    A regular meeting of the Civil Service Commission was held on Wednesday, February 26, 2014, in Trenton, New Jersey.

 

            PRESENT: Robert E. Brenner, Presiding Member, Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2013, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENTS

 

ACTION:       The Civil Service Commission acknowledged the settlements.

 

A-2      MICHAEL BIAZZO, ET AL. (CONSOLIDATED)

 

Michael Biazzo, Douglas Foster, William Hertline, III, Vito Moles and Michael Killion, Police Officers, Township of Pennsauken, Police Department, 30 working day suspensions and Michael Hutnan, Police Sergeant, 10 working day suspension on charges of conduct unbecoming an officer and neglect of duty.

 

Recommendation of the Administrative Law Judge - Uphold the 30 working day (equaling 240 hours) suspensions for Officers' Biazzo, Killion, Moles, Foster and Hertline and uphold the 10 working day (equaling 80 hours) suspension for Hutnan.

           

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3      NICHOLAS CASTILLO (REMAND)

 

Nicholas Castillo, Sheriff's Officer, Monmouth County, removal effective May 24, 2010, on charges of conduct unbecoming a public employee, discrimination that affects equal employment opportunity, other sufficient cause and violation of rules and regulations.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4      TAHISHA COLLINS (CONSOLIDATED)

 

Tahisha Collins, Senior Correction Officer, Juvenile Justice Commission, removal effective April 26, 2013 on charges of insubordination and other sufficient cause and 90 working day suspension on charges of incompetency, inefficiency or failure to perform duties and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal and uphold the 90 working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5      LUIS CRUZ

 

Luis Cruz, County Correction Officer, Middlesex County Adult Correction Center, Department of Corrections, removal effective December 21, 2011, on charges of conduct unbecoming a public employee. 

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6      JAMES KIELWASSER (CONSOLIDATED)

 

James Kielwasser, Animal Control Officer/Animal Cruelty Investigator, Township of Union, Department of Health, two removals effective May 5, 2011 and October 20, 2011, on charges of failure to perform duties, inability to perform duties and conduct unbecoming a public employee. 

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

            ACTION:       The Civil Service Commission modified the recommendation of the Administrative Law Judge and imposed a 15 working day suspension.

 

A-7      DENNIS J. NAGY

 

Dennis J. Nagy, Public Health Investigator, Middlesex County, 10 working day suspension on charges of conduct unbecoming a public employee, other sufficient cause and violation of the Middlesex County Personnel Policy on Sexual Harassment and Discrimination. 

 

Recommendation of the Administrative Law Judge - Uphold the 10 working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8      CAROL PAYTON

 

Carol Payton, Licensed Practical Nurse, Hudson County, Department of Corrections, removal effective July 2, 2012, on charges of inability to perform duties.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

            ACTION:       The Civil Service Commission modified the recommendation of the Administrative Law Judge and imposed a resignation in good standing.

 

A-9      MICHAEL RIOS (REMAND)

 

Michael Rios, Sheriff's Officer, Passaic County, Sheriff's Department, removal effective July 3, 2012, on charges of conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Deitra Sydnor, County Correction Officer, Camden County Correctional Facility, Department of Corrections, 6 month suspension on charges of conduct unbecoming a public employee, neglect of duty, other sufficient cause and violation of Camden County Correctional Facility rules. 

 

Recommendation of the Administrative Law Judge - Uphold the 6 month suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-11    JAMES WALTERS

 

James Walters, County Correction Officer, Monmouth County, indefinite suspension pending criminal charges and removal effective January 20, 2011, on charges of other sufficient cause, conduct unbecoming a public employee and violation of rules, regulation, policy and procedures.

   

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-13    MARCIA DAVIS (REMAND)

 

Marcia Davis, Communications Operator Secured Facilities, Mountainview Youth Correctional Facility, Department of Corrections, resignation not in good standing effective May 8, 2012, on charge of abandonment of job as a result of being absent from work as scheduled without permission for five consecutive work days.

