    A regular meeting of the Civil Service Commission was held on Wednesday, October 1, 2014, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Robert E. Brenner, Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2013, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

Recommendation of the Administrative Law Judge - Uphold the 10 working day suspension.  

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Kevin Enright, Laborer/CDL, Hazlet Township, Department of Public Works, removal effective August 7, 2013, on charges of insubordination, inability to perform duties, violation of federal law/regulations concerning alcohol use by employees who operate commercial vehicles, other sufficient cause, violation of the Township policies on drug, alcohol and drivers licenses and violation of the attendance and sick leave  policy.  

 

Recommendation of the Administrative Law Judge - Modify the removal to a three month suspension.

 

ACTION:     The Civil Service Commission rejected the recommendation of the Administrative Law Judge and modified the removal to a six month suspension.

Robert Sparkes, Geographic Information Systems Specialist, Mapping, Township of West Milford, removal effective February 20, 2009, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and acknowledged the settlement.

 

A-11    BASEM ZAGHLOUL - CSC DOCKET NO. 2012-2210, OAL DOCKET NO. CSV: 01899-12

 

Basem Zaghloul, Police Officer, City of Newark, Police Department, 10 working day suspension on charges of conduct unbecoming a public employee, insubordination and violation of the Newark Police Department rules and regulations.

 

Recommendation of the Administrative Law Judge Uphold the 10 working day suspension.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1      CHANGE IN CLASSIFICATION PLAN - TITLE INACTIVATION AND COMMON

 

            The Division of Classification and Personnel Management requests the inactivation of four local titles and that two State titles be made common.

 

 

 

ACTION:       The Civil Service Commission directed that this request be granted.

B-2      CHANGE IN CLASSIFICATION PLAN - TITLE CREATION

 

            The Division of Classification and Personnel Management requests the creation of four new local trainee titles.

 

 

ACTION:       The Civil Service Commission directed that this request be granted.

B-3      CHANGE IN CLASSIFICATION PLAN - TITLE INACTIVATION

 

            The Division of Classification and Personnel Management requests the inactivation of the State Monitor Advocate title.

C. B., appeals her rejection as a County Correction Officer candidate by Union County Corrections and its request to remove her name from the eligible list for County Correction Officer (C9966M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-5      E. B. - CSC DOCKET NO. 2014-1105

 

E. B., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

J. P. D., appeals his rejection as a County Correction Officer candidate by Union County Corrections and its request to remove his name from the eligible list for County Correction Officer (C9966M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Barbara Belusik appeals the decision of the Division of Selection Services denying her request for a make-up examination for Taxpayer Service Representative 3 (PS2142U), Department of the Treasury.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-10    RICHARD A. FAIRLEY, JR. - CSC DOCKET NO. 2015-368

 

Richard A. Fairley, Jr., appeals the decision of the Division of Selection Services denying his request for a make-up examination for Social Service Technician (C0015S), Passaic County.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-11    EARL CAIN - CSC DOCKET NO. 2015-691

 

Freehold Township requests that Earl Cain be provided with a retroactive date of permanent appointment as a Police Sergeant.

B-12    OLUFEMI IJANDIPE - CSC DOCKET NO. 2014-2162

 

Olufemi Ijandipe, represented by Craig S. Gumpel, Esq., appeals the decision of the Division of Classification and Personnel Management, which upheld the removal of his name from the Fire Fighter (M2554M), City of Newark, eligible list due to his failure to meet the residency requirement.

B-17    SALVATORE MONTANTI - CSC DOCKET NO. 2014-2351

 

Salvatore Montanti, represented by William D. Sayers, Esq., appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Fire Fighter (M2578M), West Orange, eligible list on the basis of falsification of the employment application.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-18    NADEYAH SARMAD - CSC DOCKET NO. 2014-0629

 

Nadeyah Sarmad, a former Family Service Specialist 2 with the Department of Children and Families, represented by Laurie Taylor, CWA Local 1037, requests that the Civil Service Commission reinstate her appeal of her release at the end of the working test period effective September 9, 2013, which was dismissed based on the petitioner and her union representative's failure to appear at the scheduled hearing.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-19    MICHAEL D'ERRICO - CSC DOCKET NO. 2014-1992

 

Michael D'Errico appeals the decision of the Division of Classification and Personnel Management that his position with the Department of the Treasury is properly classified as an Investigator 2, Taxation.  The appellant seeks an Investigator 1, Taxation job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-20    BRETT HAMLIN - CSC DOCKET NO. 2014-1007

 

Brett Hamlin appeals the decision of the Division of Classification and Personnel Management which found that his position with the Department of the Treasury is correctly classified as Technical Assistant 2, Treasury.  The appellant seeks an Investigator 3, Taxation job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-21    CAROL HODGE - CSC DOCKET NO. 2015-161

 

Carol Hodge appeals the decision of the Division of Classification and Personnel Management that the proper classification of her position with the Civil Service Commission is Customer Service Information Specialist 3.  The appellant seeks a Principal Clerk job classification.

