    A regular meeting of the Civil Service Commission was held on Wednesday, November 22, 2023, at 10:00 a.m., in Trenton, New Jersey.

 

    PRESENT: Allison Chris Myers, Chairperson; Members Delores Gorczyca, Daniel O’Mullan; Diomedes Tsitouras and Christina Mongon; Levi Klinger-Christiansen, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

    In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 23, 2022, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

ACTION:     The Civil Service Commission acknowledged the settlements.

 

A-2    ROBERT MCCAULEY – CSC DOCKET NO. 2021-1452

 

Robert McCauley, Senior Correctional Police Officer, Southern State Correctional Facility, Department of Corrections, removal, effective March 26, 2021, on charges of conduct unbecoming a public employee and other sufficient cause.      

 

Recommendation of the Administrative Law Judge – Uphold the removal. 

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    MICHAEL SOSA – CSC DOCKET NO. 2022-1326

 

Michael Sosa, Police Officer, Newark, Department of Public Safety, 94 working day suspension, on charges of neglect of duty and violation of various departmental policies. 

 

Recommendation of the Administrative Law Judge – Modify the 94 working day suspension to a six working day suspension.

 

ACTION:     The Civil Service Commission imposed a 30 working day suspension.

 

A-4    MARTINIQUAN WHITE – CSC DOCKET NO. 2022-84

 

Martiniquan White, Bus Driver, Trenton Psychiatric Hospital, Department of Health, removal, effective June 21, 2021, on charges of insubordination, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the removal to a six-month suspension.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

  

SECTION B – MISCELLANEOUS MATTERS

 

B-1    JENNY ALVARADO – CSC DOCKET NO. 2023-993

 

Jenny Alvarado appeals the removal of her name from the Judiciary Clerk 2, Bi-lingual in Spanish/English (S0979A), Vicinage 2, Bergen County eligible list due to her failure to appear/complete the pre-employment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    NICOLE BARRINGER AND JENNIFER CAHILL – CSC DOCKET NOS. 2024-528 AND 2024-529

 

Nicole Barringer and Jennifer Cahill appeal the bypass of their names on the Human Services Specialist 4 (PC4888D), Camden County Board of Social Services eligible list.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-3    MICHAEL DAVIS – CSC DOCKET NO. 2024-480

 

Michael Davis, represented by Stephen B. Hunter, Esq., appeals the bypass of his name on the Police Sergeant (PM4658C), Union Beach eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

Kevin Maguire appeals the bypass of his name on the Fire Captain (PM2335C), Millburn eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    MADONNA MORRIS AND PAMELA FELTS – CSC DOCKET NOS. 2023-1522 AND 2023-1523

 

Madonna Morris and Pamela Felts, represented by Randi Doner April, Esq., appeal the bypasses of their names on the Personnel Aide (PM0395D), Jersey City School District eligible list.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

  

B-6    JONNEL CUFF – CSC DOCKET NO. 2023-2794

 

Jonnel Cuff appeals the determination of the Division of Agency Services, which found that, per the substitution clause for education, she did not meet the experience requirement for the open competitive examination for Personnel Aide (M0067E), Camden City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    DIANA LEON – CSC DOCKET NO. 2023-2698

 

Diana Leon appeals the determination of the Division of Agency Services, which found that she did not meet the permanent service requirement for the promotional examination for Human Services Specialist 3, Bilingual in Spanish and English (PC2159E), Ocean County Board of Social Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-8    JEFFREY RAPCIEWICZ – CSC DOCKET NO. 2023-2680

 

Jeffrey Rapciewicz appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirement for the promotional examination for Records Technician 2, Motor Vehicles (PS0258T), Motor Vehicle Commission.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    MELISSA SOTO – CSC DOCKET NO. 2023-1427

 

Melissa Soto appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Supervisor 1, MVC (PS8980T), Motor Vehicle Commission.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-10   CHARLES DEAL – CSC DOCKET NO. 2024-364

 

Charles Deal appeals the determination of the Division of Agency Services which denied his request for a make-up for the open competitive examination for the 2023 Law Enforcement Examination, various titles and jurisdictions.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11   JOSEPH CRITCHLEY – CSC DOCKET NO. 2023-1900

 

Joseph Critchley appeals his score on the promotional examination for Deputy Fire Chief (PM5155C), Bloomfield.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12   VICTOR GAROFALO – CSC DOCKET NO. 2023-1780

 

Victor Garofalo appeals his seniority score for the promotional examination for Fire Captain (PM4449C), Atlantic City. 

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13   K.D. – CSC DOCKET NO. 2023-417

 

K.D., a Program Support Specialist 2, Assistance Programs with the Department of Children and Families, appeals the determination of the Deputy Commissioner, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14   M.S. – CSC DOCKET NO. 2024-322

 

M.S., an Assistant Chief, Wage and Hour Compliance with the Department of Labor and Workforce Development, appeals the determination of the Chief of Staff, which substantiated in-part, that she was subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15   ANN DODD – CSC DOCKET NO. 2023-2571

 

Ann Dodd, represented by Nicholas P. Milewski, Esq., challenges the appointment of Amy Rochette to the title of Chief Clerk.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

  

B-16   SEAN MCMANUS – CSC DOCKET NO. 2024-249

 

The Superior Court of New Jersey, Appellate Division, vacated and remanded the decision of the Civil Service Commission denied the reconsideration request of Sean McManus, a Conservation Police Officer 2 with the Department of Environmental Protection, concerning his grievance on the rate of his cash overtime compensation for emergency-related work.

 

ACTION:     The Civil Service Commission ordered the Department of Environmental Protection to recalculate the rate of cash overtime compensation and compensate McManus accordingly.

 

B-17   CIVIL SERVICE COMMISSION MEETING DATES FOR 2024

 

The proposed 2024 Civil Service Commission meeting dates are submitted for approval.

 

ACTION:     The Civil Service Commission adopted the 2024 Civil Service Commission meeting dates.