 

Recommendation of the Administrative Law Judge - Reverse the resignation not in good standing.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-14    EDWINA WASHINGTON

 

Edwina Washington, Senior Correction Officer, East Jersey State Prison, Department of Corrections, removal effective June 14, 2013, on charges of conduct unbecoming a public employee, other sufficient cause, improper or unauthorized contact with an inmate, undue familiarity with inmates, parolees, their families or friends, inappropriate physical contact or mistreatment of an inmate, patient, client, resident or employee, threatening intimidating harassing, coercing or interfering with fellow employees on State Property, violation of a rule, regulation, policy, procedure, order, or administrative decision. 

 

Recommendation of the Administrative Law Judge - Uphold the removal.

           

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

SECTION B - MISCELLANEOUS MATTERS

 

B-1      MEHMET DUSHAJ

 

Mehmet Dushaj appeals his rejection as a Police Officer candidate by the Hoboken Police Department and its request to remove his name from the eligible list for Police Officer (S9999M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-2      FRANK RODRIGUEZ, JR.

 

Frank Rodriguez, Jr., appeals his rejection as a Fire Fighter candidate by Hoboken and its request to remove his name from the eligible list for Fire Fighter (M2537M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-3      RANDOLPH RODRIGUEZ

 

Randolph Rodriguez, represented by Marissa Ruggiero, Esq., appeals his rejection as a Police Officer candidate by Union City and its request to remove his name from the eligible list for Police Officer (S9999M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-4      DEREK TURNURE

 

Derek Turnure appeals his rejection as a Parole Officer Recruit candidate by the State Parole Board and its request to remove his name from the eligible list for Parole Officer Recruit (S0738M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-5      THOMAS J. HUNT 

 

The Borough of Wildwood Crest, represented by Ryan T. Karrer, Esq., requests that the Civil Service Commission settle the record of In the Matter of Thomas Hunt, Police Sergeant, Borough of Wildwood Crest Police Department, Docket No. A-2845-12T2, now pending before the Superior Court, Appellate Division.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-6      FRANK E. FRIEND, III

 

Frank E. Friend, III, a former Fire Lieutenant, represented by John F. Pilles, Jr., Esq., and Winslow Township Fire District #1, represented by Richard M. Braslow, Esq., petition the Civil Service Commission for acknowledgment of a clarified settlement agreement reached by the parties.

 

ACTION:       The Civil Service Commission acknowledged the settlement agreement as clarified.

 

B-7      MELANIE DOLOBACS AND SHARON DIGGINS

 

Melanie Dolobacs and Sharon Diggins appeal the determination of their provisional appointment dates to the title of Investigator 2, Taxation as September 22, 2012.  The appellants seek a May 24, 2012 appointment date.

 

ACTION:       The Civil Service Commission directed that these appeals be granted in part.

 

B-8      LINDA EVANS, ET AL.

 

The Newark School District requests retroactive dates of appointment for Linda Evans, Wali Thomas, and Winston Weeks to the title of Custodian.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-9      QUEENIQUEKA PARISH

 

The Division of Selection Services, on behalf of the Department of the Treasury, requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Queeniqueka Parish to be provisionally appointed, pending promotional examination procedures, to the competitive title of Investment Technician.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-10    WILLIAM SANNINO

 

William Sannino, represented by Catherine M. Elston, Esq., appeals the Department of Human Services' failure to provisionally appoint him to the position of Quality Assurance Specialist, Health Services.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-11    CHARLES R. WELLS, III

 

Charles R. Wells, III appeals the bypass of his name on the eligible list for Police Officer (S9999M), Borough of Highlands, on the basis of his age.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-12    JESSICA MCDUFFIE

 

