    A regular meeting of the Civil Service Commission was held on Wednesday, July 29, 2015, in Trenton, New Jersey.

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

David Anthony, Management Specialist, Hudson County Department of the Sheriff, removal effective November 26, 2014, on charges of insubordination, conduct unbecoming a public employee, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the removal to a 90 working day suspension.

 

ACTION:       The Civil Service Commission directed that this matter be held over.

A-4      LISA CORLEY

 

Lisa Corley, County Correction Officer, Camden County Correctional Facility, removal effective February 7, 2014, on charges of conduct unbecoming a public employee, neglect of duty, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5      CHRISTOPHER HIGGINS (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at a future meeting.)

 

Christopher Higgins, Repairer, Vineland Developmental Center, Department of Human Services, removal effective January 10, 2014, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission directed that this matter be held over for a summary of the testimony.

 

A-6      JOHN W. IRBY   

John W. Irby, County Correction Officer, Burlington County, Department of Corrections, removal effective January 10, 2014, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7      NANCY LAGROTTERIA  

Nancy LaGrotteria, Human Services Specialist 2, Ocean County, Board of Social Servcies, 60 working day suspension, on charges of conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Modify the 60 working day suspension to a 10 working day suspension.

 

ACTION:       The Civil Service Commission modified the 60 working day suspension to a 30 working day suspension.

 

A-8      SCOTT LEUSNER

 

Scott Leusner, Police Sergeant, City of Camden, Police Department, fine equal to a 10 working day suspension, on charges of incompetency or inefficiency to perform duties.

 

Recommendation of the Administrative Law Judge - Uphold the fine.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-9      KESTER TANNIS  

Kester Tannis, Human Services Assistant, Hunterdon Developmental Center, Department of Human Services, removal effective May 23, 2014, on charges of physical or mental contact or mistreatment of a client, failure to perform duties, conduct unbecoming a public employee, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission directed that this matter be remanded to the Office of Administrative Law.

 

 

SECTION B - MISCELLANEOUS MATTERS

 

B-1      GERMAN LIRANZO - CSC DOCKET NO. 2015-813

 

German Liranzo appeals the Morris County Sheriff's Office's request for the removal of his name from the eligible list for County Correction Officer (S9999R), Morris County Sheriff, due to his failure to meet the residency requirement.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-2      ULIA RABBOH - CSC DOCKET NO. 2015-2875

 

Ulia Rabboh appeals the decision of the Division of Agency Services, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Police Officer (S9999R), City of Paterson eligible list on the basis of an unsatisfactory driving record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-3      VINCENT TRIPPI - CSC DOCKET NO. 2015-2394

 

Vincent Trippi, represented by Jacqueline Ramirez, Esq., appeals the determination of the Division of Agency Services upholding the removal of his name from the eligible list for Police Office (S9999R), Weehawken, on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-4      GREGORY ZALNIERATIS - CSC DOCKET NO. 2015-1908

 

Gregory Zalnieratis appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Correction Officer Recruit (S9988R), Department of Corrections eligible list on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-5      JORDAN ZEIGLER - CSC DOCKET NO. 2015-1003

 

Jordan Zeigler, represented by Sharon King, Esq., appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for County Correction Officer (C9982M), Camden County, on the basis that he falsified his pre-employment application

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-6      JOHN FAZZOLARI AND ROBERT MENDIBLES - CSC DOCKET NO. 2015-356

 

John Fazzolari and Robert Mendibles, represented by Daniel M. Rosenberg, Esq., appeal the bypass of their names on the County Correction Sergeant (PC5133M), Cumberland County eligible list.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-7      PERSONNEL ASSISTANT (C0392S), OCEAN COUNTY - CSC DOCKET NO. 2015-2438

 

The appointing authority requests permission not to make an appointment from the certification for Personnel Assistant (C0392S), Ocean County.

 

ACTION:       The Civil Service Commission granted the appointment waiver and assessed partial selection costs in the amount of $1,024.

The appointing authority requests permission not to make an appointment from the certification for Research Assistant, Criminal Information (C0144S), Bergen County Prosecutor's Office.

 

ACTION:       The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-9      LORI GALLON - CSC DOCKET NO.  2015-2653

 

Lori Gallon appeals her date of appointment from the special reemployment list for Assistant Administrative Analyst, City of Trenton, and seeks additional relief.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part.

