Intelligrants (IGX) is the system of record for training providers.

As a training program provider, you may have questions about data collection requirements, Eligible Training Provider List (ETPL) listing, and how the Department of Labor deals with Quality Assurance. You can find answers to your questions here.

This guidance is designed to help occupational training providers in New Jersey comply with state law, which requires joint approval from the New Jersey Department of Education (NJDOE) and the New Jersey Department of Labor and Workforce Development (NJDOL) to operate as a Private Career School (PCS). This information assists:

  • Training providers determining how to become compliant with New Jersey law.
  • Workforce partners and funders appropriately referring organizations for PCS and ETPL eligibility; and
  • Users of the Intelligrants (IGX) portal determining which type of application to initiate.

It also serves as a notice to unapproved providers that offering occupational training to the public without proper school authorization is in violation of New Jersey state law.

PCS status is governed by one statute and two sets of regulations, each serving a different purpose:

  • N.J.S.A. 34:15C-10.1 defines private career schools and assigns joint responsibility to NJDOL and NJDOE for approving them and describes their oversight role.
  • N.J.A.C. 12:41 is NJDOL’s administrative code detailing requirements for PCS initial application, renewal, performance reporting, and financial soundness.
  • N.J.A.C. 6A:19 is NJDOE’s administrative code outlining instructional, operational, and programmatic standards for private career schools.

Together, these legal authorities establish what constitutes a PCS and how it must operate in New Jersey.

Some providers are already governed as schools by other public agencies and do not need PCS approval. These include institutions governed by:

  • New Jersey Department of Education (NJDOE): Includes adult high schools and County Vocational-Technical School Districts.
  • New Jersey Office of the Secretary of Higher Education (OSHE): Licenses degree-granting institutions of higher education.
  • New Jersey State Police (SORA): Authorizes schools offering security officer training.
  • Motor Vehicle Commission (MVC): Governs licensed driver training schools.
  • Federal Aviation Administration (FAA): Oversees flight and aviation-related schools.
  • U.S. Department of Labor Office of Apprenticeship: Governs Registered Apprenticeship Programs (RAPs).
  • New Jersey Board of Cosmetology and Hairstyling: Licenses cosmetology schools and their instructors
  • New Jersey Department of Banking and Insurance (DOBI), Real Estate Commission: Licenses real estate schools, instructors, and courses

If your organization is not licensed as a school by one of the entities above, you are likely required to become a PCS, even if you offer programs that prepare students for occupations regulated by other boards.

Some boards or agencies license individuals or approve programs, but they do not license training institutions. If your school is not otherwise governed, PCS status is required.

Common examples include:

  • New Jersey Department of Health (DOH): Oversees CNA and EMT training programs.
  • Board of Nursing (BON): Approves Home Health Aide (HHA) and Licensed Practical Nurse (LPN) programs, and licenses individuals.
  • Division of Consumer Affairs (DCA): Encompasses multiple boards (e.g., massage therapy, electrical work, HVAC) that license individuals but do not license training institutions or programs.

These agencies may regulate the occupation, but not the school. If your organization is not already governed as a school, you must apply as a PCS even if your programs meet occupational licensure requirements.

Some forms of training are exempt from federal Eligible Training Provider List (ETPL) requirements under the Workforce Innovation and Opportunity Act (WIOA), as outlined in 20 CFR § 680.530. These include:

  • On-the-Job Training (OJT)
  • Customized Training
  • Incumbent Worker Training
  • Internships and work experiences
  • Transitional jobs
  • Pay-for-performance contracts

These types of training do not require ETPL listing. However,  if your organization offers occupational skills training to the public, you are likely subject to New Jersey’s PCS law, regardless of ETPL listing requirements.

If you are seeking PCS approval or ETPL eligibility, register in Intelligrants (IGX). IGX is NJDOL’s system of record for PCS and ETPL applications, reporting, and communication.

If you are a qualifying school, being approved as a PCS is required to operate legally under NJ law. Approval also allows your programs to appear on the Eligible Training Provider List (ETPL), which provides:

  • Visibility on the NJ Training Explorer, visited by thousands of people each week.
  • Eligibility for federal WIOA tuition subsidies for qualified students.
  • Access to state training grant opportunities administered by NJDOL.

The Eligible Training Provider List (ETPL) as envisioned by state and federal law, is critical to ensure that the highest level of training services is available to the citizens of New Jersey. The Workforce Innovation and Opportunity Act (WIOA) provides that participants in need of training services to enhance their job readiness or career pathway may access career training through a list of state‐approved training providers and their state‐approved training programs, known as the ETPL. The ETPL is essential not only to the workforce system, but to all New Jerseyans making an informed customer choice about available training opportunities. New Jersey State law (C:34:1A‐86) mandates the collection and display of specific provider and program performance data on the Consumer Report Card. The student record data submitted by providers populates the Consumer Report Card (CRC). The Consumer Report Card was restructured in July 2021 as the Quality Assurance Scorecard measuring equity in training and employment outcomes for labor market demand, education and training, employment and wage outcomes, and financial impact. The quality assurance scorecard aims to add a critical layer of consumer protection for NJ’s current and future students and encourage a culture of continuous program quality and improvement for NJ’s eligible training providers.

The CRC allows students to search for information and program outcomes for training providers. The search results provide information on the various programs offered by each approved training provider and allow the user to compare programs and providers based on information such as the location and length of training, the costs and any special services that may be offered, as well employment outcomes and student comments.

New Jersey Department of Labor and Workforce Development (NJDOL) requires all Private Career Schools are required to be on the ETPL. All Private Career Schools and programs listed on the ETPL are required to submit reports into the NJDOL Intelligrants (IGX) system.

The Private Career School initial application must be completed by any business enterprise that does business in New Jersey and recruits adult students from the public; charges tuition and/or fees; offers instruction to a group or groups of four or more adult students at one time; and offers preparatory instruction for entry-level employment or for upgrading in a specific occupational field. The Initial Application for a Private Career School includes the ETPL application. There is no need to complete an additional application to be on the ETPL.

The Private Career School Renewal Application must be completed every two years by all approved private career schools and submitted no later than 90 calendar days prior to the expiration date of each school's current Certificate of Approval. Failure to submit this application within the prescribed 90 days may result in a lapse in approval to provide training.

What certifications do I need to keep updated to ensure compliance throughout my approval period?  

All PCS' must maintain the following up-to-date materials:

  • Tuition performance bond
  • Professional liability insurance
  • Fire certificate (for in-person instruction locations only)
  • Health certificate (if applicable)
  • Lease (if school is rented)

What information am I required to upload into my Intelligrants (IGX) account to ensure compliance throughout my approval period?

  • Quarterly list of SSNs of all New Jersey students who entered and exited.
  • Annual report
  • Student transcripts

What student information am I required to report?

All training providers submitting student records into the Intelligrants IGX system must do so on a quarterly basis following the schedule outlined below. Each quarter, every ETPL provider is required to upload data about all students who enrolled in that quarter (entrants) and all students who completed or left training during that quarter (exiters). The entrants and exiters files require the following information fields for all students enrolled in the program, including private pay students.

  • Social Security Number
  • Full name (with correct spelling)
  • Address
  • Sex
  • Race/Ethnicity
  • Disability Status
  • Entry date: date of enrollment
  • Exit date: date of completion, date of termination