B-23    GLENN PULLIAM - CSC DOCKET NO. 2014-1256

 

Glenn Pulliam appeals the decision of the Division of Classification and Personnel Management that the proper classification of his position with the Department of Health is Occupational Health Consultant 1. The appellant seeks a Research Scientist 2 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-24    ANTHONY TARR - CSC DOCKET NO. 2014-1945

 

Anthony Tarr appeals the determination of the Division of Classification and Personnel Management that his position with the Department of Human Services is properly classified as Analyst 1, Health Care Facilities (Mental Health Services).  The appellant seeks a Section Supervisor, Fiscal Resources job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-25    VALERIE TUCKER-TROWER - CSC DOCKET NO. 2014-2712

 

Valerie Tucker-Trower appeals the decision of the Division of Classification and Personnel Management which found that her position with the Department of Health is properly classified as Public Health Representative 2, Communicable Disease.  The appellant seeks a Public Health Representative 1, Communicable Disease job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied and the appellant's current classification undergo a classification review.

 

B-26    G. N.  - CSC DOCKET NO. 2014-2502

 

G. N., a Senior Examiner, Unemployment Tax with the Department of the Labor and Workforce Development, appeals the determination of the Office of Diversity and Compliance, Department of Labor and Workforce Development, which determined that D. W. did not falsely allege that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-27    JUVENILE DETENTION OFFICER (C0788P), CAMDEN COUNTY - CSC DOCKET NO. 2015-677

 

Camden County requests that the eligible list for Juvenile Detention Officer (C0788P), be extended for one year beyond its original expiration date.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-28    CRISTINA OLIVIERI - CSC DOCKET NO. 2014-2227

 

Cristina Olivieri, a former Family Service Specialist Trainee with the Department of Children and Families, petitions the Civil Service Commission for reconsideration of the final administrative decision, rendered on May 14, 2014, in which the Director of the Division of Appeals and Regulatory Affairs denied her request for a hearing with respect to her release at the end of her working test period.

 

ACTION:       The Civil Service Commission directed that this petition be denied.

 

B-29    ANGELA ANDERSEN - CSC DOCKET NO. 2015-255

 

Angela Andersen appeals the determination of the Division of Selection Services that she did not meet the experience requirements for the promotional examination for Clerk 2 (PM0322S), Long Beach Township.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-30    DAWN BLAKE - CSC DOCKET NO. 2015-327

 

Dawn Blake appeals the determination of the Division of Selection Services that she did not meet, per the substitution clause, the experience requirements for the promotional examination for Program Monitor (PC0413S), Ocean County Prosecutor's Office.

 

ACTION:       The Civil Service Commission directed that this appeal be denied and the appellant's provisional position undergo a classification review.

 

B-31    TYRONE BRINKLEY - CSC DOCKET NO. 2014-2822

 

Tyrone Brinkley appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirement for the promotional examination for Supervisor, Repair and Maintenance (PM2298R), East Orange Water Department.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-32    EDWARD CONKLIN, ET AL. - CSC DOCKET NO. 2014-1525

 

Edward Conklin, Ronald Fernandez and Matthew Lopes appeal the administration of the Entry Level Law Enforcement Examination (S9999R), Statewide.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-33    LOUIS DELGADILLO - CSC DOCKET NO. 2014-2682

 

Louis Delgadillo appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirement for the promotional examination for Public Health Representative 1 Communicable Disease (PS2925H), Department of Health.

 

ACTION:       The Civil Service Commission directed that this appeal be denied and the appellant's provisional position undergo a classification review.

 

B-34    YVONNE HERNANDEZ - CSC DOCKET NO. 2014-3166

 

Yvonne Hernandez appeals the determination of the Division of Selection Services, which found that, per the substitution clause for education, she did not meet the experience requirement for the promotional examination for Personnel Assistant 2 Employee Relations (PS6821G), Department of Environmental Protection.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

The City of Margate, on behalf of Jessica Fane, requests that she be permitted to participate in the intergovernmental transfer program and to complete her working test period as a Police Officer with Margate.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-49    JERRY BURGOS - CSC DOCKET NO. 2015-678

 

The Township of Hazlet requests that the eligible list for Police Sergeant (PM2590J), be revived in order to appoint Jerry Burgos effective May 1, 2012.

B-64    MANAGEMENT ASSISTANT (SPECIAL), CITY OF NEWARK -

            CSC DOCKET NO. 2014-2047

 

The appointing authority's failure to dispose of the certification for Management Assistant (Special), City of Newark, while a provisional is serving in the title, has been referred to the Civil Service Commission for enforcement.

 

ACTION:       The Civil Service Commission ordered the appointing authority to remove the provisional appointee, make an appointment from the certification, and pay compliance costs.
