    A regular meeting of the Civil Service Commission was held on Wednesday, December 6, 2023, at 10:00 a.m., in Trenton, New Jersey.

 

    PRESENT: Allison Chris Myers, Chairperson; Members Delores Gorczyca, Daniel O’Mullan; and Diomedes Tsitouras; Craig Keiser, Deputy Attorney General; Nicholas F. Angiulo, Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary.  All individuals listed participated via teleconference.

 

    In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 23, 2022, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of November 22, 2023.

 

ACTION:      The Civil Service Commission adopted the minutes of its meeting of November 22, 2023.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Brian Bushong, Truck Driver, Heavy, Upper Township, Department of Public Works, Health and Grounds, removal.

 

Toshiko Harperin, Senior Practical Nurse, New Lisbon Developmental Center, Department of Human Services, removal.

 

Gary Reich, Laborer 1, Hunterdon County, Department of Public Works, release at the end of the working test period.

 

ACTION:     The Civil Service Commission noted the withdrawal of appeals without prejudice.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

William Stanford, Building Maintenance Worker, Jersey City Public Library, removal.

 

Ken Tejeda, Fire Fighter, Paterson, Fire Department, removal.

 

ACTION:     The Civil Service Commission noted the dismissal of appeals without prejudice.

ACTION:     The Civil Service Commission acknowledged the settlements.     

 

A-2    CARL CIDONI – CSC DOCKET NO. 2022-3253

 

Carl Cidoni, Graphic Artist 1, Middlesex County, Department of Purchasing, removal, effective June 14, 2022, on charges of conduct unbecoming a public employee and other sufficient cause.      

 

Recommendation of the Administrative Law Judge – Uphold the removal.  

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    BRUCE GOMOLA – CSC DOvCKET NO. 2022-2677

 

Bruce Gomola, County Correctional Police Officer, Burlington County Jail, resignation not in good standing, effective March 8, 2022. 

 

Recommendation of the Administrative Law Judge – Grant the appointing authority’s motion for summary decision and dismiss the appeal as moot.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 A-4    BENJAMIN MARKUS – CSC DOCKET NO. 2023-2658

 

Benjamin Markus, County Correctional Police Officer, Monmouth County, Sheriff’s Office, removal, effective May 2, 2023, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty, misuse of public property and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.    

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

SECTION B – MISCELLANEOUS MATTERS

 

B-1    E.B. – CSC DOCKET NO. 2023-2192

 

E.B. appeals her rejection as a Police Officer candidate by Delran and its request to remove her name from the eligible list for Police Officer (M0031D) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    N.C. – CSC DOCKET NO. 2023-1232

 

N.C., represented by Robert Chewning, Esq., appeals his rejection as a Police Officer candidate by Wood-Ridge and its request to remove his name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-3    A.H. – CSC DOCKET NO. 2023-1463

 

A.H., represented by Valerie Palma Deluisi, Esq., appeals his rejection as a Police Officer candidate by Clifton and its request to remove his name from the eligible list for Police Officer (S9999A) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission referred the matter for an independent psychological examination.

 

 B-4    CHRISTOPHER BROWN – CSC DOCKET NO. 2023-1867

 

Christopher Brown appeals the determination of the Division of Agency Services which found that he was ineligible for the promotional examination for Deputy Director Public Safety (PM5048C), Newark for failure to file a complete application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-5    JOSEPH CAPRIO – CSC DOCKET NO. 2023-1982

 

Joseph Caprio appeals his seniority score for the promotional examination for Fire Captain (PM4449C), Atlantic City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    STEVEN FOSTEK, JR. – CSC DOCKET NOS. 2024-244 AND 2024-39

 

Steven Fostek, Jr., appeals the multiple-choice portion of and seniority scoring for the promotional examination for Battalion Fire Chief (PM3384C), Harrison.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    TIMOTHY GAY – CSC DOCKET NO. 2023-1895

 

Timothy Gay appeals his score on the promotional examination for Deputy Fire Chief (PM5178C), Newark.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-8    ACCOUNTANT (C0244E), MERCER COUNTY– CSC DOCKET NO. 2024-615

 

Mercer County requests permission not to make an appointment from the July 28, 2023, certification for Accountant (C0244E), Mercer County.

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.        

  

B-9    DEPUTY MUNICIPAL EMERGENCY MANAGEMENT COORDINATOR (M0051E), HOBOKEN – CSC DOCKET NO. 2024-753

 

Hoboken requests permission not to make an appointment from the June 5, 2023, certification for Deputy Municipal Emergency Management Coordinator (M0051E), Hoboken.

 

ACTION:     The Civil Service Commission granted the appointment waiver and deferred selection costs.

 

B-10   FORESTER TRAINEE – CSC DOCKET NO. 2024-1043

 

The Division of Agency Services requests the reactivation of the Forester Trainee title in the non-competitive division of the career service in accordance with N.J.A.C. 4A:3-1.2.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-11   PUBLIC SAFETY TELECOMMUNICATOR FIRST RESPONDER APPRENTICE – CSC DOCKET NO. 2024-1119

 

The Division of Agency Services requests the creation of the title, Public Safety Telecommunicator First Responder Apprentice, State Police, and that it be allocated to the non-competitive division of the career service in accordance with N.J.A.C. 4A:3-1.2.

 

ACTION:     The Civil Service Commission directed that these requests be granted.
