A regular meeting of the Civil Service Commission was held on Thursday, November 5, 2009, in Trenton, New Jersey.

ACTION: The Civil Service Commission acknowledged the settlements. A-2 KANCHAN KUMAR BAUL
Kanchan Kumar Baul appeals the removal of his name from the eligible list for Human Services Specialist I (C0103K), Atlantic County, on the basis of inability to communicate effectively in English in order to perform the duties of the position. Recommendation of the Administrative Law Judge - Reverse the removal of appellant's name from the Human Services Specialist I (C0103K) eligible list.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-3 MARC PITTS
Marc Pitts, Laborer, Township of Marlboro, Department of Public Works, 30-day suspension on charges of conduct unbecoming a public employee, neglect of duty, misuse of public property, including motor vehicles and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the 30-day suspension.
ACTION: The Civil Service Commission modified the recommendation of the Administrative Law Judge to a 15-day suspension.
A-4 WANDA WRIGHT
Wanda Wright, Human Services Specialist 2, Union County, Department of Human Services, eight-working day suspension on charges of incompetency, inefficiency and/or failure to perform duties, insubordination, chronic and excessive absenteeism, conduct unbecoming a public employee, neglect of duty and violation of the County Attendance Family Leave Policies and Sick Leave Policies.
Recommendation of the Administrative Law Judge - Modify the eight-working day suspension to a five-working day suspension.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-5 FRANCISCO CINTRON
Francisco Cintron, Truck Driver, City of Newark, Department of Neighborhood and Recreational Services, removal effective March 31, 2008, on charges of chronic or excessive absenteeism or lateness and other sufficient cause. Settled to a resignation in good standing.
Recommendation of the Administrative Law Judge - Enforce the settlement agreement.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-6 RON SMITH
Ron Smith, Repairer, Kean University, removal effective February 25, 2008 on charges of conduct unbecoming a public employee and violation of the State of New Jersey Workplace Violence Policy.
Recommendation of the Administrative Law Judge - Modify the removal to a 30-day suspension.
ACTION: The Civil Service Commission directed that this matter be held over.
A-7 MICHAEL SARNI
Michael Sarni, a Youth Worker at the Mercer County Youth Detention Center, was removed from his position, effective February 22, 2007, on charges of conduct unbecoming a public employee, as well as, various violations of departmental policies.
Recommendation of the Administrative Law Judge - Uphold the charges and the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1 SHAWN R. GREENE
Shawn R. Greene, represented by James P. Swift, Esq., appeals his rejection as a Police Officer candidate by Atlantic City and its request to remove his name from the eligible list for Police Officer (S9999H), on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-2 STEPHEN A. MAZZUCOLA
Stephen A. Mazzucola, represented by Thomas J. Cammarata, Esq., appeals his rejection as a Sheriff's Officer candidate by Hudson County and its request to remove his name from the eligible list for Sheriff's Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.

