A regular meeting of the Civil Service Commission was held on Wednesday, July 11, 2012, in Trenton, New Jersey.

ACTION: The Civil Service Commission acknowledged the settlements.

Jamie M. Applegate, Investment Specialist and Mary Pace, Account Clerk Typing, Camden County, Department of Health and Human Services, appeal the good faith of their layoffs effective April 4, 2011, for reasons of economy and efficiency.
Recommendation of the Administrative Law Judge - Uphold the layoffs.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge. The Civil Service Commission also dismissed the appeals of Pasquale Angelastro, Gennie Lebron, and Jennifer Williams for non-appearance at the pre-hearing conference noted the withdrawals of the appeals of Valerie Castagna, Jennifer Fedoriw, and Ronald Molnar.

A-14 JOHN CHIKOWSKI
John Chikowski, Graduate Nurse, Hudson County, Department of Health and Human Services, removal effective November 30, 2010, on charges of conduct unbecoming a public employee, neglect of duty, unfit for duty and other sufficient cause. This matter was held over from the June 20, 2012, Civil Service Commission meeting for summary of testimony.
Recommendation of the Administrative Law Judge - Reverse the removal.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge and upheld the removal.

SECTION B - MISCELLANEOUS MATTERS
B- 1 The Division of Classification and Personnel Management requests the reallocation of the State title, Civil Engineer Trainee, from State service to Common, to address a classification need for Burlington County.

ACTION: The Civil Service Commission directed that this request be granted.
B- 2 The State Commission of Investigation requests the establishment of a Confidential Investigative Specialist title series. In accordance with N.J.S.A. 52:9M-9, employees in the Legislative Branch of State Government shall be in the unclassified service.

ACTION: The Civil Service Commission directed that this request be granted.
B-3 CHRISTOPHER TARONCHER
Christopher Taroncher, a Police Officer with the City of Margate, represented by Erika A. Appenzeller, Esq., petitions the Civil Service Commission for interim relief of his immediate suspension effective April 20, 2012.
ACTION: The Civil Service Commission directed that this request be denied.
B-4 ODISE CARR
Odise Carr, a Police Officer with the City of Camden, represented by Timothy J.P. Quinlan, Esq., seeks enforcement of the Civil Service Commission decision rendered on September 15, 2010, awarding counsel fees.
ACTION: The Civil Service Commission granted counsel fees in the amount of $19,880, $109.92 in costs, and awarded the appellant shift differential pay based on the back pay award he has already received.
B-5 ROBERT DEL PRETE
Robert Del Prete, represented by Arnold Shep Cohen, Esq., petitions the Civil Service Commission for revival of the Maintenance Supervisor (PM0787K), Jersey City School District, eligible list, in order to effectuate the terms of the settlement agreement between him and Jersey City School District.
ACTION: The Civil Service Commission directed that this request be granted.
B-6 CIRO RIBAUDO
Ciro Ribaudo, a Senior Correction Officer with East Jersey State Prison, Department of Corrections, represented by Robert D. Kovic, Esq., requests that his entitlements to benefits, seniority credit and salary step placement be calculated based on his retroactive date of appointment of July 6, 2006, pursuant to the July 3, 2008 final decision of the Police Training Commission.
ACTION: The Civil Service Commission directed that this request be granted.
B-7 LISANDRO ROSARIO
The Borough of Woodland Park, on behalf of Lisandro Rosario, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remainder of his working test period as a Police Officer with Woodland Park.
ACTION: The Civil Service Commission directed that this request be granted.
B-8 JOANNE SAPIA
The Department of Human Services, on behalf of Joanne Sapia, a former Data Processing Analyst 2, requests that N.JA.C. 4A:3-5.6(b)3 be relaxed to allow the cash payment of Sapia's accrued compensatory time, upon her March 1, 2011 retirement.
ACTION: The Civil Service Commission directed that this request be denied.
B-9 KRISTEN SLEEPER
The Department of Law & Public Safety requests that the provisions of N.JA.C. 4A:4-1.1(c) be relaxed in order to allow Kristen Sleeper to be provisionally appointed, pending promotional examination procedures, to the title of Administrative Analyst 2.
ACTION: The Civil Service Commission directed that this request be granted.
B-10 JEWEL TAYLOR
Jewel Taylor, a former Senior Correction Officer with the Central Reception and Assignment Facility, Department of Corrections, represented by Paul L. Kleinbaum, Esq., requests a waiver of repayment of a salary overpayment pursuant to N.J.S.A. 11A:3-7, which provides that when an employee has erroneously received a salary overpayment, the Civil Service Commission may waive repayment based on a review of the case.
ACTION: The Civil Service Commission directed that this request be denied.
B-11 CHRISTOPHER HENRY
Christopher Henry, represented by Jason J. LeBoeuf, Esq., appeals his removal from the special reemployment list for Police Officer, City of East Orange, and his separation from employment as a Police Officer, effective July 1, 2011, with the City of East Orange.
ACTION: The Civil Service Commission granted a hearing.

Keisha Boyd appeals the decision of the Division of Selection Services which found that she lacked the required amount of permanent status in a title to which the examination was open for Correction Sergeant (PS6436I), Department of Corrections.

