The Highlands Council is legislatively charged with reviewing proposed projects throughout the Highlands Region, including both the Preservation Area and the Planning Area, for consistency with the goals, requirements, and provisions of the Highlands RMP. The Highlands Council issues consistency determinations that provide a detailed analysis of each project on a case-by-case basis.

Procedures for Highlands Redevelopment Area Designation

The Highlands Council developed procedures in late 2008 implementing provisions of the Highlands Act regarding the designation of Highlands Redevelopment Areas in the Preservation Area. Such designations are necessary for any project that requires a Highlands Preservation Area Approval under N.J.A.C. 7:38 (the NJDEP Preservation Area Rules) with a waiver of provisions regarding a brownfield or a site with existing impervious cover of 70 percent or more. The Highlands Council procedures establish the process and substantive requirements for Council designation of Highlands Redevelopment Areas. The Highlands Council anticipates development of analogous procedures for the Planning Area in 2010 for use as part of the Plan Conformance process.

Highlands Preservation Area Exemptions

While Preservation Area exemptions are issued by the NJDEP in accordance with N.J.A.C. 7:38, the jurisdiction is shared and the Highlands Council collaborates with the Department on these reviews. Accordingly please be advised that the NJDEP requires that applicants supply proof that the Highlands Council was sent a copy of the entire Preservation Area exemption application and supporting documentation submitted to the Department.

Highlands Planning Area Exemptions

The Highlands Council issues exemptions in the Planning Area in accordance with the Highlands Act and the Highlands Regional Master Plan at Objective 7F1d. Any person that seeks confirmation of eligibility for an exemption under the Highlands Act for a Planning Area development project or activity in the Highlands Region may obtain a Highlands Exemption Determination letter from the Highlands Council. Information requirements for a Highlands Exemption Determination application to the Highlands Council are based upon the provisions of the Highlands Act as well as NJDEP’s application requirements for exemptions codified in N.J.A.C. 7:38, subchapters 2 and 9. All persons seeking a Highlands Exemption Determination shall complete and file a Highlands Exemption Determination (Planning Area) Application Form, and provide the supporting documentation listed in the form.

WQMP Consistency Review Documents

The Highlands Council has prepared a Highlands RMP Consistency Determination Review Template for use in determining whether and to what extent Water Quality Management Plan amendments are consistent with the RMP. This template is used by Highlands Council staff, and is provided here to assist potential applicants in understanding the basis for reviews. In addition, the Highlands Council has prepared a listing of submittal requirements for WQMP amendments that it reviews. This document is advisory at this time, but compliance with the submittal listing will assist the Highlands Council with its review of such amendments.