Victoria Suarez, represented by Catherine M. B-12 CHRISTOHER CREIGHTON, LOUIS FUNDORA, AND JOSEPH J. ROGERS, JR.
The Borough of Highlands requests that the eligible list for Police Sergeant (PM2523F), Highlands, be revived in order to permanently appoint Joseph J. Rogers, Jr., effective May 4, 2005, and Christopher Creighton and Louis Fundora, effective May 18, 2005.
ACTION: The Civil Service Commission granted the request.
B-13 COREY HAMILTON
Corey Hamilton appeals the decision of the Division of Local Human Resource Management which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Police Officer (S9999H), Trenton based on his indication that he was no longer interested in the position.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-14 AKHIA SCOTT
Akhia Scott appeals the removal of his name from the eligible list for Police Officer (S9999H), Newark, on the basis that he lacked the required education.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-15 RICHARD SERRANO
Richard Serrano appeals the removal of his name from the Correction Officer Recruit (S9999H), Department of Corrections eligible list due to an unsatisfactory criminal record and falsification of his employment application.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-16 COLLECTION REPRESENTATIVE (M0169K), NEWARK
The matter of whether Newark should be granted permission not to make an appointment from the June 16, 2008 certification for Collection Representative (M0169K), has been referred to the Civil Service Commission for review.
ACTION: The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.
B-17 PARALEGAL SPECIALIST (M1527J), NEWARK
The appointing authority's failure to dispose of the certification for Paralegal Specialist (M1527J), Newark, while provisionals are serving in the title has been referred to the Civil Service Commission for enforcement.
ACTION: The Civil Service Commission ordered the appointing authority to properly dispose of the outstanding certification and pay compliance costs.
B-18 REGISTRAR OF VITAL STATISTICS (M0737K), HAZLET
Hazlet, represented by Yaacov Brisman, Esq., requests permission not to make an appointment from the January 21, 2009 certification for Registrar of Vital Statistics (M0737K).
ACTION: The Civil Service Commission denied the request for an appointment waiver, ordered the appointing authority to properly dispose of the certification, and assessed compliance costs in the amount of $500.
B-19 SENIOR COMMUNITY RELATIONS SPECIALIST (SPECIAL REEMPLOYMENT LIST AND M1597J), NEWARK
The appointing authority's failure to dispose of the certification for Senior Community Relations Specialist (Special Reemployment List and M1597J), Newark, while a provisional is serving in the title, has been referred to the Civil Service Commission for enforcement.
ACTION: The Civil Service Commission ordered the appointing authority to dispose of the outstanding certification and pay compliance costs.
B-20 VICTOR AVIDOR
Victor Avidor, a former Family Service Specialist Trainee with the Department of Children and Families (DCF), appeals the determination of the Chief of Staff of DCF which found that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey state Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-21 NAZIA MUGHIS-SOHRAWARDY
Nazia Mughis-Sohrawardy, an Assistant Environmental Engineer, Water Resources with the Department of Environmental Protection, appeals the determination of the Assistant Commissioner of Management and Budget, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-22 ANITA SCHANCK
Anita Schanck, an Administrative Assistant 3 with the Department of Labor and Workforce Development (DL&WD), appeals the determination of the Commissioner of DL&WD stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-23 SHAWN VAUGHN
Shawn Vaughn, a Correction Lieutenant with Mid-State Correctional Facility, Department of Corrections, appeals the determination of the Director of the Equal Employment Division, which found that the appellant failed to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.

Mignon Wilson, a Human Resource Consultant 2 with the Civil Service Commission, appeals the determination of the Chair/Chief Executive Officer, which found that the appellant failed to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.

Rosemarie Lavala appeals the decision of the Division of State and Local Operations that the proper classification of her position is Clerk Typist. The appellant seeks a Senior Clerk Typist classification.

Tema Morelli appeals the decision of the Division of State Human Resource Management which found that her position is properly classified as an Administrative Analyst 2.

Richard Rosa, represented by Joseph S. Murphy, Esq., requests additional relief regarding his removal from the Police Officer (S9999H), Paterson, eligible list.

