SUBJECT: Change in State Classification Plan

DEPARTMENT OF HUMAN SERVICES

The Department of Human Services has requested that one (1) title
be allocated to the unclassified service for use by the New
Jersey Developmental Disabilities Council and the State Office of
Disabilities Services in order to employ the developmentally
disabled.

The New Jersey Developmental Disabilities Council is responsible,
through change and advocacy, for promoting the development of a
comprehensive system of services, designed to assist the disabled
and their families to achieve independence and integration in
the community. While allocated to the Department of Human
Services, N.J.S.A. 30:1AA-1 provides that the Developmental
Disabilities Council be independent of any control or
supervision by the Department of Human Services. Because of its
autonomy, the Council is considered a separate layoff unit, and
individuals employed by the Council are not impacted by any
departmental reduction-in-force. The Council must maintain
compliance with the Developmental Disabilities Assistance and
Bill of Rights Act, federal legislation which limits the length
of time for certain projects and encourages employment of the
disabled or their family members.

The Office of Disabilities Services, created in October 1997 and
strongly supported by Governor Whitman, was established to
provide cross-disabilities information and referral services to
all New Jersey residents. It is requested that the State Office
of Disabilities Services also be permitted to use the same
unclassified title, pursuant to its mission of providing
employment opportunities to the disabled.

Since neither agency currently has the ability to select disabled
individuals for particular projects or to encourage employment of
people with disabilities, the creation of this unclassified
title would enable maximum diversity in employing persons with
disabilities, eliminate any impact from a departmental reduction-
in-force, and allow the Department of Human Services to maintain
compliance with the Developmental Assistance and Bill of Rights
Act.

Appointment to this title will require notification of the
appointee's specific disability and the approval of the Division
of Human Resource Management.

With your approval, the following title may be relegated to the
unclassified service in accordance with N.J.S.A. 11A:3-4(l).
