Chapter 193: Remedial Services
Chapter 193 programs provide remedial services such as:
- Evaluation and determination of eligibility for special education
- Supplemental instruction
- Speech-language services
Chapter 193 programs must be supplemental to federal Individuals with Disabilities Education Act (IDEA) programs.
General Eligibility Criteria
To be eligible for Chapter 193, a student must:
- Reside in New Jersey
- Be between the ages of 5 and 21 years and in grades K–12
- Attend a nonpublic school, full-time, that is registered with the State of New Jersey
- Meet the NJDOE criteria for the specific service
- Have parent or guardian consent as indicated by a signed 407-1 form
Boarding Students
If the student boards at a nonpublic school in New Jersey, the state in which the parent or guardian resides is the child's state of residence.
Non-Residents
Students who live in a state other than New Jersey are eligible for Chapter 193 Evaluation & Determination of Eligibility for Services, including Speech-only Evaluation, as follows:
- Initial evaluation—First time student is evaluated
- Speech-only evaluation—This evaluation type is indicated when the nonresident student requires speech-language evaluation only (no other evaluation is being requested or provided)
- Annual Review—Yearly with exception of years when a reevaluation is done; cannot be conducted more often unless parent and district agree it is warranted
- Reevaluation—Every three years from date of initial review or last reevaluation; cannot be conducted less than one year from date of most recent evaluation unless parent and district agree it is warranted

Supplemental Instruction
Supplemental instruction may not replace the instruction provided by the general education teacher.
Supplemental instruction must be:
- Specified in the student's service plan
- Delivered by an appropriately certified teacher to:
- An individual student, or
- A group of no more than six students
Speech Language Services
Speech language services may be provided to students with disabilities in addition to the regular instructional program. These services include language, articulation, voice, and fluency.
Speech language services must be:
- Specified in the student's service plan
- Delivered by an appropriately certified teacher to:
- An individual students, or
- Groups of no more than five students
