NOTICE OF PUBLIC HEARING
WATER INFRASTRUCTURE PROTECTION ACT
EMERGENT CONDITIONS

PLEASE TAKE NOTICE that on Monday, June 30, 2025, at 7:30 pm, the Township of Mendham is holding a Public Hearing during the regularly scheduled meeting of the Governing Body at the Mendham Township Town Hall, 2 West Main Street, Brookside, NJ 07926 on the proposed Emergent Condition Certification in connection with the Township’s wastewater systems (the “Systems”) in accordance with the Water Infrastructure Protection Act, N.J.S.A. 58:30-1 et seq. (“WIPA”). The proposed Emergent Condition Certification is based on the findings presented in the report prepared by French & Parrello Associates, Township Engineer, entitled “Sanitary Sewer System Emergent Condition Analysis Mendham Township Morris County, New Jersey” available on the Township’s website at www.mendhamtownship.org . The report notes the existence of two (2) specific Emergent Conditions within the Systems, Emergent Conditions #4 and #5 as set forth in WIPA. Under Emergent Condition #4, there is a demonstrated lack of historical investment, repair, or sustainable maintenance, or material damage to the infrastructure of the system. Under Emergent Condition #5, the Township lacks the financial, technical, or managerial capacity to adequately address any of the Emergent Conditions on a sustainable basis or own and operate the system in a way that supports economic activity in the Township on a sustainable basis. The financial report prepared by the Township’s independent financial advisor, NW Financial Group, LLC, found that the sale of the Systems would produce an economic benefit to the Township. The certification of certain Emergent Conditions by the Township is in anticipation of a proposed sale of the Systems to a capable private or public entity in accordance with the provisions of WIPA.
