A regular meeting of the Civil Service Commission was held on Tuesday, November 19, 2019, at 10:00 a.m., in Trenton, New Jersey.
PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamula Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.
In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 20, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT
ACTION: The Civil Service Commission acknowledged the settlements.
A-2 ERIC BEAGIN
Eric Beagin, Fire Fighter, City of Paterson, Fire Department, removal effective September 18, 2015, on charges of conduct unbecoming a public employee and other sufficient cause.
Recommendation of the Administrative Law Judge – Reverse the removal.
ACTION: The Civil Service Commission directed that this matter be held over.
SECTION B – MISCELLANEOUS MATTERS
B-1 INSTITUTIONAL ATTENDANT, BILINGUAL IN SPANISH AND ENGLISH – CSC DOCKET NO. 2020-1306
The Division of Agency Services requests the creation of the non-competitive title of Institutional Attendant, Bilingual in Spanish and English.
ACTION: The Civil Service Commission directed that this request be granted.
B-2 S.D. – CSC DOCKET NO. 2019-457
S.D., represented by Bette R. Grayson, Esq., appeals his rejection as a County Correction Officer candidate by Essex County and its request to remove his name from the eligible list for County Correction Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-3 PRISCILLA GUZMAN – CSC DOCKET NO. 2020-482
Priscilla Guzman appeals her removal from the eligible list for Correctional Police Officer (S9999U), Department of Corrections based on an unsatisfactory criminal record and falsification.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-4 VERNON LINCOLN – CSC DOCKET NO. 2020-475
Vernon Lincoln appeals his removal from the eligibility list for Correctional Police Officer (S9999U), Department of Corrections, on the basis of an unsatisfactory background report and falsification of his employment application.

D.W. appeals the removal of her name from the eligible list for Correctional Police Officer, JJC (S9999U), Juvenile Justice Commission, on the basis of an unsatisfactory criminal record.

D.W. appeals the removal of her name from the eligible list for Police Officer (S9999U), Linden, on the basis that she resided outside of the residency scope.

The Department of Environmental Protection requests that the Environmental Specialist 4 (PS3581G) eligible list be revived to allow it to make a regular appointment.

B-10 PATRICIA CIRILLO – CSC DOCKET NO. 2020-1152
Patricia Cirillo appeals the determination of the Division of Agency Services that the proper classification of her position with the Department of the Treasury is Secretarial Assistant 2, Non-Stenographic. The appellant seeks an Administrative Assistant 3 job classification.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-11 DAVID LOSS – CSC DOCKET NO. 2020-1276
David Loss appeals the determination of the Division of Agency Services that the proper classification of his position with the Department of the Treasury is Pensions Benefits Specialist 1. The appellant seeks a Pensions Benefits Specialist 2 job classification.

Hany Sawires appeals the decision of the Division of Agency Services that the proper classification of his position with Hudson County is Truck Driver. The appellant seeks a Maintenance Worker, Grounds job classification.

Edward Kelly appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Assistant Maintenance Superintendent (PC0437A), Burlington County.

David Chasmer (PM2036W), Union City and Michael Kisfalvi (PM2019W), Passaic request reconsideration of the final administrative determination in In the Matter of Mark Moskal, et al., Police Lieutenant (CSC, decided February 20, 2019.
ACTION: The Civil Service Commission directed that these requests be denied.
B-20 M.S. – CSC DOCKET NO. 2018-3749
M.S., a Management Improvement Specialist 1 with the Department of Transportation, appeals the determination of the Executive Director, Division of Civil Rights and Affirmative Action, which found that the appellant failed to support a finding that he had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-21 C.T. – CSC DOCKET NO. 2020-460
C.T., an Administrative Analyst 1 with the Division of Aging Services, appeals the decision of the Department of Human Services’ Chief of Staff which did not substantiate her allegations to support a finding that she had been subject to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-22 JASON RODRIGUEZ – CSC DOCKET NO. 2020-811
Jason Rodriguez, represented by Ben Weather, Esq., appeals the removal of his name from the Fire Fighter (M1863W), Paterson eligible list due to his failure to appear for the Physical Performance Test.
ACTION: The Civil Service Commission directed that this appeal be denied.

G.G.B., represented by Stephen B. Hunter, Esq., appeals his rejection as a Sheriff’s Officer candidate by Middlesex County and its request to remove his name from the eligible list for Sheriff’s Officer (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.

Teresa Baker appeals Mercer County’s request to remove her name from the eligible list for Senior Library Assistant (PC0090U), on the basis that she failed to respond to the certification notice.

J.C. appeals the removal of his name from the Sheriff’s Officer (S9999U), Hudson County eligible list on the basis of an unsatisfactory background report.

B-32 ERIC JACKSON – CSC DOCKET NO. 2019-3328
Eric Jackson appeals the appointing authority’s request to remove his name from the eligible list for Correctional Police Officer (S9988V), Department of Corrections, on the basis of unsatisfactory employment record.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-33 D.R. – CSC DOCKET NO. 2020-1010
D.R., a former Forensic Scientist 3, Division of State Police, Department of Law and Public Safety, requests a waiver of repayment of a salary overpayment, pursuant to N.J.S.A. 11A:3-7, which provides that when an employee has erroneously received a salary overpayment, the Civil Service Commission may waive repayment based on a review of the case.
ACTION: The Civil Service Commission directed that this request be granted.
B-34 T.W. – CSC DOCKET NO. 2019-2611
T.W., a former Clinical Psychiatrist with the Department of Health (DOH), appeals the determination of the Chief of Staff, DOH, which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