B-25 MARK A. O'SULLIVAN
Mark A. O'Sullivan appeals the determination of the Division of Selection Services which found that he was not eligible for the promotional examination for Hearing Officer 3, State Parole Board (PS6876I), State Parole Board, because he is not permanent in a competitive title.
ACTION: The Civil Service Commission directed that this appeal be denied and the classification of the appellant's position be referred to the Division of Classification and Personnel Management for further review.
B-26 LUCY RODRIGUEZ
The Department of the Treasury requests the acceptance of out-of-title experience for Lucy Rodriguez to qualify her for a prospective promotional examination for the title of Buyer.
ACTION: The Civil Service Commission directed that this request be granted.
B-27 TRAVON ROMEO
The Township of Teaneck requests that Travon Romeo's out-of-title experience be accepted to qualify him for a prospective promotional examination for the title of Assistant Supervisor, Public Works.
ACTION: The Civil Service Commission directed that this request be granted.
B-28 PATRICIA EDWARDS
Patricia Edwards, a Personnel Assistant 2 with the Department of Human Services (DHS), appeals the determination of the Assistant Commissioner of the DHS, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-29 CHHAYA CHANPURA
Chhaya Chanpura appeals the decision of the former Division of State and Local Operations that the proper classification of her position with the Department of the Treasury is Auditor 3, Taxation. The appellant seeks an Auditor 2, Taxation classification.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-30 JOSEPH GALLAGHER
Joseph Gallagher appeals the decision of the former Division of State and Local Operations that the proper classification of his position with the Department of the Treasury is Auditor 2, Taxation. The appellant seeks an Auditor 1, Taxation classification.

Stephen Klein appeals the decision of the former Division of State and Local Operations that the proper classification of his position with the Department of the Treasury is Auditor 2, Taxation. The appellant seeks an Auditor 1, Taxation classification.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-33 DONALD W. REESE
Mercer County requests that the eligible list for County Correction Officer (S9999F) be revived to record the permanent appointment of Donald W. Reese effective March 30, 2007.
ACTION: The Civil Service Commission directed that this request be granted.
B-34 VIRGINIA BEST
The appeal of Virginia Best, a former Compliant Investigator with the East Orange Department of Health and Human Services, of her layoff effective February 1, 2011, was heard by Administrative Law Judge Barry E. Moscowitz (ALJ), who rendered his initial decision on April 9, 2012. At its meeting on June 20, 2012, the Civil Service Commission adopted the ALJ's recommendation to uphold the layoff. However, the Commission found it necessary to address the exceptions and cross exceptions filed by the parties. The proposed final decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the final decision.
B-35 CARMELO LIO
The appeal of Carmelo Lio, a Senior Correction Officer with the Adult Diagnostic and Treatment Center, Department of Corrections, of his 45 working day suspension, on charges, was heard by Administrative Law Judge Kimberly A. Moss (ALJ), who rendered her initial decision on May 12, 2012. At its meeting on June 20, 2012, the Civil Service Commission did not adopt the ALJ's recommendation to modify the 45 working day suspension to a 20 working day suspension. Rather, the Commission upheld the 45 working day suspension. The proposed final decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the final decision.
B-36 CARLOS SANTIAGO
The appeal of Carlos Santiago, a Building Maintenance Worker with Union County, of his removal, effective December 13, 2011, on charges, was heard by Administrative Law Judge Gail M. Cookson (ALJ), who rendered her initial decision on May 25, 2012. At its meeting on June 20, 2012, the Civil Service Commission did not adopt the ALJ's recommendation to modify the appellant's removal to a 60-day suspension. Rather, the Commission upheld the removal. The proposed final decision is now submitted for the Commission's review.
ACTION: The Civil Service Commission adopted the final decision.
B-37 FIRE FIGHTER (M2321H), ATLANTIC CITY
The Division of State and Local Operations requests that the Civil Service Commission order Atlantic City to return the May 26, 2011 certification of the eligible list for Fire Fighter (M2321H) for proper disposition.
ACTION: The Civil Service Commission directed that this request be granted.
B-38 HUMAN SERVICES SPECIALIST 1, BILINGUAL IN SPANISH AND ENGLISH
The Director, Division of Selection Services, on behalf of the Cumberland County Board of Social Services, requests that the eligible list for Human Services Specialist 1, Bilingual in Spanish and English (C0094L), be extended for six months beyond its original expiration date.
ACTION: The Civil Service Commission directed that this request be granted.
B-39 INVENTORY CONTROL CLERK (C0462M), SALEM COUNTY
Salem County requests permission not to make an appointment from the June 9, 2011 certification for Inventory Control Clerk (C0462M).
ACTION: The Civil Service Commission granted an appointment waiver and assessed selection costs in the amount of $2,048.
B-40 VIOLATIONS CLERK (M0375L), MANASQUAN BOROUGH
Manasquan Borough, represented by Mark G. Kitrick, Borough Attorney, requests permission not to make an appointment from the July 13, 2011 certification for Violations Clerk (M0537L).
ACTION: The Civil Service Commission granted an appointment waiver and assessed selection costs in the amount of $2,048.

The appeal of Mildred Jaime, a Cottage Training Technician at Hunterdon Developmental Center, Department of Human Services, of her removal effective December 7, 2010, on charges, was heard by Administrative Law Judge John R. Futey (ALJ), who rendered his initial decision on January 23, 2012. At its meeting on June 20, 2012, the Civil Service Commission adopted the ALJ's recommendation to reverse the removal. However, the Commission found it necessary to address the exceptions and cross exceptions filed by the parties. The proposed decision is now submitted for the Commission's review.
