    A regular meeting of the Civil Service Commission was held on Wednesday, December 17, 2014, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Robert E. Brenner and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2013, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

Recommendation of the Administrative Law Judge - Reverse the removal. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Ramona Carter, County Correction Officer, Mercer County, Department of Public Safety, 25 working day suspension and a $152.23 fine on charges of conduct unbecoming a public employee, other sufficient cause, insubordination, falsification and violation of a rule, regulation, policy, procedure, order or administrative decision. 

 

Recommendation of the Administrative Law Judge - Modify the 25 working day suspension and $152.23 fine to a five working day suspension and no fine.

 

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the 25 working day suspension and fine of $152.23 to a 15 working day suspension and a fine of $152.23.

Recommendation of the Administrative Law Judge - Modify the removal to a six month suspension.

 

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the removal.

John Restrepo, Senior Correction Officer, Northern State Prison, Department of Corrections, removal effective February 20, 2014, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee,  other sufficient cause, neglect of duty, loafing, idleness or willful failure to devote attention to tasks which could result in danger to persons or property, falsification and violation of a rule, regulation, policy, procedure, order or administrative decision. 

 

Recommendation of the Administrative Law Judge - Modify the removal to a six month suspension.

 

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the removal.

Mallory Suarez, County Correction Officer, Hudson County, Department of Corrections, 10 working day suspension on charges of incompetency, inefficiency, or failure to perform duties, insubordination, chronic or excessive absenteeism, conduct unbecoming a public employee, neglect of duty, and other sufficient cause.   

 

Recommendation of the Administrative Law Judge - Uphold the 10 working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

John Wiley, Senior Building Maintenance Worker, Rowan University, 15 working day suspension and removal effective October 24, 2012, on charges of neglect of duty and chronic or excessive absenteeism or lateness.

SECTION B - MISCELLANEOUS MATTERS

 

B-1      A. G. - CSC DOCKET NO. 2013-2987

 

A.G., represented by Curtis J. La Forge, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9987M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this matter be referred for an independent evaluation.

 

B-2      B. G. - CSC DOCKET NO. 2014-897

 

B. G., appeals her rejection as a County Correction Officer candidate by Essex County and its request to remove her name from the eligible list for Essex County (C9979M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-3      S. L. - CSC DOCKET NO. 2014-1879

 

S. L., appeals her rejection as a Sheriff's Officer candidate by the Bergen County Sheriff's Office and its request to remove her name from the eligible list for Sheriff's Officer (C9984M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-4      ANNIE BAKER - CSC DOCKET NO. 2015-1286

 

The Superior Court of New Jersey, Appellate Division, has remanded the April 24, 2012 removal of Annie Baker, a Correction Sergeant, Juvenile Justice, with the Juvenile Justice Commission, to the Civil Service Commission.

 

ACTION:       The Civil Service Commission directed that this appeal be remanded to the Office of Administrative Law.

 

B-5      SHENA GRIMES - CSC DOCKET NO. 2014-2876

 

Shena Grimes, a Police Lieutenant with the City of East Orange Police Department, represented by Timothy Smith, Esq., petitions the Civil Service Commission for a stay of her removal, effective April 28, 2014, pending the outcome of her hearing at the Office of Administrative Law.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-6      MERCEDES COLMENARES AND NANCY CATALANO -

CSC DOCKET NOS. 2015-1176 AND 2015-1621

 

The Department of Children and Families, on behalf of Mercedes Colmenares, requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit Ms. Colmenares to receive more than the 260 donated leave days allowed to a recipient.  Additionally, the appointing authority requests that N.J.A.C. 4A:6-1.22(d) be relaxed so as to permit Nancy Catalano to donate more than 30 sick days to Ms. Colmenares.

 

ACTION:       The Civil Service Commission directed that these requests be granted.

