About the Board of Review

The Board of Review is the highest appellate level within the Department of Labor and Workforce Development for deciding Unemployment and Temporary Disability Insurance benefit disputes, including demands for refunds of benefits.

Decisions issued by the Appeal Tribunal, the lower appellate level, will become final unless an interested party to a decision files an appeal in writing to the Board of Review within twenty days of the date of mailing or notification of the issued decision.

The Board of Review normally does not conduct hearings. Most appeals to the Board of Review are decided based on the record created at the Appeal Tribunal hearing. Therefore, it is important to provide a detailed written argument to the Board of Review when protesting an Appeal Tribunal decision.

In rendering a decision, the Board of Review either affirms, modifies, or reverses the decision of the Appeal Tribunal.

When affirming an Appeal Tribunal decision, the Board of Review has agreed with the decision of the Appeal Tribunal and the decision will stand.

Modifying the decision of an Appeal Tribunal means the Board of Review has changed the decision in some way. A modification may be favorable or unfavorable to the appellant of an Appeal Tribunal decision.

When reversing an Appeal Tribunal decision, the Board of Review has disagreed with the decision of the Appeal Tribunal. This means that the appellant of an Appeal Tribunal decision has prevailed.

A remand by the Board of Review means the matter is being returned to the Appeal Tribunal or the Division Deputy to supplement the record, or for some other stated reason which may affect entitlement to benefits.  

Most appeals to the Board of Review are decided based on the record created at the Appeal Tribunal hearing. Therefore, it is important to provide a detailed written argument to the Board of Review when protesting an Appeal Tribunal decision.

  • Understand how similar cases were handled and give you an idea of what you may expect.
  • Learn what arguments or points were successful in past hearing can help you build a stronger case.
  • Better understand the rules and criteria used in making these decisions.

NOTE: While you are waiting for the appeal hearing, continue to certify weekly for your Unemployment Insurance benefits. This action gives you credit for these weeks pending the results of the hearing. You must also report to any appointments we schedule. Failure to do so may result in the loss of benefits, even if you win your appeal.

Please include the identifying information associated with the hearing and the reason(s) for requesting the recording. In some instances, a nominal cost of duplicating the recording is involved.

Written transcripts are only prepared for cases appealed to the Appellate Division of the New Jersey Superior Court. In lieu of a transcript, a copy of the Appeal Tribunal recording may be requested as indicated above.

The decision rendered by the Board of Review is the final administrative decision of the Department of Labor.

Any interested party to a proceeding before the Board of Review may secure judicial review of the final decision of the Board of Review by filing a written appeal within 45 days of the mailing date of the decision.