 

B-10    SETH HACKMAN - CSC DOCKET NO. 2015-2748

 

The Department of Environmental Protection requests that Seth Hackman's out-of-title work experience in the title Geographic Information Systems Specialist 2 be accepted to qualify him for a prospective promotional examination for Administrative Analyst 1, Fiscal Management.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-11    HUSSEIN AHMED AND MICHAEL SILVESTRI - CSC DOCKET NO. 2015-3237

 

Hussein Ahmed and Michael Silvestri appeal the determinations of the Division of Agency Services that they were below the minimum requirements in experience for the promotional examination for Property Management Services Specialist 2 (PS9801U), Department of the Treasury

 

ACTION:       The Civil Service Commission directed that these appeals be granted.

 

B-12    KIMBERLY DORTCH, ET AL. - CSC DOCKET NO. 2015-2674

 

Kimberly Dortch, Emily Gear, Barbara Hasen, Michael Lenehan and Tashia Owens-Muhammad appeal the decisions of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Supervisor Child Care Quality Assurance Inspections (PS1509K), Department of Children and Families.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-13    SHENEEQUA MING - CSC DOCKET NO. 2015-3092

 

Sheneequa Ming appeals the determination of the Division of Agency Services that she was below the minimum requirements in experience for the promotional examination for Senior Clerk (PS9475F), Department of Education.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-14    KELLY TOBOLSKI - CSC DOCKET NO. 2015-3150

 

Kelly Tobolski requests a makeup examination for the promotional examination for Data Entry Operator 2 (PS7139U), Department of the Treasury.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-15    ANNA DELANEY - CSC DOCKET NO. 2015-1255

 

Anna Delaney, an employee with the Department of Law and Public Safety (LPS), represented by Gaye Palmer Executive Vice Present, CWA Local 1033, appeals the calculation of her salary upon her appointment to the title of Forensic Scientist 1, LPS, effective March 23, 2013.  She also requests a retroactive date of appointment to December 15, 2012.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-16    PATRICIA DIXON - CSC DOCKET NO. 2015-2258

 

Patricia Dixon appeals the decision of the Division of Agency Services, which found that her position with the Department of the Treasury is properly classified as a Field Representative, Local Property Tax.  The appellant seeks a Senior Field Representative, Local Property Tax job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-17    KALLIOPI KOSTIS - CSC DOCKET NO. 2015-2259

 

Kalliopi Kostis appeals the decision of the Division of Agency Services, which found that her position with the Department of the Treasury is properly classified as a Field Representative, Local Property Tax.  The appellant seeks a Senior Field Representative, Local Property Tax job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-18    LAWRENCE GIOCONDA - CSC DOCKET NO. 2015-3174

 

Lawrence Gioconda, represented by David B. Beckett, Esq., requests reconsideration of In the Matter of Todd Kelly, et al. (CSC, decided May 6, 2015), which rescinded a third appointment from the January 13, 2014 certification of the Police Lieutenant (PM5107M), City of Elizabeth, eligible list.  Additionally, the petitioner requests a stay of the decision. 

 

ACTION:       The Civil Service Commission directed that the request for reconsideration be denied, and the request for a stay be dismissed as moot.

 

B-19    S.B. - CSC DOCKET NO. 2015-224

 

S.B., a Senior Parole Counselor, State Parole Board, appeals the determination of the Executive Director, which found that S.B. failed to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace (State Police).  S.B. also requests reconsideration of the final administrative decision rendered on July 16, 2014, finding that he failed to support a finding that he had been subjected to a violation of the State Policy and his reassignment was proper.

 

ACTION:       The Civil Service Commission directed that the appeal and request for reconsideration be denied.

B-20    LILLIAN SERINO - CSC DOCKET NO.  2015-2193

 

Irene Netzel, on behalf of Lilian Serino, a former Technical Assistant Construction Official with Berkeley Township, Department of Administrative Services, petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on February 3, 2015, in which the Director of the Division of Appeals and Regulatory Affairs denied her request for a hearing with respect to her resignation not in good standing effective September 24, 2014.

 

ACTION:       The Civil Service Commission directed that the request for reconsideration be granted.

