A regular meeting of the Civil Service Commission was held on Wednesday, October 3, 2018 at 10:00 a.m., in Trenton, New Jersey.
PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.
In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 17, 2017, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT
ACTION: The Civil Service Commission acknowledged the settlements.
A-2 FATIMA BEATTY
Fatima Beatty, Omnibus Operator, Hudson County, Department of Health and Human Services, Meadowview Psychiatric Hospital, 90 working day suspension on charges of neglect of duty, insubordination, conduct unbecoming a public employee, misuse of public property and other sufficient cause.
Recommendation of the Administrative Law Judge – Modify the 90 working day suspension to a 60 working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-3 MICHAEL MEGARA
Michael Megara, Police Officer, Township of Riverside, Department of Public Safety, removal effective June 27, 2017 on charges of inability to perform duties and other sufficient cause.
Recommendation of the Administrative Law Judge – Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
SECTION B – MISCELLANEOUS MATTERS
B-1 R.D. – CSC DOCKET NOS. 2018-2855 AND 2018-3530
R.D. appeals his removal from the eligible lists for Sheriff’s Officer (S9999U), Cumberland County and Police Officer (S9999U), Vineland on the basis that he possessed an unsatisfactory criminal background.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-2 B.G. – CSC DOCKET NO. 2019-70
B.G. appeals the removal of his name from the Correction Officer Recruit (S9988T), Department of Corrections, eligible list based on an unsatisfactory criminal record and falsification of his employment application.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-3 NAKIA HILL – CSC DOCKET NO. 2018-3279
Nakia Hill, represented by Lawrence E. Popp, Esq., appeals the removal of her name from the Medical Security Officer Recruit (S0239T), Department of Human Services eligible list on the basis of an unsatisfactory criminal record.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-4 DANIEL URBAN – CSC DOCKET NO. 2019-32
Daniel Urban, represented by Thomas J. Cammarata, Esq., appeals Jersey City’s removal of his name from the eligible list for Fire Fighter (M1544T), Jersey City, on the basis that he resided outside the residency scope.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-5 LUKATA YOUNG – CSC DOCKET NO. 2016-3193
Lukata Young, represented by Jean Kim, Esq., appeals the removal of his name from the Police Officer (S9999R), City of Newark eligible list on the basis of an unsatisfactory criminal background, unsatisfactory driving record and failure to complete pre-employment processing.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-6 MELISSA BROWN – CSC DOCKET NO. 2018-1746
Melissa Brown, a Sergeant with the New Jersey State Park Police, appeals the bypass of her name on the State Park Police Lieutenant (PS2442G), Department of Environmental Protection eligible list.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-7 NERMEEN BAKHOUM – CSC DOCKET NO. 2018-3144
Nermeen Bakhoum appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Field Services Supervisor 2, Medical Assistance and Health Services (PS3669K), Department of Human Services.
ACTION: The Civil Service Commission directed that this appeal be granted.

Angelina Ibacache appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Supervisor of Recreation (PS3734H), Ancora Psychiatric Hospital.

Christine Kukoda appeals the determination of the Division of Agency Services which found that she was below the minimum requirements in experience for the promotional examination for Keyboarding Clerk 3 (PM2125V), Hamilton Township.

Michelle McNellis appeals the determination of the Division of Agency Services, which found that she did not meet the experience requirement for the open competitive examination for Administrative Analyst 4 (S0512V), Department of Corrections.

James Mooney appeals his oral score on the promotional examination for Deputy Police Chief (PM0508W), Elizabeth.

Elijah James, a Police Lieutenant with Irvington, represented by Kara A. Mackenzie, Esq., petitions the Civil Service Commission for interim relief regarding his 15 working day suspension without pay commencing on May 11, 2018.
ACTION: The Civil Service Commission directed that this petition be granted in part.

I.C. petitions the Civil Service Commission for relief, pursuant to N.J.S.A. 11A:2-24 and N.J.A.C. 4A:2-5.1, from alleged reprisal from the City of East Orange.

Jo-Ann Browne appeals the determination of the Division of Agency Services that she did not meet the education requirements for the promotional examination for Chemist 1 (PM0604W), Passaic Valley Water Commission.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-20 L.J. – CSC DOCKET NO. 2018-665
L.J., a former Assistant Supervisor 1, Administrative Services with William Paterson University (WPU), appeals the determination of the Vice President for Human Resources, WPU, which found that the appellant failed to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.

Camden County requests that the appointment of Samuel G. Liebman be recorded from the eligible list for County Police Officer (S9999R), Camden County, effective April 4, 2016.

The City of Union City petitions the Civil Service Commission for a retroactive date of appointment to the title of Police Lieutenant for Willie Sierra, in order to effectuate the terms of a settlement agreement.
ACTION: The Civil Service Commission directed that this petition be granted.
B-29 J.R. – CSC DOCKET NO. 2018-3211
J.R., an Administrative Analyst 1, requests reconsideration of the decision rendered on March 27, 2018, which denied his request to participate in the Donated Leave Program on an intermittent basis.
ACTION: The Civil Service Commission directed that this request be denied.
B-30 ALGENORIA SIMPSON - CSC DOCKET NO. 2019-253
Algenoria Simpson, represented by Wolodymr P. Tyshchenko, Esq., requests reconsideration of the decision rendered on May 23, 2018, which upheld the bypass of his name from the eligible list for Police Sergeant (PM4108N), East Orange.
ACTION: The Civil Service Commission directed that this request be denied.
B-31 UPMANYU PATEL – CSC DOCKET NO. 2018-2085