 

B-7      STEPHANIE NUTTER - CSC DOCKET NO. 2015-1128

 

The Division of Agency Services, on behalf of the Department of State, requests that Stephanie Nutter's out-of-title experience in the title of Technical Assistant 1, Department of State, be accepted to qualify her for a prospective promotional examination for Personnel Assistant 4.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-8      CHRISTOPHER RIZK - CSC DOCKET NO. 2014-1815

 

Christopher Rizk appeals the decision of the Division of Selection Services which denied him a make-up examination for the Entry-Level Law Enforcement Examination (S9999R).

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-9      SHIKEYA WALKER-BALDWIN - CSC DOCKET NO. 2014-2759

 

Shikeya Walker-Baldwin, represented by Bilal Hill, Esq., appeals the determination of the Division of Classification and Personnel Management which found that the appointing authority had presented a sufficient basis to retain her name on the eligible list for Senior Community Program Specialist (S0090P), Department of Human Services for future certifications only.

 

ACTION:       The Civil Service Commission directed that this appeal be referred to the Office of Administrative Law for a hearing.

 

B-10    YASMINE WHITE - CSC DOCKET NO. 2014-2643

 

Yasmine White appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Correction Officer Recruit (S9988R), Department of Corrections, eligible list on the basis of an unsatisfactory criminal record and falsification of the employment application.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-11    BREANN ANTHONY - CSC DOCKET NO. 2014-2268

 

Breann Anthony appeals the decision of the Division of Classification and Personnel Management which found that her position with the Department of the Treasury is properly classified as Management Assistant.  The appellant seeks an Administrative Assistant 2 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-12    ASSISTANT PURCHASING AGENT (M0046R), SPARTA TOWNSHIP - CSC DOCKET NO. 2014-1711

 

Sparta Township requests permission not to make an appointment from the May 28, 2013 certification for Assistant Purchasing Agent (M0046R).

 

ACTION:       The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-13    CAFETERIA MANAGER (M2106N) & (M0909R), NEWARK SCHOOL DISTRICT - CSC DOCKET NO. 2015-412

 

Newark School District requests permission not to make an appointment from the April 30, 2014 certification for Cafeteria Manager (M2106N) & (M0909R), Newark School District.

 

ACTION:       The Civil Service Commission granted the appointment waiver and directed that no selection costs be presently assessed.

 

B-14    COURT CLERK (M0411P), JERSEY CITY -

CSC DOCKET NO. 2014-1827

 

The Division of Classification and Personnel Management requests that Jersey City be ordered to return the January 30, 2013 certification (OL130156) of the eligible list for Court Clerk (M0411P), Jersey City, for proper disposition.

 

ACTION:       The Civil Service Commission ordered the appointing authority to properly dispose of the certification and pay compliance costs.

 

B-15    CUSTODIAN (M2134N), NEWARK SCHOOL DISTRICT -

CSC DOCKET NO. 2015-410

 

Newark School District requests permission not to make an appointment from the October 2, 2013 certification for Custodian (M2134N), Newark School District.

 

ACTION:       The Civil Service Commission granted the appointment waiver and directed that no selection costs be presently assessed.

 

B-16    SCHOOL NURSE AIDE (M0910R), NEWARK SCHOOL DISTRICT -

CSC DOCKET NO. 2015-413

 

Newark School District requests permission not to make an appointment from the March 24, 2014 certification for School Nurse Aide (M0910R), Newark School District.

 

ACTION:       The Civil Service Commission granted the appointment waiver and directed that no selection costs be presently assessed.

ACTION:       The Civil Service Commission granted the appointment waiver and directed that no selection costs be presently assessed.

ACTION:       The Civil Service Commission granted the appointment waiver and directed that no selection costs be presently assessed.

 

B-19    INTERIM PUBLIC HEALTH RECOVERY DIVISION -

CSC DOCKET NO. 2014-894

 

The Communications Workers of America, represented by Steven P. Weissman, Esq., requests reconsideration of the decision rendered on July 31, 2013, which permitted the Department of Health to make temporary unclassified appointments to various career service titles in order to allow expedited staffing of its interim Public Health Recovery Division.