The Division of State Police, Department of Law and Public Safety, requests that the Civil Service Commission authorize the promotion of Jessica McDuffie from her non-competitive title to a competitive title pursuant to N.J.A.C. 4A:4-1.1(c)2.  It also requests that the Commission accept McDuffie's out-of-title work experience for a prospective promotional examination for the title of Principal Clerk Typist.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-13    MICHAEL SHERIDAN

 

Union County requests that Michael Sheridan, a Mason's Helper, be transferred from the Department of Engineering and Public Works Facilities to the Sheriff's Department and appointed to the title of Parking Attendant.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-14    PATRICK BONACCI

 

Patrick Bonacci, represented by Marcia J. Tapia, Esq., appeals the determination of the Division of Classification and Personnel Management upholding the removal of his name from the eligible list for Police Officer (S9999M), Union City, on the basis of an unsatisfactory driving record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-15    JOSHUA BRIGGS

 

Joshua Briggs, represented by Andrea Hemschoot, Esq., appeals his non-appointment from the December 21, 2011 certification of the Fire Fighter (M2508M), City of Bridgeton, eligible list and his removal from the February 11, 2013 certification of the eligible list due to an unsatisfactory driving record.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-16    KEVIN CALLENDER

 

Kevin Callender, represented by James P. Swift, Esq., appeals the determination of the Division of Classification and Personnel Management upholding the removal of his name from the eligible list for Fire Fighter (M2501M), Atlantic City, on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-17    THE ESTATE OF JESS COHEN

 

The Estate of Jess Cohen, a former Motor Vehicle Operator, Elderly & Handicapped, with Monmouth County, Department of Transportation, represented by Elizabeth Cohen, requests that the Civil Service Commission reinstate Mr. Cohen's appeal of his removal effective March 3, 2011, which was dismissed based on his failure to appear at his scheduled hearing.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-18    BRAUN HURLEY

 

Braun Hurley, represented by James P. Swift, Esq., appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Police Officer (S9999M), Atlantic City eligible list on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-19    TAMMY MEYERS

 

Tammy Meyers appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Correction Officer Recruit (S9987M), Department of Corrections, eligible list on the basis of falsification of her employment application and failure to complete pre-employment processing.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-20    ALEXIS MILLER

 

Alexis Miller, a Family Service Worker with Essex County, appeals the decision of the Division of Classification and Personnel Management which upheld the removal of her name from the Family Service Supervisor (PC0530N), Essex County eligible list due to an unsatisfactory employment record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-21    NELSON MOLINAREZ

 

Nelson Molinarez, represented by Michael L. Prigoff, Esq., appeals the determination of the Division of Classification and Personnel Management upholding the removal of his name from the eligible list for Fire Fighter (M2542M), Jersey City, on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-22    AJA SCOTT

 

Aja Scott appeals the decision of the Division of Classification and Personnel Management which upheld the removal of her name from the County Correction Officer (C9973M), Monmouth County, eligible list due to an unsatisfactory background report.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part.

 

B-23    LAMAR WILLIAMS

 

Lamar Williams appeals the decision of the Division of Classification and Personnel Management which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Correction Officer Recruit (S9987M), Department of Corrections, due to an unsatisfactory driving record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-24    AARON CLEMENTS

 

Aaron Clements requests a make-up examination for Correction Officer Recruit (S9988R).

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-25    VIRGILIO FERNANDEZ

 

Virgilio Fernandez requests that he be permitted to submit a late application for the open competitive examination for Parole Officer Recruit (S0566R), Statewide.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-26    JAKUB NOWAK

 

Jakub Nowak appeals the determination of the Division of Selection Services denying his request for a make-up examination for the open-competitive examination for Word Processing Specialist 2 (S0112R), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-27    WILLIAM PEPPARD

 

William Peppard appeals the denial of his request for a makeup examination for County Police Sergeant (PC5095N), Bergen County.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-28    MANFRED AMISSAH

 

