Law Judge - Modify one removal to a six-month suspension and reverse one removal.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to uphold one removal and reverse one removal.
A-7 GREGORY WADE
Gregory Wade, County Correction Officer, Camden County, Department of Corrections, two removals effective October 3, 2007, on charges of conduct unbecoming a public employee, neglect of duty, and violation of Department rules regarding conduct, departmental reports, use of force, courtesy and civil rights.
Recommendation of the Administrative Law Judge - Uphold the removals.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
SECTION B - MISCELLANEOUS MATTERS
B-1 RICKY BURGMAN
Ricky Burgman appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-2 BRUCE GILMER
Bruce Gilmer appeals his rejection as a Police Officer candidate by Phillipsburg and its request to remove his name from the eligible list for Police Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this matter be referred for an independent psychological evaluation.
B-3 RONALD E. MANNING, JR.
Ronald E. Manning, Jr. appeals his rejection as Fire Fighter candidate by Elizabeth and its request to remove his name from the eligible list for Fire Fighter (M2275E) on the basis of psychological unfitness to perform effectively the duties of the position.

Shaytika Bryant appeals the decision of the former Division of State Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Correction Officer Recruit (S9999H), Department of Corrections eligible list, on the basis of falsification of her employment application.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-14 ALEXIS T. MILLER
Alexis T. Miller appeals the decision of the former Division of State Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Probation Officer (S0508H), Judiciary, Union County Vicinage eligible list on the basis of an unsatisfactory background report.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-15 BRIAN TAKACH
Brian Takach appeals the decision of the Division of Local Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Police Officer (S9999H), Fair Lawn eligible list, on the basis of making false statements of material facts.

B-17 DATA PROCESSING TECHNICIAN (SPECIAL RE-EMPLOYMENT LIST), NEWARK
The former Division of Local Human Resource Management requests that Newark be ordered to return the May 27, 2008 certification for Data Processing Technician (Special Re-employment List) for proper disposition.
ACTION: The Civil Service Commission ordered the appointing authority to properly dispose of the certification and pay compliance costs in the amount of $500.
B-18 LOAN ADVISOR (M1466H), NEWARK
The Division of Local Human Resource Management requests that Newark be ordered to return the May 14, 2008 certification for Loan Advisor (M1466H) for proper disposition.
ACTION: The Civil Service Commission ordered the appointing authority to properly dispose of the certification, remove the provisional appointee and pay compliance costs in the amount of $500.
B-19 PAYROLL CLERK (M1802J), JERSEY CITY
Jersey City requests permission not to make an appointment from the February 25, 2008 certification for Payroll Clerk (M1802J).
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.
B-20 PRINCIPAL CLERK TYPIST (M1869K), MILLBURN TOWNSHIP
Millburn Township requests permission not to make an appointment from the June 30, 2008 certification for Principal Clerk Typist (M1869K).
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.
B-21 JOANNE RHODES
Joanne Rhodes, a Supervisor 2, Motor Vehicles with the Motor Vehicle Commission, appeals the determination of the Chief of Staff, which found that the appellant failed to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-22 CHRISTOPHER M. CARTY AND THE ESTATE OF ROBERT ROEDER
Christopher M. Carty, a former County Correction Officer with Atlantic County, and the Estate of Robert Roeder, represented by Keith Waldman, Esq., appeal Mr. Carty's and Mr. Roeder's resignations in good standing.
ACTION: The Civil Service Commission referred the matter of Christopher M. Carty to the Office of Administrative Law for a hearing and dismissed the appeal of the Estate of Robert Roeder as moot.
B-23 EMERGENCY MEDICAL TECHNICIAN LAYOFF, CITY OF PERTH AMBOY
The Professional Firefighters Association of New Jersey and the Perth Amboy Fire Department Professional Emergency Medical Technicians International Association of Firefighters, Local 3994, represented by Raymond G. Heineman, Jr., Esq., requests relief from the Civil Service Commission regarding the June 30, 2009 layoff of Emergency Medical Technicians with the City of Perth Amboy.
ACTION: The Civil Service Commission denied the request for relief but granted a hearing with regard to the good faith of the layoff.
B-24 ZACHARIAH DAIS AND VINCENT RANSOM
Zachariah Dais, a former Relocation Officer, and Vincent Ransom, a former Relocation Assistant, with the City of Newark's Department of Economic and Housing Development, represented by Clayton Giles, Esq. appeal the determinations of their layoff rights by the Division of Local Human Resource Management.
ACTION: The Civil Service Commission directed that the appeal of Zachariah Dais be granted in part and directed that the appeal of Vincent Ransom be denied.
B-25 JOHN LEWIS AND JOHN SHULTZ
John Lewis and John Shultz, former County Correction Officers with Monmouth County, represented by Robert A. Fagella, Esq., petition the Civil Service Commission for relief regarding their layoffs effective May 1, 2009.
ACTION: The Civil Service Commission denied the requests.

Atlantic County requests a retroactive permanent appointment date for Juan Ramos as a County Correction Sergeant.
ACTION: The Civil Service Commission granted the request.

Rosemary Lapp, Senior Correction Officer, appeals an official written reprimand issued by the Department of Corrections.

Kevin Lopina, Senior Correction Officer, represented by Jerry Verdier, PBA Local 105, appeals an official written reprimand issued by the Department of Corrections.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-29 ROBERT HARRIS
Robert Harris appeals the decision of the Division of State Human Resource Management which found that his position is properly classified as Technical Assistant 3. He seeks a Technical Assistant 2, Treasury job classification in this proceeding.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-30 KEISHA HENDERSON
Keisha Henderson, represented by Gregory R. Preston, Esq., petitions the Civil Service Commission for enforcement of the decision in In the Matter of Keisha Henderson (MSB, decided May 8, 2008), in which Henderson's removal was reversed and her immediate reinstatement with appropriate back pay, benefits and seniority was ordered. Additionally, Essex County, represented by Steven J. Augustin, Assistant County Counsel, requests that the prior decision be stayed.
ACTION: The Civil Service Commission granted the request for enforcement but denied the request for a stay.

