If you believe that your employer has not properly paid you, or you have a complaint against an employer for violating a NJ Labor Law enforced by Wage & Hour, file a wage complaint:

To file anonymously, file by mail or fax. Write “ANONYMOUS” in the name section of the complaint form and leave address blank. You won’t receive information about your complaint or be able to check its status.

NJDOL does not ask about citizenship and serves all workers regardless of their immigration status. NJDOL will not share any information, including with immigration agencies, unless required by law or regulations.

When does the law go into effect?

Will the Department be making the temporary laborer assignment notification form linked to above available to temporary help service firms in Spanish and other languages?

What does the law empower the Department of Labor and Workforce Development to do when they find that a temporary help service firm has violated the provisions of the new law that go into effect on May 7, 2023?

Is there any way for a temporary laborer who has been harmed by a violation of the new law by the temporary help service firm that employs them to receive money damages, and/or in the case of illegal retaliation, to be reinstated to their job?

I know that on May 7, 2023, the “Temporary Laborer Assignment Notification” requirement and the anti-retaliation provisions of the law became effective, but what additional requirements go into effect on August 5?

I’m the owner of a temporary help service firm located in New Jersey. Must I comply with the requirements of the new law with regard to a temporary laborer if I’m assigning that temporary laborer to work for a third-party client in New York?

Where the “Temporary Laborer Assignment Notification” form requires the firm to indicate the duration of the assignment, will “on-going,” “to be determined or TBD,” or “dependent on performance,” satisfy this requirement?

Where the “Temporary Laborer Assignment Notification” form requires the firm to indicate whether any licenses are required for the assignment, does that include certifications, such as an OSHA forklift certification?

The “Temporary Laborer Assignment Notification” form asks separately for both the “name and nature of [the] work to be performed” and a “description of the position.” Aren’t those the same thing?

When does the requirement become effective that temporary help service firms located, operating or transacting business within New Jersey, and making designated classification placements, must become certified by the Director of the Division of Consumer Affairs?

Are temporary laborers required to keep for their records, each “Temporary Laborer Assignment Notification” form that it is provided by the temporary help firm at the time of dispatch?