Manfred Amissah appeals the decision of the Division of Classification and Personnel Management that the proper classification of his position with the Department of Environmental Protection is Environmental Engineer 2.  The appellant seeks an Environmental Engineer 3 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-29    PRISCILLA BADIANE

 

Priscilla Badiane appeals the determination of the Division of Classification and Personnel Management that her position with the Department of the Treasury is properly classified as a Pensions Benefits Specialist 1.  The appellant seeks a Supervising Pensions Benefits Specialist job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-30    BERNADINE BROZENA

 

Bernadine Brozena appeals the determination of the Division of Classification and Personnel Management that her position with the Department of the Treasury is properly classified as a Pensions Benefits Specialist 1.  The appellant seeks a Supervising Pensions Benefits Specialist job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Janet Caiola appeals the decision of the Division of Classification and Personnel Management, which found that her position with the Department of the Treasury is properly classified as Software Development Specialist 2.   The appellant seeks a Software Development Specialist 3 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-32    CYNTHIA DEY

 

Cynthia Dey appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Department of Transportation is Geographic Information Systems Specialist 1.  The appellant seeks a Manager 1, Information Processing job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-33    JUNE FOSTER

 

June Foster appeals the determination of the Division of Classification and Personnel Management that her position with the Department of the Treasury is properly classified as an Auditor 2, Taxation.  The appellant seeks an Auditor 1, Taxation job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-34    CRISTINA HEREDIA

 

Cristina Heredia appeals the decision of the Division of Classification and Personnel Management, which found that her position with the Department of Education is properly classified as Senior Management Assistant.  The appellant seeks an Administrative Analyst 2, Data Processing job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-35    STEPHEN KLEIN

 

Stephen Klein appeals the determination of the Division of Classification and Personnel Management that his position with the Department of the Treasury is properly classified as an Auditor 2, Taxation.  The appellant seeks an Auditor 1, Taxation job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-36    JOAN PEREZ-GONZALEZ

 

Joan Perez-Gonzalez appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Department of the Treasury is Auditor 3, Taxation.  The appellant seeks an Auditor 2, Taxation job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-37    TIMOTHY STEWART

 

Timothy Stewart appeals the decision of the Division of Classification and Personnel Management that the proper classification of his position with the Department of Transportation is Geographic Information Systems Specialist 2.  The appellant seeks a Geographic Information Systems Specialist 1 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-38    SUZANNE TOBOLSKI

 

Suzanne Tobolski appeals the decision of the Division of Classification and Personnel Management that her position with the Office of the Sheriff, Cumberland County is properly classified as Clerk 2.  The appellant seeks either an Execution Clerk, Keyboarding Clerk 1 or Keyboarding Clerk 2 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-39    KIMBERLY WOODSON

 

Kimberly Woodson appeals the decision of the Division of Classification and Personnel Management which found that her position with the Department of Community Affairs is properly classified as Principal Clerk.  The appellant seeks a Technical Assistant 3, Community Affairs job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied and the positions of four Technical Assistants 3, Community Affairs in the unit undergo classification reviews.

 

B-40    A. R. 

 

A. R., a Cottage Training Technician with the Department of Human Services, appeals the determination of the Assistant Commissioner, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-41    J. S. 

 

J. S., a Standards and Procedures Technician 3 with the Department of Law and Public Safety, appeals the decision of the Director of the Office of Equal Employment Opportunity, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-42    K. K. AND L. C. 

 

K. K., an Assistant Vice President of Labor Relations with Rowan University and L. C., a Locksmith with the University, appeal the decision of the Office of Equity and Diversity which partially substantiated that K. K., violated the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Policy).

 

ACTION:       The Civil Service Commission directed that K. K.'s appeal be granted and L. C.'s appeal be denied.

 

B-43    L. C. 

 

L. C., a Locksmith with Rowan University, appeals the decision of the Office of Equity and Diversity, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-44    S. H. 

