A RESOLUTION authorizing the Executive Director to issue the guidance dated April 2002, entitled "Guidelines for Developing an Integrated Resource Plan Under the Delaware River Basin Commission Southeastern Pennsylvania Ground Water Protected Area Regulations."
WHEREAS, in October 1980 the Commission adopted Resolution No. 80-18 creating the Southeastern Pennsylvania Ground Water Protected Area and in part establishing ground water withdrawal limits for all delineated basins and subbasins within the protected area; and
WHEREAS, Resolution No. 98-1, adopted by the Commission in January 1998, amended the Southeastern Pennsylvania Ground Water Protected Area Regulations by adding subsection 6.I.2, setting forth conditions under which the Commission may revise a subbasin ground water withdrawal limit; and
WHEREAS, subsection 6.I.2 provides in part that the Commission may revise withdrawal limits upon application by the appropriate government bodies to correspond with more stringent requirements set forth in integrated resource plans adopted and implemented by all municipalities within a subbasin and incorporated into each municipality's comprehensive plan; and
WHEREAS, subsection 6.I.2 further provides that an integrated resource plan shall be developed according to sound principles of hydrology and identifies nine minimum components of such a plan; and
WHEREAS, Resolution No. 98-21, adopted by the Commission on December 9, 1998, established the Water Management Advisory Committee, composed of representatives of each of the DRBC member states, the U.S. Army Corps of Engineers, U.S. EPA and U.S. Geological Survey, the cities of New York and Philadelphia, a county water agency, the Delaware Valley Water Resources Association, an industry, a water utility, the agricultural sector, a civic organization, an environmental organization, academia, and the recreation and fisheries sectors, and assigned the committee, among other charges, the tasks of advising the Commission and staff on protocols for development and review of integrated resource plans capable of satisfying the protected area regulations; and
WHEREAS, the Water Management Advisory Committee, in consultation with the DRBC staff, pursued its charge diligently, and on September 25, 2001 recommended by unanimous vote that the "Guidelines for Developing an Integrated Resource Plan Under the Delaware River Basin Commission Southeastern Pennsylvania Ground Water Protected Area Regulations" be adopted as DRBC guidance; and
WHEREAS, the Commission held a duly noticed public hearing on April 3, 2002 regarding this proposed resolution and has received and considered testimony from water users and other interested parties; now therefore,
BE IT RESOLVED by the Delaware River Basin Commission:
1. The Commission authorizes the Executive Director to issue the guidance dated April 2002, entitled "Guidelines for Developing an Integrated Resource Plan Under the Delaware River Basin Commission Southeastern Pennsylvania Ground Water Protected Area Regulations" for use by DRBC staff in reviewing and municipalities in preparing integrated resource plans; and
2. The guidelines set forth in this document are not a regulation, and the DRBC does not intend to give them that weight or deference. The DRBC reserves the discretion to deviate from these guidelines if circumstances warrant.