 

B-21    J.L. - CSC DOCKET NO. 2016-433

 

The Department of Children and Families, on behalf of J.L., requests the relaxation of the provision of N.J.A.C. 4A:6-1.22 so as to permit J.L., who is participating in the donated leave program, to received more than the 260 donated leave days allowed to a recipient.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-22    J.B. - CSC DOCKET NO. 2015-1258

 

J.B., an Assistant Regional Forester with the Department of Environmental Protection appeals the decision of the Chief of Staff, which found that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Work Place.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-23    M.F. - CSC DOCKET NO. 2015-2995

 

M.F., a Senior Correction Officer with the Department of Corrections, appeals the decision of the Commissioner of the DOC, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-24    OSAROBO AKINGBALA - CSC DOCKET NO. 2015-686

 

Osarobo Akingbala, a former Cottage Training Technician with the Hunterdon Developmental Center, represented by John F. McDonnell, Esq., requests that the Civil Service Commission reinstate her appeal of her removal, which was dismissed based on her failure to appear at a scheduled conference.

 

ACTION:       The Civil Service Commission directed that this request be granted.

            Middletown Township requests permission not to make an appointment from the February 20, 2015 certification for Municipal Court Administrator (M0583S).

 

ACTION:       The Civil Service Commission directed that this matter be held over.

 

B-30    BROOKE TUMILLO - CSC DOCKET NO. 2015-3253

 

            The Department of Law and Public Safety requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Brooke Tumillo to be provisionally appointed, pending promotional examination procedures, to the competitive title of Personnel Aide 2.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-31    SIGFREDO MERCADO - CSC DOCKET NO. 2015-2958

 

            Sigfredo Mercado appeals the decision of the Division of Agency Services, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Police's Officer (S9999R), City of Paterson eligible list on the basis of an unsatisfactory background.

            The Division of Agency Services requests that the Software Development Specialist 1, Software Development Specialist 2, Network Administrator 1, and Network Administrator 2 titles be approved for job banding in the Office of Information Technology in accordance with N.J.A.C. 4A:3-3.2A(b).

 

ACTION:       The Civil Service Commission directed that this request be granted.

 OIT Job Banding Proposal

 

The Civil Service Commission (Commission) today approved implementation of job banding for certain levels within two titles in the Office of Information Technology (OIT), Software Development Specialist and Network Administrator. The request was made by OIT following a comprehensive administrative analysis and succession planning report in December 2014, supplemented by a survey of OIT employees.

 

Job banding is a competency-based human resource process that groups similar job titles together to form career bands, within which employees may advance subject to fulfillment of explicitly stated criteria. It provides a more effective option for appointing authorities to ensure that employee competency is properly assessed.  The job banding advancement process is a more valid and merit-based tool to move employees forward than the education and experience (E and E) method and written exams currently used for these titles.

 

Job banding has been successfully employed by the State Judiciary for over 15 years, as authorized by the Commission under State statute. Programs undertaken in selected titles at the Civil Service Commission and the Office of Management and Budget (OMB) since banding rules were adopted in late 2013 and implemented the following year further underscore the efficacy, fairness, and common-sense approach of job banding.

 

In the case of the band levels under consideration here, the rapidly evolving state of network and software systems underscores the need for more flexible advancement tools. Researching, writing, and deploying examinations is a time-consuming process that can be overtaken by technological developments. Supervisors "on the ground" are in a far better position to anticipate in a timely manner coming changes, determine the necessary skills and competencies to meet them, and identify staff members whose past performance and current knowledge best reflect those assets.

 

The successful history of job banding in Judiciary, the Civil Service Commission, and OMB; the quantifiable and technical nature of the work performed by the bands in question; and the fact that a majority of the OIT employees who responded to the survey indicated support for updating Civil Service selection and advancement procedures (including creating a more performance-based process) reinforce the Commission's judgment that OIT's proposal will serve the interests of the agency, its employees, and the taxpayers of the State of New Jersey.

 

 

B-33    JIMMY RIOS - CSC DOCKET NO. 2015-960

 

            Jimmy Rios appeals his score on the video portion of the promotional examination for Police Sergeant (PM5107M), Newark.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-34    BHANUPRASAD P. RANGANATHARAO -CSC DOCKET NO. 2015-2527

 

            Bhanuprasad P. Ranganatharao appeals the determination of the Division of Agency Services, which found that he did not meet the requirements for the promotional examination for Software Development Specialist 2 (PS9488G), Department of Environmental Protection.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-35    ANNIE BAKER - CSC DOCKET NO. 2015-1286

 

            The appeal of Annie Baker, a Correction Sergeant, Juvenile Justice, with the Juvenile Justice Commission, Department of Law and Public Safety, of her removal, effective April 24, 2012, on charges, was heard by Administrative Law Judge Robert Bingham II (ALJ), who rendered his initial decision on June 5, 2015.  At its meeting on July 15, 2015, the Civil Service Commission (Commission) adopted the ALJ's recommendation to reverse the appellant's removal.  However, the Commission did not limit the appellant's reinstatement to one year.  The proposed decision is now submitted for the Commission's review.

