A regular meeting of the Civil Service Commission was held on Wednesday, June 12, 2024, at 10:00 a.m., in Trenton, New Jersey.
PRESENT: Allison Chris Myers, Chairperson; Members Dolores Gorczyca, Daniel O’Mullan, and Christina Mongon; Levi Klinger Christiansen, Deputy Attorney General; Dulce A. Sulit-Villamor, Deputy Director, Division of Appeals and Regulatory Affairs; Annemarie Ragos, Commission Secretary. All individuals listed participated via teleconference.
In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2023, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

A-2 L.H.-P. – CSC DOCKET NO. 2022-1809
L.H.-P., Senior Parole Officer, Bilingual in Spanish and English, State Parole Board, removal, effective January 28, 2022, on charges of other sufficient cause.
Recommendation of the Administrative Law Judge – Grant the appointing authority’s motion for summary decision but modify the removal to a resignation in good standing.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-3 RANDY KELLY – CSC DOCKET NO. 2021-1815
Randy Kelly, Human Services Technician, Ancora Psychiatric Hospital, Department of Health, removal, effective September 28, 2020, on charges of conduct unbecoming a public employee, neglect of duty, other sufficient cause, and violations of administrative orders.
Recommendation of the Administrative Law Judge – Reverse the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-4 TYHAIRA MATLOCK – CSC DOCKET NO. 2022-206
Tyhaira Matlock, County Correctional Police Officer, Mercer County, Department of Corrections, removal, effective March 11, 2021, on charges of conduct unbecoming a public employee, neglect of duty, other sufficient cause, and violations of administrative procedures, rules, and regulations.
Recommendation of the Administrative Law Judge – Modify the removal to a 24-month suspension.
ACTION: The Civil Service Commission rejected the initial decision and acknowledged the settlement.
A-5 CHRISTY MATTHEWS – CSC DOCKET NO. 2022-2334
Christy Matthews, Keyboarding Clerk 1, Burlington County, Sheriff’s Department, release at the end of the working test period effective March 11, 2022.
Recommendation of the Administrative Law Judge – Uphold the release at the end of the working test period.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-6 THOMAS RIORDAN – CSC DOCKET NO. 2023-979
Thomas Riordan, Police Lieutenant, Vineland, Police Department, removal, effective November 15, 2021, on charges of conduct unbecoming a public employee, discrimination that affects equal employment opportunity, and other sufficient cause.
Recommendation of the Administrative Law Judge – Reverse the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-7 P.S. - CSC DOCKET NO. 2021-1812
P.S., County Correctional Police Sergeant, Union County, Department of Corrections, 10 working day suspension and demotion to County Correctional Police Officer, effective May 14, 2021, on charges of conduct unbecoming a public employee, discrimination that affects equal employment opportunity, and other sufficient cause.
Recommendation of the Administrative Law Judge – Uphold the 10 working day suspension and demotion.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
SECTION B – MISCELLANEOUS MATTERS
B-1 A.H. – CSC DOCKET NO. 2023-1463
A.H., represented by Valerie Palma Deluisi, Esq., appeals his rejection as a Police Officer candidate by the City of Clifton and its request to remove his name from the eligible list for Police Officer (S9999A).
ACTION: The Civil Service Commission directed that this appeal be granted.
B-2 A.M. – CSC DOCKET NO. 2023-2226
A.M., represented by Craig S. Gumpel, Esq., appeals his rejection as a Fire Fighter candidate by the City of Elizabeth and its request to remove his name from the eligible list for Fire Fighter (M1818W).
ACTION: The Civil Service Commission directed that this appeal be denied.
B-3 MONICA AUCAPINA – CSC DOCKET NO. 2024-1435
Monica Aucapina appeals the removal of her name from the eligible list for Sheriff’s Officer (C0220D), Hudson County.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-4 L.P. – CSC DOCKET NO. 2023-933
L.P., a Sergeant with the Division of State Police, Department of Law and Safety, appeals the determination of the Director, Office of Equal Employment Opportunity, which was unable to substantiate that he was subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-5 N.B. – CSC DOCKET NO. 2024-1837
N.B., an Administrative Assistant with the Department of Environmental Protection, appeals the determination by the Director, Office of Equal Opportunity and Public Contract Assistance, which was unable to substantiate that she was subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-6 ANDREW ECKERT – CSC DOCKET NO. 2024-1961
Andrew Eckert, represented by Stuart J. Alterman, Esq., requests reconsideration of In the Matter of Andrew Eckert (CSC, decided February 7, 2024).
ACTION: The Civil Service Commission directed that this appeal be denied.

B-7 MARCUS FULLER – CSC DOCKET NO. 2024-1441
Marcus Fuller, a Laborer 1 with Paterson, represented by Lisa Fittipaldi, Esq., petitions the Civil Service Commission for interim relief of his immediate suspension without pay.
ACTION: The Civil Service Commission directed that this petition be granted in part.
B-8 POLICE AIDE (M0686E), UNION TOWNSHIP – CSC DOCKET NO. 2024-1959
Union Township requests permission not to make an appointment from the November 13, 2023 certification for Police Aide (M0686E), Union Township.
ACTION: The Civil Service Commission granted the appointment waiver and deferred selection costs.
B-9 FISCAL YEAR 2024 SALARY REGULATIONS COMPENSATION COMPENDIUM
The Fiscal Year 2024 Salary Regulations Compensation Compendium includes the following: Section 1 - Aligned Salary Regulation, Non-Aligned Salary Regulation, and Attachments A and B; Section 2 - Emergency Conditions Salary Regulation; Section 3 - Special Incentive Salary Regulation; Section 4 - Miscellaneous Salary Regulation. The Compendium has been approved by Allison Chris Myers, Chair/Chief Executive Officer, Civil Service Commission, and Tariq Shabazz, Acting Director, Office of Management and Budget.
ACTION: The Civil Service Commission recorded the regulations.
