A regular meeting of the Merit System Board was held on
Monday, July 19, 1999, in Trenton, New Jersey.

PRESENT: Presiding Merit System Board Member, Margaret
E. L. Howard; Merit System Board Members, Judith Shaw and
Alan Dexter Bowman; Elizabeth Laufer, Deputy Attorney
General; Henry Maurer, Director, Elizabeth A. Napolitano,
Sybil Janowitch, and Charles Spano, Division of Merit System
Practices and Labor Relations.

In accordance with L.1975, c.231, Margaret E. L.
Howard, presiding Board Member, opened the meeting with the
following statement:

Notice of this meeting was filed with the Secretary of
State and sent to the Trentonian, Trenton Times, Courier-
Post and Star Ledger on July 12, 1999 and posted at the
Department of Personnel, 3 Station Plaza, Trenton, New
Jersey.

All other actions were by unanimous vote unless
otherwise specified.

DEPARTMENT OF PERSONNEL

The Department of Personnel, Office of External Affairs, has
requested Position #054045 be reallocated from the Career
Service to the Senior Executive Service.

Position #054045 reports to the Assistant Commissioner,
Office of External Affairs and is responsible for
identifying and analyzing trends in the composition and
competence of State and local government agency workforces,
forecasts, and plans relating to workforces. This position
is responsible for coordinating and developing the State
Government-wide Workforce Plan, which has substantial
influence on policy decisions. A review of the assigned job
functions has been conducted and the position meets the
standards established for inclusion in the Senior Executive
Service.

A-2 WALTER BERESFORD

Walter Beresford, Battalion Fire Chief, Fire
Department, Township of Belleville, suspension for six
months and demotion to position of Fire Captain
effective March 20, 1997, on charges of neglect of
duty, incompetency, inefficiency or failure to perform
duties, conduct indicating that a member has little or
no regard for his responsibility toward members of the
department, knowingly and willfully making a false
entry in any departmental report or record, failure to
comply with the Chief's directive, and conduct
subversive of good order and the discipline of the
department.

Recommendation of the Administrative Law Judge - Uphold
the suspension and demotion.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.

A-3 CHARLOTTE CHILDS

Charlotte Childs, Practical Nurse, Greystone Park
Psychiatric Hospital, Department of Human Services,
suspension for 120 days, on charges of falsification.

Recommendation of the Administrative Law Judge -
Reverse the suspension.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.

A-4 MICHAEL CIPRIANO

Michael Cipriano, Correction Officer Recruit, Albert C.
Wagner Youth Correctional Facility, release at the end
of the Working Test Period effective February 16, 1998.

Recommendation of the Administrative Law Judge -
Reverse the Release at the end of Working Test Period
and afford a new shortened Working Test Period.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge and specified that the length of the
new Working Test Period be six months..

Colleen M. Facendo, Senior Clerk Typist, Monmouth
County Prosecutor's Office, removal effective July 8,
1998, on charges of inability to perform duties.

Maurice Hayes, Senior Correction Officer, Department of
Law and Public Safety, Juvenile Justice Commission,
removal effective March 19, 1998, on charges of chronic
or excessive absenteeism or lateness and unexcused
lateness of 15 minutes or more but less than 30
minutes.

Recommendation of the Administrative Law Judge - Uphold
the removal.

ACTION: The Merit System Board directed
that this matter be held over.

A-7 JOANNE LATHAN

Joanne Lathan, Probation Officer, Administrative Office
of the Courts, removal effective July 15, 1996, and
resignation not in good standing effective July 15,
1996, on charges of unauthorized absences and conduct
unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold
the resignation not in good standing.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.

A-8 ROGER MOLLETT

Roger Mollett, Human Services Technician, Greystone
Park Psychiatric Hospital, removal effective January
16, 1996, on charges of threatening and intimidating a
fellow employee.

Recommendation of the Administrative Law Judge -
Reverse the removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.

A-9 DAMON REID

Damon Reid, Senior Correction Officer, Garden State
Youth Correctional Facility, Department of Corrections,
removal effective May 22, 1998, on charges of conduct
unbecoming an employee, improper or unauthorized
contact with an inmate, undue familiarity with inmates,
parolees, their families, or friends, and performance,
neglect of duty, loafing, idleness, or willful failure
to devote attention to tasks which could result in
danger to persons or property.

Recommendation of the Administrative Law Judge - Uphold
the removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.

