    A regular meeting of the Civil Service Commission was held on Wednesday, May 22, 2024, at 10:00 a.m., in Trenton, New Jersey.

 

    PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca Daniel W. O’Mullan, and Christina Mongon; Levi Klinger-Christiansen, Deputy Attorney General; Dulce A. Sulit-Villamor, Deputy Director, Division of Appeals and Regulatory Affairs; and Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

     In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

     Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2023, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

A-2    ERIC ADAMS – CSC DOCKET NO. 2023-228

 

Eric Adams, Assistant Director of Finance, City of Newark, removal, effective June 28, 2022, on charges of incompetency, inefficiency or failure to perform duties; insubordination; inability to perform duties; conduct unbecoming a public employee; neglect of duty; and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    MARK DE AZEVEDO – CSC DOCKET NO. 2022-1795

         

Mark De Azevedo, Police Officer, Rahway, Police Department, removal, effective September 10, 2021, on charges of incompetency; conduct unbecoming a public employee; neglect of duty; and other sufficient cause.

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    MICHAEL GROSSMAN – CSC DOCKET NO. 2020-2238       

 

Michael Grossman, Correctional Police Sergeant, Southern State Correctional Facility, Department of Corrections, removal, effective February 18, 2020, on charges of conduct unbecoming a public employee; other sufficient cause; and violation of administrative procedures and regulations.

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 SECTION B – MISCELLANEOUS MATTERS

 

B-1    A.C. – CSC DOCKET NO. 2023-1740

 

A.C., represented by Stephen B. Hunter, Esq., appeals his rejection as a Police Officer candidate by Teaneck and its request to remove his name from the eligible list for Police Officer (M0152D).

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-2    N.C. – CSC DOCKET NO. 2023-2569

 

N.C., represented by Michael L. Prigoff, Esq., appeals his rejection as a Fire Fighter candidate by Nutley and its request to remove his name from the eligible list for Fire Fighter (M1859W).

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    ALEXANDRE GABLER – CSC DOCKET NOS. 2024-646 and 2024-1028   

 

Alexandre Gabler appeals the removal of his name from the eligible list for Librarian 3 (M0424E), Elizabeth Library, and requests other relief. 

 

ACTION:     The Civil Service Commission directed that these appeals be denied.     

 

B-4    JONATHAN JENKINS– CSC DOCKET NO. 2023-2688

 

Jonathan Jenkins, represented by Lori A. Dvorak, Esq., requests that the eligible list for Police Sergeant (PM0812V), Irvington, be revived and additional relief be granted.

 

ACTION:     The Civil Service Commission directed that this request be granted in part.

 

B-5    JAMES BELLAMY – CSC DOCKET NO. 2024-2203

 

Hudson County requests to transfer County Correctional Police Sergeant James Bellamy from the Somerset County Sheriff’s Office, a non-Civil Service jurisdiction, to the title of County Correctional Police Officer.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

 

B-6    GEISA PEDREIRA – CSC DOCKET NO. 2023-2617

 

Geisa Pedreira appeals the determination of the Division of Agency Services that she was ineligible for the promotional examination for Human Services Specialist 4 (PC2358E), Mercer County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    D.P. – CSC DOCKET NO. 2023-2412

 

D.P., an Executive Secretary with the Department of Law and Public Safety, Division of Consumer Affairs, appeals the determination of the Division of Equal Employment Opportunity/Affirmative Action, Civil Service Commission, which found that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-8    SEAN MCMANUS – CSC DOCKET NO. 2024-1445

 

Sean McManus, a Conservation Police Officer 2 with the Department of Environmental Protection (DEP), represented by David Beckett, Esq., requests reconsideration of the final decision of the Civil Service Commission, rendered on November 22, 2023, ordering that the DEP recalculate McManus’ rate of cash overtime compensation in accordance with the decision of the Superior Court of New Jersey, Appellate Division, in In the Matter of Sean McManus, Docket No. A-0845-20 (App. Div. August 1, 2023).

           

ACTION:     The Civil Service Commission directed that this appeal be granted in part and denied in part.

 

B-9    RYAN HICKMAN – CSC DOCKET NO. 2024-1846

 

Ryan Hickman, a Police Sergeant with the Borough of Stanhope, represented by Frank C. Cioffi, Esq., petitions the Civil Service Commission for interim relief of his indefinite suspension.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part and transmitted to the Office of Administrative Law for a hearing.

 

B-10   MODEL TELEWORK PILOT PROGRAM– CSC DOCKET NO. 2024-2187

         

The Chairperson of the Civil Service Commission recommends extending the Model Telework Pilot Program established by the Civil Service Commission at its meeting on April 6, 2022.

 

ACTION:     The Civil Service Commission directed that this recommendation be granted.

 

B-11   REGULATORY OFFICER, CIVIL SERVICE COMMISSION, AND PERSONNEL AND LABOR ANALYST TITLE SERIESCSC DOCKET NO. 2024-2338

 

The Division of Agency Services requests the establishment of a new title series, Regulatory Officer, Civil Service Commission (CSC), including the creation of a noncompetitive trainee title within the title series; the cross walk of incumbents from the Personnel and Labor Analyst title series to the Regulatory Officer, CSC, title series; and the inactivation of the Personnel and Labor Analyst title series.

 

ACTION:     The Civil Service Commission directed that this request be granted.