 

            ACTION:       The Civil Service Commission adopted the decision.

 

B-36    TAQIYYAH DAVIDSON - CSC DOCKET NO. 2015-2874

 

            The appeal of Taqiyyah Davidson, a Juvenile Detention Officer with the Essex County Department of Civilian Services, of her removal, effective February 18, 2014, on charges, was heard by Administrative Law Judge Leland McGee, who rendered his initial decision on June 22 2015.  At its meeting on July 15, 2015, the Civil Service Commission did not accept the recommendation to reduce the removal to a 240 day suspension.  Rather, the Commission upheld the removal.  The proposed final decision is now submitted for the Commission's review.

 

            ACTION:       The Civil Service Commission adopted the final decision.

 

B-37    UMAR SALAHUDDIN - CSC DOCKET NO. 2016-427

 

            The Appellant Division, Superior Court of New Jersey, reversed and remanded the determination of the Civil Service Commission In the Matter of Umar Salahuddin, et al., Atlantic City (CSC, decided September 18, 2013) which denied the appellant's appeal that his demotion in lieu of layoff to the title of Community Service Aide was not in good faith.

 

ACTION:       The Civil Service Commission directed that the layoff be reversed.

 

B-38    C.W. - CSC DOCKET NO. 2016-583

 

            The Department of Agriculture, on behalf of James Murphy, requests the relaxation of the provisions of N.J.A.C. 4A:6.1.22 so as to permit him to donate more than 30 sick days to C.W., an employee of the Department of Agriculture, who is participating in the donated leave program.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-39    J.H. - CSC DOCKET NO.  2016-442

 

            The Department of Human Services, on behalf of J.H., requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit J.H.'s retroactive participation in the donated leave program.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-40    RICHARD MCGOWAN - CSC DOCKET NO. 2015-3274

 

            Richard McGowan, a Police Captain with the City of East Orange, represented by Wolodymyr P. Tyshchenko, Esq., petitions the Civil Service Commission for a stay of his removal, effective June 10, 2015, pending the outcome of his hearing at the Office of Administrative Law. 

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-41    PROGRAM DEVELOPMENT SPECIALIST, YOUTH SERVICESCSC DOCKET NO. 2015-3138

 

            Union County requests permission not to make an appointment from the December 22, 2014 certification for Program Development Specialist, Youth Services (C0674S).

 

ACTION:       The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-42    THOMASINA DELEON-JESTUS - CSC DOCKET NO. 2015-2783

 

            Thomasina DeLeon-Jestus, requests additional relief regarding her removal from the Human Services Technician (PS7399K), Ancora Psychiatric Hospital eligible list.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-43    NATALIE OGONOWSKI - CSC DOCKET NO. 2015-91

 

            Natalie Ogonowski, Police Officer, Hillside, represented by Daniel J. Zirrith, Esq., appeals her non-appointment from the Police Sergeant (PM2677L), Hillside eligible list.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-44    ROBERT RONCERAY - CSC DOCKET NO. 2016-438

 

The Township of Millburn petitions the Civil Service Commission for revival of the Police Lieutenant, Millburn, eligible list, in order to effectuate the terms of the Order from the Superior Court of New Jersey, Essex County, Law Division.

 

ACTION:       The Civil Service Commission directed to revive the eligible list for Police Lieutenant (PM2534K), Millburn.

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-46    LINDA CUMMINS - CSC DOCKET NO. 2016-145

 

Linda Cummins appeals the determination of the Division of Agency Services, which found that, per the substitution clause for education, she was below the minimum requirements in experience for the promotional examination for Management Specialist (PC0188T), Sussex County, Prosecutor's Office.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-47    JUSTIN VOIGTSBERGER - CSC DOCKET NO. 2015-3197

 

Justin Voigtsberger, a former County Correction Officer with Camden County, requests reconsideration of the decision rendered on June 3, 2015, which upheld his release at the end of the working test period.

 

ACTION:       The Civil Service Commission directed that the request for reconsideration be denied.

 

There being no further business before the Civil Service Commission, the meeting was adjourned to convene on Wednesday, August 19, 2015, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