 

ACTION:       The Civil Service Commission directed that this request for reconsideration be denied.

 

B-20    REBECCA CROKE AND LORIE GUERIERI -

CSC DOCKET NOS. 2014-1461 AND 2014-1462

 

Rebecca Croke, a Senior Management Assistant, and Lorie Guerieri, a Principal Technician, Management Information Systems, request reconsideration of the final administrative decision, rendered on October 2, 2013, which found that there was not a sufficient basis to grant a waiver of the salary overpayment amounts owed by Guerieri and Croke pursuant to N.J.A.C. 4A:3-4.21.

 

ACTION:       The Civil Service Commission directed that this request for reconsideration be denied.

 

B-21    RALPH BITTER, III - CSC DOCKET NO. 2015-296

 

Ralph Bitter, III appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirements for the promotional examination for Manager 4 Environmental Protection, Technical, Scientific, Engineering (PS6834G), Department of Environmental Protection.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-22    LEON HARASYM, ET AL.  -

CSC DOCKET NOS. 2015-794, 2015-931 AND 2015-821

 

Leon Harasym, Michael Jones and Robert Tyciak appeal the determinations of the Division of Selection Services that they did not meet the experience requirements for the promotional examination for Assistant Supervisor, Public Works (PM0633S), Gloucester Township.

 

ACTION:       The Civil Service Commission directed that these appeals be granted.

 

B-23    DAPHNE HOLMAN - CSC DOCKET NO. 2014-2999

 

Daphne Holman appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Rehabilitation Counselor, Mental Health (PS6834K), Department of Human Services.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-24    JEFFREY MEYER - CSC DOCKET NO. 2015-350

 

Jeffrey Meyer appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Manager 4 Environmental Protection, Technical, Scientific, Engineering (PS6834G), Department of Environmental Protection.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-25    JEFFREY PAPIENUK - CSC DOCKET NO. 2013-3390

 

Jeffrey Papienuk appeals the administration of the promotional examination for Police Sergeant (PM5142), Parsippany-Troy Hills.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-26    SOPHIA PROCTOR - CSC DOCKET NO. 2015-465

 

Sophia Proctor appeals the determination of the Division of Selection Services that, per the substitution clause for education, she was below the minimum requirements in experience for the promotional examination for Senior Income Maintenance Technician (PS8415K), Division of Medical Assistance.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-27    JOSE SANCHEZ - CSC DOCKET NO. 2015-1070

 

Jose Sanchez appeals the determination of the Division of Selection Services that he did not meet the experience requirement for the promotional examination for Sewer Repair Supervisor (PM0741S), Trenton.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

B-29    NOLAN COX - CSC DOCKET NO. 2013-116

 

The appeal of Nolan Cox, a former County Correction Officer with Mercer County, of his 45 working day suspension, on charges, was heard by Administrative Law Judge Ronald W. Reba (ALJ), who rendered his initial decision on October 22, 2014.  At its meeting on December 3, 2014, the Civil Service Commission did not adopt the ALJ's recommendation to modify the 45 working day suspension to a five working day suspension.  Rather, the Commission upheld the 45 working day suspension.  The proposed final decision is now submitted for the Commission's review.

 

            ACTION:       The Civil Service Commission adopted the final decision.

 

B-30    ROBERT MAGELLA, ET AL. - CSC DOCKET NO. 2015-1343

 

The Borough of Carteret, represented by Leslie G. London, Esq., on behalf of Robert Magella, Samuel Goddess, Richard Bonner, Peter Ziemba, and Mark Hruska requests a waiver of the promotional examination for Fire Captain.  Additionally, the appointing authority requests that the petitioners receive retroactive permanent dates of appointment to Fire Captain effective July 9, 2012.

 

ACTION:       The Civil Service Commission directed that this request be granted in part.