A-10 MAURICE WOODY

Maurice Woody, Building Maintenance Worker, Newark
Housing Authority (NHA), removal effective May 23,
1997, on charges of conduct unbecoming a public
employee and theft of property.

Recommendation of the Administrative Law Judge - Uphold
the removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.


A motion was made and seconded that the open session be
recessed and that, pursuant to Section 12(b) of the
Open Public Meetings Act, the Merit System Board
entered into Executive Session for the purpose of legal
advice on the matter of A-11 Curtis Chiumento, A-13
Edward Wise, A-14 Joseph Zayak and A-16 William
Carroll. The Board subsequently reconvened the public
meeting.

A-11 CURTIS CHIUMENTO

Curtis Chiumento, Sheriff's Sergeant, Sheriff's Office
B Camden County, written reprimand, on charges of
neglect of duty. The Merit System Board at its meeting
of July 7, 1999, directed that this matter be held
over.

Recommendation of the Administrative Law Judge - Delete
the charge of locking the door to the substation
entrance and uphold the written reprimand, based on the
charge of allowing officers to change into civilian
clothes prior to the end of their shift.

ACTION: The Merit System Board dismissed the appeal.

A-12 MICHAEL SMITH

Michael Smith, Human Services Technician, Trenton
Psychiatric Hospital, Department of Human Services,
removal effective January 22, 1998, on charges of
physical abuse of a patient. The Merit System Board at
its meeting of June 8, 1999, considered this matter and
directed that it be held over.

Recommendation of the Administrative Law Judge - Uphold
the removal.

ACTION: The Merit System Board modified the
removal to a three month supsension on a
charge of inappropriate contact with a
patient.

A-13 EDWARD WISE

Edward Wise, Code Enforcement Officer, Administration
Department B Atlantic City, removal effective January
18, 1994, on charges of incompetency, inefficiency or
failure to perform duties, insubordination and conduct
unbecoming a public employee. The Merit System Board
at its meeting June 8, 1999, directed that this matter
be held over.

Recommendation of the Administrative Law Judge - Uphold
the removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge but granted back pay from January 18,
1994, to April 30, 1999.

A-14 JOSEPH ZAYAK

Joseph Zayak, Police Lieutenant, Township of
Woodbridge, removal effective April 2, 1997, on charges
of statutory forfeiture. The Merit System Board at its
meeting July 7, 1999, directed that this matter be held
over.

Recommendation of the Administrative Law Judge - Uphold
the removal.

ACTION: The Merit System Board directed
that this matter be remanded to the Office of
Administrative Law.

A-15 ROBERT GREDONE

Robert Gredone, Supervisor, Regional Food Services,
Bayside State Prison, Department of Corrections,
removal effective May 9, 1997, on charges including
conduct unbecoming a public employee, neglect of duty
and falsification. The Merit System Board at its
meeting of June 21, 1999, directed that this matter be
held over.

Recommendation of the Administrative Law Judge -
Reverse the removal.

ACTION: The Merit System Board modified the
removal to a three month suspension.



A-16 WILLIAM CARROLL

William Carroll, Sheriff's Officer, Morris County,
removal effective December 17, 1997, on charges of
conduct unbecoming a public employee, insubordination
and conduct prejudicial to the efficiency of the good
name and reputation of the office. The Merit System
Board at its meeting of June 8, 1999, directed that
this matter be held over.

Recommendation of the Administrative Law Judge -
Reverse the removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law
Judge.

SECTION B B MISCELLANEOUS MATTERS

B-1 CHRISTIAN SEUGLING

Christian Seugling represented by Anthony M. Arbore,
Esq., appeals his rejection as a County Correction
Officer candidate by the County of Morris and its
request to remove his name from the eligible list for
County Correction Officer on the basis of psychological
unfitness to perform effectively the duties of the
position.

ACTION: The Merit System Board directed
that this appeal be denied.

B-2 ANN STASI

Ann Stasi, a Supervisor of Nursing Services at Trenton
Psychiatric Hospital, Department of Human Services,
appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed
that this appeal be granted.

B-3 CHRISTOPHER DEMURO

Christopher DeMuro, represented by Marc N. Isenberg,
Esq., appeals the decision of Human Resource
Information Services which found that the appointing
authority had presented a sufficient basis to remove
his name from the eligible list for Police Officer
(M3394Y), City of Newark due to his failure to meet the
announced residency requirement.

ACTION: The Merit System Board directed
that this appeal be granted.