Charles Fitzmaurice, a Police Officer with Lower Township, represented by D. William Subin, Esq., request a hearing regarding his removal, effective May 29, 2009.
ACTION: The Civil Service Commission granted a hearing.
B-29 WILLIE ROWE
Willie Rowe, a Police Officer with the City of East Orange, represented by Matthew D. Areman, Esq., seeks enforcement of the Merit System Board decision rendered on May 7, 2008, granting him mitigated back pay, benefits and seniority.
ACTION: The Civil Service Commission awarded back pay in the amount of $40,271.70.
B-30 RUPESH SHAH
Rupesh Shah, Communications Operator Secured Facilities, East Jersey State Prison, represented by Joseph Tartza, IFPTE representative, appeals a five day suspension issued by the Department of Corrections.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-31 JOINT ORDER OF CONSOLIDATION AND PREDOMINANT INTEREST - CHRISTOPHER M. CARTY AND COUNTY OF ATLANTIC V. FOP LODGE 34
Administrative Law Judge (ALJ) Bruce M. Gorman issued an Order of Consolidation and Predominant Interest in In the Matter of Christopher M. Carty and County of Atlantic v. FOP Lodge 34. Based on the ALJ's Order, the Civil Service Commission and the Public Employment Relations Commission developed a Joint Order. The proposed Order is now submitted for the Commission's adoption.
ACTION: The Civil Service Commission adopted the joint order.
B-32 JOINT ORDER OF CONSOLIDATION AND PREDOMINANT INTEREST - JOSE SANTANA AND IFPTE LOCAL 195 V. STATE OF NEW JERSEY, STOCKTON STATE COLLEGE
Administrative Law Judge (ALJ) Bruce M. Gorman issued an Order of Consolidation and Predominant Interest in In the Matter of Jose Santana and IFPTE Local 195 v. State of New Jersey, Stockton State College. Based on the ALJ's Order, the Civil Service Commission and the Public Employment Relations Commission developed a Joint Order. The proposed Order is now submitted for the Commission's adoption.
ACTION: The Civil Service Commission adopted the joint order.
B-33 BUILDING MAINTENANCE WORKER/SECURITY GUARD (C0178K), PASSAIC COUNTY SHERIFF'S DEPARTMENT
The Passaic County Sheriff's Department requests reconsideration of the decision rendered on April 15, 2009 by the Civil Service Commission in In the Matter of Building Maintenance Worker/Security Guard (C0178K), Passaic County Sheriff's Department, which denied its request for an appointment waiver and ordered it to properly dispose of the certification within 30 days.
ACTION: The Civil Service Commission granted the request for reconsideration and an appointment waiver but assessed selection costs in the amount of $2,048 and prior costs of $1000 for compliance. VOTE: Margaret E. L. Howard (Yes) Flavella Branham (Yes) John Currie (Abstained)
B-34 JOHN DOWD
The Township of Parsippany-Troy Hills, represented by Stephen E. Trimboli, Esq., petitions for reconsideration of that part of the decision rendered on May 27, 2009, which awarded John Dowd back pay from September 29, 2007 through December 28, 2007.
ACTION: The Civil Service Commission granted the request in part and awarded back pay from September 29, 2007 to October 23, 2007.
B-35 DENNIS DZIESIUTA, ET AL.
On behalf of Dennis Dziesiuta, Randall Leszcynski, Ronald Luccarelli, and Michelle Mann, Dudley Burdge of CWA Local 1032 petitions the Civil Service Commission for reconsideration of the decision rendered on July 8, 2009, in which their requests for admittance to the examination for Supervisor Information Technology (PS6403U), Office of Information Technology were denied.
ACTION: The Civil Service Commission dismissed the request as moot.
B-36 JOSHUA GILES
Joshua Giles, a Human Services Assistant with the North Jersey Developmental Center, petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on April 30, 2009, in which the Director of the Division of Merit System Practices and Labor Relations denied his request for a hearing with respect to his 90-day suspension.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-37 JAMIE MCCARRON
Jamie McCarron, a Police Officer with Middletown, represented by Merick H. Limsky, Esq., petitions the Civil Service Commission for reconsideration of the final decision rendered on July 22, 2009, which upheld his removal.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-38 OMNIBUS OPERTOR (M9925J), GLOUCESTER TOWNSHIP
Gloucester Township requests reconsideration of that part of the decision of In the Matter of Omnibus Operator (M9925J), Gloucester Township (CSC, decided April 29, 2009), which assessed compliance costs in the amount of $1,000.
ACTION: The Civil Service Commission granted the request in part and reduced the prior assessment of $1,000 to $500.
B-39 JAMES TARVER
James Tarver, a former Senior Correction Officer with the Central Reception and Assignment Facility, Department of Corrections, represented by Genevieve Murphy-Bradacs, Esq., requests reconsideration of the decision rendered on April 29, 2009, which acknowledged a settlement.
ACTION: The Civil Service Commission denied the request for reconsideration.
B-40 JOEL SMITH
The appeal of Joel Smith, a Senior Youth Worker with the Department of Children and Families, of his resignation not in good standing, effective June 19, 2008, on charges, was heard by Administrative Law Judge W. Todd Miller (ALJ), who rendered his initial decision on June 26, 2009. At its meeting of October 21, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to reverse the resignation not in good standing. The proposed decision is now submitted for the Commission's review.

Robert Baker appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Assistant Supervisor of Resident Living Developmental Disabilities (PS1953K), New Lisbon Developmental Center.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-42 WINNIE CHU, ET AL.
Winnie Chu, Haydar Erdogan, Diane Groth, Karanvir Kaushal, James Kealy, Dorothy Lin, Allan Motter, Greg Neumann, and Joseph Sanguilano appeal the determinations of the Division of Selection Services which found that they were below the minimum requirements in experience for the promotional examination for Section Chief, Environmental Protection (PS2376G), Department of Environmental Protection.

The appeal of Michael Chromey, a Fire Fighter with North Hudson Regional Fire and Rescue, of his 90-day suspension, commencing on November 30, 2006 and his removal, effective April 21, 2008, on charges was before Administrative Law Judge (ALJ) Joseph A. Paone, who rendered his initial decision on May 14, 2009. At its meeting on October 21, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to acknowledge the settlement agreement. The proposed final decision is now submitted for the Commission's review.