 

B-31    OSAROBO AKINGBALA - CSC DOCKET NO. 2015-686

 

Osarobo Akingbala, a former Cottage Training Technician with Hunterdon Developmental Center, Department of Human Services, represented by John F. McDonnell, Esq., petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on September 11, 2014, in which the Director of the Division of Appeals and Regulatory Affairs denied her request for a hearing with respect to her removal effective May 13, 2014.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-32      JANIS E. FEUCHAK - CSC DOCKET NO. 2014-2827

 

Janis E. Feuchak appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the promotional examination for Fiscal Analyst (PM0059S), Jersey City.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-33      TELINA HAIRSTON - CSC DOCKET NO. 2015-1098

 

Telina Hairston, a Police Officer with the City of East Orange, represented by Steven J. Kaflowitz, Esq., petitions the Civil Service Commission for interim relief of her disciplinary proceedings.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-34      VERA T. KALISH - CSC DOCKET NO. 2015-1211

 

Vera T. Kalish appeals the determination of the former Division of Selection Services that she did not meet the experience requirement for the promotional examination for Personnel Officer (PM0711S), Middle Township. 

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-35      DELORES VANDEGRIFT - CSC DOCKET NO. 2015-288

 

Delores Vandegrift appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the open competitive examination for Public Health Nurse (M0220S), Hamilton.  

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-36      MIGUEL A. VARGAS - CSC DOCKET NO. 2014-2552

 

Miguel A. Vargas appeals the determination of the Division of Selection Services which found that he did not meet the requirements for the promotional examination for Senior Motor Vehicle Operator, Elderly and Handicapped Persons (PC2280R), Morris County.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-37    TIMOTHY LONDON AND EDMUND JOHNSON -

            CSC DOCKET NOS. 2012-2817 AND 2012-1462

 

The appeals of Timothy London and Edmund Johnson, Water Meter Readers, of their six month suspensions from the City of Trenton, on charges, was heard by Administrative Law Judge Edward J. Delanoy, Jr. (ALJ), who rendered his initial decision on September 26, 2014.  At its meeting on December 3, 2014, the Civil Service Commission (Commission) did not accept the recommendation to modify the six month suspensions to three month suspensions.  Rather, the Commission modified the six month suspensions to 30 working day suspensions.  The proposed decision is now submitted for the Commission's review. 

 

ACTION:       The Civil Service Commission adopted the decision.

 

B-38    RAMKUMARIE RAMCHARAN - CSC DOCKET NO. 2013-1645

 

The appeal of Ramkumarie Ramcharan, a Clerk 2 with the Jersey City Public School District (District), of her return to her previously held title of Clerk 1 at the end of her working test period effective November 28, 2012, was heard by Administrative Law Judge Mumtaz Bari-Brown, (ALJ), who rendered her initial decision on October 6, 2014.  At its meeting on December 3, 2014, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to grant the appellant a new working test period.  Rather, the Commission upheld the return to the previously held title of Clerk 1.  The proposed final decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the final decision.

B-39    FY 2015 SALARY REGULATIONS COMPENDIUM

 

The FY 2015 Salary Regulations Compendium includes the following:  Section 1 - Aligned Salary Regulation, Deputy Attorneys General, Non-Aligned Salary Regulation, Management Salary Regulation, Exempt Salary Regulation, and Attachments A and B; Section 2 - Emergency Conditions Salary Regulation; Section 3 - Special Incentive Salary Programs; Section 4 - Miscellaneous Salary Regulation; Appendix A, including Employee Relations Group List, Salary Schedules, Single Rates and Trainee Rates; Appendix B, including State Benefits Programs; and Index.  The Compendium has been approved by Robert M. Czech, Chair/CEO, Civil Service Commission, and Charlene M. Holzbaur, Director, Office of Management and Budget. 

 

ACTION:       The Civil Service Commission recorded the regulations.