B-4 RAYMOND SAN MARTIN

Raymond SanMartin appeals the decision of Human
Resource Information Systems which found that the
Department of Corrections had presented a sufficient
basis to remove his name from the Correction Officer
Recruit (S9998U) eligible list due to an unsatisfactory
criminal record.

ACTION: The Merit System Board directed
that this appeal be denied.

B-5 ROBERT R. VOCATURO

Robert R. Vocaturo, represented by Robert J. DeGroot,
Esq., appeals the decision of Human Resource
Information Services which found that the appointing
authority had presented a sufficient basis to remove
his name from the eligible list for Police Officer
(M3394X), City of Newark based on a driving record
which relates adversely to the position sought.

ACTION: The Merit System Board directed
that this appeal be denied.

B-6 DENNIS HLAVATY

Dennis Hlavaty, a Head Nurse with the Hagedorn Gero-
Psychiatric Hospital, Department of Human Services,
appeals the determination of the Assistant Commissioner
for Human Resources stating that there was no probable
cause that he had been discriminated against based on
his sex.

ACTION: The Merit System Board directed
that this appeal be denied.

B-7 CARRIE N. WYNDER

Carrie N. Wynder, an Executive Secretarial Assistant
with the Division of Planning and Development,
Department of Personnel (CSC), appeals the
determination of the Commissioner of CSC stating that
appellant failed to present sufficient evidence to
support a finding of probable cause that she had been
discriminated against on the basis of her sex or race.

ACTION: The Merit System Board directed
that this appeal be denied.

B-8 WAYNE HUNDEMANN

Wayne Hundemann, a Police Officer with the the Borough
of Carteret, represented by John Charles Allen, Esq.,
asks the Merit System Board to reinstate him to his
former position after a determination by the Police and
Firemen's Retirement System that he is no longer
disabled and is fit for duty.

ACTION: The Merit System Board directed
that this appeal be granted.

B-9 ROBERT TEREBETSKI

Robert Terebetski, a Police Sergeant with the Borough
of Carteret, represented by John Charles Allen, Esq.,
asks the Merit System Board to reinstate him to his
former position after a determination by the Police and
Firemen's Retirement System that he is no longer
disabled and is fit for duty.

ACTION: The Merit System Board directed
that this appeal be granted.

B-10 DAVID EISENHAUER

David Eisenhauer, a Police Sergeant with the Township
of North Bergen, represented by John A. Young, Jr.,
Esq., petitions the Merit System Board for interim
relief of his removal, effective April 20, 1999,
pending the outcome of his hearing at the Office of
Administrative Law.

ACTION: The Merit System Board directed
that this appeal be denied.

B-11 MICHAEL FERRANTE

Michael Ferrante, an Environmental Health Specialist
with Burlington County, represented by William B.
Hildebrand, Esq., petitions the Merit System Board for
reconsideration of the final decision rendered on April
20, 1999, which upheld his removal effective December
3, 1997 on charges.

ACTION: The Merit System Board directed
that this appeal be denied.

B-12 ERNEST LUCAS

The Department of Human Services requests
reconsideration of the Office of Administrative Law
(OAL) initial decision, dated September 9, 1998, in
which the Administrative Law Judge (ALJ) recommended
that the layoff of Ernest Lucas be modified. Based on
the Board's failure to act within prescribed time
limits, pursuant to N.J.S.A. 52:14B-10, the initial
decision was deemed adopted as final.

ACTION: The Merit System Board granted the
request for reconsideration but denied the
appeal of layoff rights.

B-13 RICHARD VOGEL, SR.

Peter Zwiebach, Esq., on behalf of Cohen, Weiss and
Simon, Counsellors at Law, requests reconsideration of
those portions of the final administrative decision, In
the Matter of Richard Vogel, Sr. (MSB, decided March 9,
1999), which state that Mr. Vogel was represented by
Earl R. Pfeffer, Esq., of the above-stated law firm,
and that Mr. Vogel received erroneous advice from his
union representative. This matter was held over from
the June 21, 1999 Merit System Board meeting.

ACTION: The Merit System Board granted the request in
part.

B-14 WILLIAM DONNELLY

William Donnelly, formerly a Fire Fighter with Ventnor
City, requests reinstatement to his position with back
pay and benefits.

ACTION: The Merit System Board directed
that this appeal be granted.

B-15 JOHN GOODMAN

John Goodman, a Senior Parole Officer, Department of
Corrections, represented by Paul L. Kleinbaum, Esq.,
requests Merit System Board (Board) review of his
expenditures for health insurance coverage that were
awarded pursuant to the Board Orders of July 8, 1997,
April 15, 1997 and December 3, 1996.