 

S. H., a Family Service Specialist 2 with the Department of Children and Families, appeals the determination of the Office of Equal Employment Opportunity and Affirmative Action (EEO/AA), which found that the appellant failed to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Policy).

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-45    CLERK 3 (M0752P), CITY OF PATERSON

 

The City of Paterson requests permission not to make an appointment from the April 15, 2013 certification for Clerk 3 (M0752P).

 

ACTION:       The Civil Service Commission directed that the request for appointment waiver be granted and no selection costs presently be assessed.

 

B-46    PERSONNEL ASSISTANT (M0891P), PARSIPPANY-TROY HILLS PUBLIC LIBRARY

 

Parsippany-Troy Hills Public Library requests permission not to make an appointment from the February 11, 2013 certification for Personnel Assistant (M0891P).

 

ACTION:       The Civil Service Commission directed that the request for appointment waiver be granted and assessed selection costs in the amount of $2,048.

 

B-47    KIM BLACKMON

 

Kim Blackmon, represented by Christopher Young, Staff Representative, Local 1040, Communications Workers of America, petitions the Civil Service Commission for reconsideration of its decision rendered on August 15, 2013 in which the Commission determined that Ms. Blackmon was ineligible for the Rehabilitation Counselor, Mental Health (S0805P) open competitive examination.

B-84    ADMINISTRATIVE ANALYST, DISASTER RECOVERY 

 

The Division of Classification and Personnel Management, on behalf of the Department of Law and Public Safety, Division of State Police, Bureau of Recovery, recommends creation of the Administrative Analyst, Disaster Recovery title series in the competitive division of the career service and requests the reallocation of the title series to the noncompetitive division of the career service on an interim basis in order to facilitate the initial hiring of staff.

 

ACTION:       The Civil Service Commission directed that these requests be granted.

 

B-85    SHERIFF'S OFFICER (S9999M), ESSEX COUNTY SHERIFF'S OFFICE 

 

The Division of Classification and Personnel Management requests that the Civil Service Commission order the Essex County Sheriff's Office to return the June 27, 2012 certification (OL120865) of the eligible list for Sheriff's Officer (S9999M) for proper disposition.

 

ACTION:       The Civil Service Commission directed that this request be granted.

Thomas Van Gorder, a former part-time Fire Official with Vernon Township, represented by Bruce D. Leder, Esq., requests relief from the Civil Service Commission regarding his layoff effective October 14, 2011.

 

ACTION:       The Civil Service Commission directed that this request be granted in part.

 

B-87    TYRONE MAJOR

 

Tyrone Major, a Police Officer with the City of Newark, represented by Anthony J. Fusco, Jr., Esq., petitions the Civil Service Commission for enforcement of the settlement agreement acknowledged by the Commission at its meeting on September 4, 2013.

 

ACTION:       The Civil Service Commission directed that this request be granted and Newark be assessed compliance costs.

The Director, Division of Selection Services, on behalf of the Department of the Treasury, requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Genae Jennings to be provisionally appointed, pending promotional examination procedures, to the competitive title of Technical Assistant 3.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-89    NATALIE MINTCHWARNER

 

Natalie Mintchwarner appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Department of Banking and Insurance is Investigator 2.  The appellant seeks a Principal Investigator, Insurance Enforcement or Investigator 1 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-90    BRIAN HUNTLEY

 

The appeal of Brian Huntley, a Heavy Equipment Operator with the City of Asbury Park, of his removal, effective August 10, 2012, on charges, was heard by Administrative Law Judge Edward J. Delanoy, Jr., (ALJ), who rendered his initial decision on December 6, 2013.  At its meeting on February 12, 2014, the Civil Service Commission adopted the ALJ's recommendation to modify the appellant's removal to a six-month suspension contingent upon his passing a return to work drug test.  However, the Commission did not adopt the ALJ's recommendation for an award of back pay.  The proposed final decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the final decision.
