Notice of this Meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on March 29, 1999, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All other actions were by unanimous vote unless otherwise specified.

The Department of Labor is requesting the following job function be reallocated to the Senior Executive Service.

Justification --Position Number # 939776
The incumbent of this position will serve as the Assistant Director for Office Services. In that capacity the incumbent will manage a staff responsible for all postal operations, printing functions, microfilm and archiving all records and files. The office has responsibility for making recommendations for potential savings in all areas of printing and postal operations. In the past fiscal year, the postal unit realized a savings of $3,000,000 as a result of bar coding and resorting capability. The office is able to produce professional publications for the various operating divisions within the Department at a cost substantially less than if obtained from outside sources.
The position is currently vacant. It will be posted following Merit System Board approval of its reallocation.
The position is the third of three Assistant Director, Facilities Management positions which the Department of Labor has proposed for reallocation into the Senior Executive Service. The reallocation of two Assistant Director, Facilities Management positions was approved by the Merit System Board at its February 9, 1999 meeting with an effective date of February 13, 1999. One of the positions was approved to function as Assistant Director of Procurement. The second was approved to function as Assistant Director for Building Management. The Reallocation of all three positions had initially been requested by the Department of Labor at the same time; however, it decided to request a temporary hold on this third position until it was vacated.

James Marsh, represented by Joel C. Seltzer, Esq., requests enforcement of that part of the Merit System Board decision rendered on September 16, 1997, granting him back pay and attorney fees.

B-31 ASUTOSH CHAKRABARTI
The appeal of Asutosh Chakrabarti, Chief Actuary, Department of Banking and Insurance, concerning his layoff for reasons of economy, was heard by Administrative Law Judge Jeff S. Masin (ALJ), who rendered his initial decision on remand from the Merit System Board (Board) dismissing the appeal. At its meeting on February 10, 1998, the Board accepted the ALJ's recommendation. Thereafter, the appellant filed an appeal in the Appellate Division, Superior Court. The Appellate Division remanded the matter to the Board.
ACTION: The Merit System Board directed that this matter be held over.
B-32 DEAN FRASIER
The appeal of Dean Frasier, a Laborer with the State Operated School District of the City of Newark, of his removal effective May 7, 1997 on charges, and of his resignation not in good standing, was heard by Administrative Law Judge (ALJ) Edith Klinger, who rendered her initial decision on January 19, 1999. The Merit System Board (Board), at its meeting on March 23, 1999, affirmed the ALJ's recommendation to modify the removal to a 15-day suspension and to resign appellant from his position, not in good standing, effective May 7, 1997. The proposed final decision is now submitted for the Board's final review.
ACTION: The Merit System Board adopted the final decision.

The appeal of Robert Lacaillade, Police Sergeant, Police Department, City of Millville, of his removal, effective March 13, 1992 on charges, was heard by Administrative Law Edgar R. Holmes (ALJ), who rendered his initial decision on February 10, 1999. The Merit System Board, at its meeting on March 23, 1999, adopted the ALJ's recommendation to uphold the removal. The proposed final decision is now submitted for the Board's final review.

The appeal of John Prior, Fire Fighter, West Orange Fire Department, concerning his 182-day suspension beginning December 2, 1997, on charges, was heard by Administrative Law Judge Thomas E. Clancy (ALJ), who rendered his initial decision on February 1, 1999. The Merit System Board (Board), at its meeting on March 9, 1999, adopted the ALJ's recommendation to uphold the 182-day suspension. The proposed final decision is now submitted for the Board's final review.

B-35 GARY VAN NORMAN
The appeal of Gary Van Norman, a Senior Correction Officer with Garden State Reception and Youth Correctional Facility, Department of Corrections, of his 15-day suspension on charges, was heard by Administrative Law Judge John R. Tassini (ALJ), who rendered his initial decision on November 24, 1998. At its meeting of March 23, 1999, the Board adopted the recommendation of the ALJ to vacate the suspension. The proposed final decision is now submitted for the Board's final review.

The appeal of Janine Watts, a Senior Parole Officer with the Bureau of Parole, Department of Corrections, of her 15-day suspension, on charges, was heard by Administrative Law Judge Arnold Samuels (ALJ), who rendered his initial decision on January 22, 1999. The Merit System Board, at its meeting on March 9, 1999, affirmed the ALJ's recommendation upholding the suspension. The proposed final decision is now submitted for the Board's final review.

The appeal of William Brennan, a Fire Fighter with the Teaneck Fire Department, suspended for 63 days, 21 days, two days and five days on charges, was heard by Administrative Law Judge Maria Mancini LaFiandra (ALJ), who rendered her initial decision on January 20, 1999, dismissing the 21-day suspension, upholding the two-day suspension, modifying the 63-day suspension to a 10-day suspension and modifying the five-day suspension to a two-day suspension. At its meeting on March 23, 1999, the Board affirmed the ALJ's initial decision. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.

The appeal of Thelma Cole, a Hospital Charge Attendant with Buttonwood Hospital, Burlington County, concerning her resignation not in good standing, on charges, was heard by Administrative Law Judge Anthony T. Bruno, who rendered his initial decision on February 17, 1999, recommending the reversal of the appellant's resignation not in good standing. At its meeting on March 23, 1999, the Board ordered that this matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.

The appeal of Deborah Cregger, a Senior Clerk Typist with the Salem County Board of Social Services, of her removal effective December 11, 1997, on charges, was heard by Administrative Law Judge Lillard E. Law (ALJ), who rendered his initial decision on February 5, 1999 upholding the removal. At its meeting on March 23, 1999, the Board affirmed the ALJ's recommendation. The proposed final decision is now submitted for the Board's review.

The appeal of Linda Scannavino, a Clerk Typist with the Department of Public Works, Township of North Bergen, of her removal effective January 6, 1995, on charges, was heard by Administrative Law Judge Arnold Samuels (ALJ), who rendered his initial decision on December 22, 1998, modifying the removal to a resignation in good standing. The Merit System Board, at its meeting on March 23, 1999, modified the ALJ's recommendation to a resignation not in good standing. The final decision in this matter is now submitted for the Board's review.