Trevor Weigle appeals his initial appointment as an unclassified Municipal Department Head, Bloomfield Township Board of Health. The appellant seeks a retroactive appointment date to the competitive title

Keary Allen, a Police Officer with the City of Newark, represented by Eric Winston, Esq., petitions for reconsideration of the final decision rendered on May 7, 2008, which upheld his two removals, effective December 6, 2004.
ACTION: The Civil Service Commission denied the request for reconsideration.
*B-33 ALONZO CUMBERLANDER
The Department of Corrections, represented by Sarah B. Campbell, Deputy Attorney General, petitions the Civil Service Commission (Commission) for reconsideration of the Commission decision rendered on January 14, 2009, which reversed the removal of Alonzo Cumberlander, a Senior Correction Officer with Northern State Prison, Department of Corrections.
ACTION: The Civil Service Commission granted the request for reconsideration but affirmed its prior decision reversing the removal.
B-34 RALPH CHIMENTO
Ralph Chimento petitions the Civil Service Commission for reconsideration of the decision rendered on June 11, 2008, in which his request for admittance to the examination for Fire Lieutenant (PM2631J), Belleville, was denied.
ACTION: The Civil Service Commission denied the request for reconsideration.

Joseph Gaines, an Assistant Supervisor of Motor Pool with Trenton, represented by Bruce Darvas, Esq., petitions for reconsideration of the final decision rendered on December 17, 2008, which upheld his removal, effective February 9, 2005.
ACTION: The Civil Service Commission denied the request for reconsideration.

Sheila Tolor, a former Communications Officer with Newark, represented by Leon Grauer, Esq., petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on June 20, 2008, in which the Director of the Division of Merit System Practices and Labor Relations denied her request for a hearing with respect to her removal from employment.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-37 BENJAMIN RICHARDSON
The appeal of Benjamin Richardson, a Laborer with Newark, of his removal effective January 26, 2007, on charges was heard by Administrative Law Judge Maria Mancini LaFiandra (ALJ), who rendered her initial decision on May 21, 2009. At its meeting on June 24, 2009, the Civil Service Commission found it necessary to address the exceptions and cross-exceptions filed by the parties. The proposed final decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the final decision.

B-38 QURAN SANTANA
The appeal of Quran Santana, a Human Services Assistant with Ancora Psychiatric Hospital, Department of Human Services, of his removal effective October 15, 2007, on charges, was heard by Administrative Law Judge Edward J. Delanoy, Jr. (ALJ), who rendered his initial decision on June 15, 2009. At its meeting on June 24, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to uphold the removal. The proposed final decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the final decision.

Christopher Cavallo (PM2607J), Newark; Jeffrey Lehbrink (PM2592J), Hoboken; and Lino Rosario (PM2615J), Trenton; appeal the determinations of the Division of Selection Services which found them ineligible for the promotional examination for Police Sergeant due to untimely applications.
ACTION: The Civil Service Commission directed that these appeals be denied.

Althea Curry appeals her disqualification from the promotional examination for Administrative Analyst 2 (PS6491R), Board of Public Utilities.
ACTION: The Civil Service Commission directed that this appeal be granted.

Dennis Dziesiuta, Ronald Leszcynski, Ronald Luccarelli, and Michelle Mann appeal the determinations of the Division of Selection Services which found that, per the substitution clause for education, Messrs. Dziesiuta and Luccarelli did not meet the minimum experience requirements, and that Mr. Leszcynski and Ms. Mann did not meet the minimum experience requirements for the promotional examination for Supervisor Information Technology (PS6403U), Office of Information Technology.
ACTION: The Civil Service Commission directed that these appeals be denied.

Kimberly Hollingsworth appeals the determination of the Division of Selection Services which found that she did not meet the education and experience requirements for the promotional examination for Staff Clinical Psychologist 2 (PS9399K), Woodbine Developmental Center.

Wilhemina Martin appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Nursing Administrator, Psychiatric Services (PS8984K), Ancora Psychiatric Hospital, Department of Human Services.
ACTION: The Civil Service Commission directed that the eligible list for Nursing Administrator, Psychiatric Services (PS0720K), Ancora Psychiatric Hospital be revived in order to effectuate the permanent appointment of Wilhemina Martin, effective February 4, 2006.

William J. Morgan appeals the determination of the Division of Selection Services which found that he did not meet the requirements for the open-competitive examination for Mechanical Equipment Specialist (S0086L).

The Division of Selection Services, on behalf of the Department of the Treasury, requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Dennis Corry to be provisionally appointed, pending promotional examination procedures, to the competitive title of Data Base Analyst 1.

The Department of the Treasury, on behalf of William Brennan, requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit him to donate more than 10 sick days to Joanne Pascucci, who is participating in the donated leave program.
ACTION: The Civil Service Commission granted the request.
B-67 ANTHONY HUNT, SR. AND TARA HUNT
The Department of the Transportation, on behalf of Anthony Hunt, Sr., requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to allow him to donate more than 10 days to Tara Hunt, who is participating in the donated leave program. Further, the Department of Human Services, on behalf of Tara Hunt, requests that she be permitted to receive more than the 180 donated leave days allowed to a recipient.
ACTION: The Civil Service Commission granted the requests.