ACTION: The Merit System Board granted the request.

B-16 WALTER OLIVANT, ET AL.

The appeals of three Department of Environmental
Protection (DEP) employees, Walter Olivant, a Principal
Environmental Engineer with the Division of Water
Quality, Thomas Quigley, a Hazardous Site Mitigation
Specialist with the Division of Responsible Party Site
Remediation, and Richard DeWan, a Section Chief with
the Division of Water Quality, concerning their 65-day
suspensions on charges, were heard by Administrative
Law Judge (ALJ) Anthony T. Bruno, who rendered his
initial decision on April 12, 1999. The Merit System
Board, at its meeting on July 7, 1999, did not adopt
the ALJ's recommendation to modify Olivant's penalty to
a 90-day suspension, and to modify the penalties for
Quigley and DeWan to 30-day suspensions. Rather, the
Board concluded that the appropriate penalty for
Olivant was a 30-day suspension, and the appropriate
penalties for Quigley and DeWan were 15-day
suspensions. The proposed final decision in this
matter is now submitted for the Board's review and
approval.

ACTION: The Merit System Board directed
that this matter be held over.

B-17 ALFRED VAN SLYCK

The appeal of Alfred Van Slyck, a Heavy Equipment
Operator with the Village of Ridgewood, of his removal,
effective April 18, 1997 on charges, was heard by
Administrative Law Judge Margaret M. Hayden (ALJ), who
rendered her initial decision on February 16, 1999
reversing the removal. At its meeting on July 7, 1999,
the Board affirmed the ALJ's recommendation that the
appellant's removal be reversed. However, the Board
felt it necessary to address the exceptions and cross-
exceptions filed by the parties. The proposed final
decision in this matter is now submitted for the
Board's review and approval.

ACTION: The Merit System Board directed
that this matter be held over.

B-18 SHERYL L. ALLEN, ET AL.

Sheryl L. Allen, Laurie Acevedo, Surei Cubo and Ann
Marie Dell=Arte Imbriacco appeal the determination of
the Division of Selection Services, which found that
they did not meet the experience requirement for the
open competitive examination for Investigator Probation
(SO323W).

ACTION: The Merit System Board directed
that this appeal be denied.

B-19 ROBERT G. ARTER

Robert G. Arter appeals the determination of the
Division of Selection Services, which found that he did
not meet the experience requirement for the promotional
examination for Bridge Construction Inspector/Road
Inspector (PC0021W), Middlesex County.

ACTION: The Merit System Board directed
that this appeal be denied.

B-20 KAREN ASHE, ET AL.

Karen Ashe, Gail Horne, and Mae Jones appeal the
determinations of the Division of Selection Services
which found that they did not meet the education and
experience requirements for the promotional examination
for Field Service Supervisor 2, Medical

Health and Senior Services.

ACTION: The Merit System Board directed
that these appeals be denied.

Thomas G. Beers appeals the determination of the
Division of Selection Services which found that he did
not meet the experience requirement for the promotional
examination for Municipal Recycling Coordinator
(PM0397W), Hamilton Township.

ACTION: The Merit System Board directed
that this appeal be granted.

Nancy Ceperley appeals the determination of the
Division of Selection Services which found that she did
not meet the requirements for the open competitive
examination for Historic Preservation Specialist
(S6142W), Department of Environmental Protection.

ACTION: The Merit System Board directed
that this appeal be granted.

Gilbert L. Harris appeals the determination of the
Division of Selection Services which found that the
appellant did not meet the requirements for the
promotional examination for Social Caseworker
(PM1311W), Newark.

ACTION: The Merit System Board directed

Marie Mogol and Theodore Mogol appeal the

Winthrop Merritt, a Personnel Management Analyst I, New
Jersey Department of Personnel, claims that his special
reemployment rights were abrogated following his
demotion during layoffs effective October 3, 1992.

ACTION: The Merit System Board directed
that this appeal be denied.

The Merit System Board Minutes for the meeting of July
7, 1999 are submitted for adoption.

ACTION: The Merit System Board directed
that this matter be held over.

B-41 DENISE COLE

Denise Cole appeals the determination of the Division
of Selection Services which found that appellant's
application for the Family Service Specialist Trainee
(S6086O) examination was properly scored.

ACTION: The Merit System Board directed
that this appeal be denied.
